At Cork District Court on 1 October 2026, Judge David Waters struck out three criminal-damage charges against James Spillane and rejected remanding him in prison as a substitute for psychiatric care. The Irish Examiner reported that concerns had been raised about Spillane’s ability to engage with the plea process, but no psychiatric report was available at the hearing.
What happened at Cork District Court?
According to the Irish Examiner’s report by Liam Heylin, published 1 October 2026, Spillane, 35, of no fixed address, had been in custody since 25 September. He faced three counts of criminal damage relating to parked cars at Kyrl’s Quay in Cork City. The alleged damage took place at about 10:30 p.m. on 2 September.
Spillane appeared by video link from prison. The report said the court was concerned about his ability to plead because of mental-health issues, and that no psychiatric report was available after only a week in custody. Solicitor Eddie Burke described him as starting to answer questions and then trailing off into murmured, irrelevant comments. Judge Waters said his own interaction with Spillane matched that description.

Those accounts describe what was reported at the hearing; they are not an independent clinical assessment or a confirmed diagnosis. Garda Jane Delahunty told the court: “I believe he is a danger to the public, to the gardaí and to himself. He is a vulnerable person. I do not believe he is aware of what he is doing.”

Why did the judge reject prison remand as a substitute for care?
Judge Waters said he would strike out the three charges and would not engage in “some kind of preventative detention”. As reported by the Irish Examiner, he said: “I am not going to plug the gap for the State by remanding him in prison”. He also said that if psychiatric services were so poor there was no provision for Spillane’s care, he would not remand him in custody as an alternative.
That was the judge’s reported decision in this case, not a general legal rule that applies automatically whenever an accused person has mental-health needs. The report does not establish what happened in later proceedings, whether the charges were brought again, or what care Spillane subsequently received.
How does Irish law address fitness to be tried?
Ireland’s Criminal Law (Insanity) Act 2006 sets out a fitness-to-be-tried test. A person is unfit because of mental disorder if they cannot understand the nature or course of proceedings sufficiently to plead, instruct a legal representative, make a proper defence, or understand the evidence.
For summary proceedings in the District Court, the court decides whether the accused is fit. If it finds the person unfit, the Act provides for an adjournment and, subject to statutory conditions and medical evidence, orders for care or treatment in a designated centre. The reported account does not say that Judge Waters made a finding of unfitness under the Act; it describes concerns about Spillane’s ability to plead and the lack of a psychiatric report at that hearing.

Can a prisoner be transferred from prison for treatment?
The 2006 Act provides a separate mechanism for transferring a prisoner from prison to a designated centre for care or treatment. It requires written certification that appropriate care or treatment cannot be provided in that prison. This is statutory context, not an account of a step taken in Spillane’s case: the Irish Examiner report does not say that a transfer was sought or assessed.
