Consumers have filed a proposed class action alleging that eight Starbucks protein drinks marketed with “Sugar-Free” in their names contain 13–21 grams of sugar in a venti serving. Starbucks disputes the claims, saying it adds no sugar and that the sugar comes from its protein-boosted milk. The case is unresolved; the allegations have not been established by a court.
Which Starbucks drinks are named in the lawsuit?
The complaint names eight drinks, covering four flavors or types in hot and iced versions:
- Sugar-Free Vanilla Protein Latte
- Sugar-Free Caramel Protein Latte
- Sugar-Free Vanilla Protein Matcha
- Sugar-Free Caramel Protein Matcha
- Iced Sugar-Free Vanilla Protein Latte
- Iced Sugar-Free Caramel Protein Latte
- Iced Sugar-Free Vanilla Protein Matcha
- Iced Sugar-Free Caramel Protein Matcha
Plaintiffs allege that venti servings contain 13–21 grams of sugar. Those are complaint figures, not independently verified laboratory results. The Associated Press reported a dated U.S. menu snapshot on October 5, 2026: the 16-ounce Sugar-Free Caramel Protein Matcha listed 16 grams, and its 20-ounce version listed 21 grams. Those examples cover one drink, not every product or size, and menu listings can change.

Plaintiffs’ position
The plaintiffs argue that “Sugar-Free” in the product names describes the finished beverages, which they allege contain sugar contributed by milk. The complaint alleges violations of federal labeling rules and state consumer-protection laws. Plaintiffs’ counsel says the case seeks repayment and corrective relief. These are claims made by the plaintiffs, not findings that Starbucks violated the law.

Starbucks’ response
Starbucks says it does not add sugar to the drinks, the flavor syrups are sugar-free, and the sugar comes from its protein-boosted milk. A company spokesperson said, “We believe these claims have no merit,” and said Starbucks intends to vigorously defend the case. The disagreement turns in part on the distinction between total sugar in a finished drink and whether sugar was added.
How do “sugar free” and “no added sugar” differ under federal rules?
Under the current text of 21 CFR § 101.60, the “sugar free” claim is generally permitted only when a food contains less than 0.5 gram of sugars per reference amount customarily consumed and per labeled serving. The regulation also addresses ingredients that are sugars or are generally understood to contain sugars, and calorie-related statements. When the relevant conditions are not met, it specifies statements such as “not a reduced calorie food,” “not a low calorie food,” or “not for weight control.” Read 21 CFR § 101.60 in the eCFR.

“No added sugar” is a separate claim with separate conditions. Among other requirements, sugars or ingredients that functionally substitute for added sugars must not be added during processing or packaging. The regulation also requires a calorie-status statement and a direction to the nutrition panel unless the product meets the relevant calorie criteria. Thus, a claim that no sugar was added does not by itself mean a product meets the separate “sugar free” standard. The same regulation sets out the conditions for “no added sugar.”
How those rules apply to Starbucks’ menu names and presentation is part of the unresolved dispute. The existence of nutrition information or a claim about added sugar does not, on its own, settle whether the product names comply with the rules.

What is the lawsuit’s status?
The proposed consumer class action was filed in Seattle on October 2, 2026. Coverage available as of October 7, 2026 does not establish a court ruling, class certification, or settlement. The case therefore remains an allegation rather than an adjudicated finding. The plaintiffs’ counsel describes the case and its allegations.
For consumers checking a particular drink, the menu’s current nutrition listing is more useful than applying a single sugar figure to every size or recipe. The AP’s October 5 menu snapshot illustrates why size matters, but it is only a dated example: Associated Press coverage of the menu figures and lawsuit.
