Choose an AI development agency by testing whether it can connect your business goal to a suitable technical approach, prove how it will evaluate results, explain risks and limits, identify the people doing the work, and put ownership and ongoing responsibilities in writing. Ask every bidder the same questions and compare evidence—not demos, broad promises, or a low headline price.
12 questions to ask an AI development agency
1. What problem are you solving, for whom, and why is AI appropriate?
Start with the user and the outcome, not a request for a particular model or feature. Ask the agency to define the problem, identify who benefits, and propose a measurable result—for example, reducing a specified task’s handling time or improving the quality of a defined decision.
Ask what a simpler rule-based system, existing product, or process change could accomplish. NIST’s AI procurement workbook recommends describing the problem and evaluating outcome-based criteria rather than prescribing an AI system prematurely. That is guidance, not a binding requirement for every private buyer.

Ask whether the proposal is custom software, an integration with existing products, or a hybrid. Have the agency identify major components and their providers, describe the techniques it expects to use, and explain what the system is not designed to do.

Request explanations for both technical reviewers and business users. Ask for foreseeable failure cases, how the system behaves when it lacks a reliable answer, and what work remains with a person. A proposal that names a fashionable technique but cannot explain its role in your use case is not a technical rationale.
3. What data will the project need, and are we allowed and ready to use it?
Ask the agency to inventory the data required, who controls it, where it is held, and whether you have the rights and permissions needed for the proposed use. Discuss quality, coverage, representativeness, known gaps, and potential sources of bias. Establish what information would be shared with the agency or its subprocessors, and under what arrangements.
UK government procurement guidance recommends assessing data and defining data-sharing arrangements before procurement; it notes that data underpins the majority of AI-powered solutions. That makes data readiness an early feasibility question, not a detail to defer until after a build is commissioned.

Ask for a test plan tied to the intended use, a relevant test set, measures that reflect the outcome you care about, and a baseline for comparison. Agree documented acceptance criteria before a proof of concept or delivery milestone, including how borderline or failed results will be handled.
Ask who will review the test data and results, and how the agency will check performance after launch. A single impressive demonstration does not establish how the system performs across the cases your users will encounter.

5. What risks could affect users, and how will you manage them?
Discuss risks relevant to the application: privacy, security, unfair or uneven outcomes, lack of transparency, and inappropriate reliance on automated output. Ask what human review, correction, escalation, or appeal paths users will have where those risks matter.
NIST’s AI Risk Management Framework can help structure a risk conversation, but it is voluntary guidance—not a certification, a guarantee of safety, or proof that an agency follows it. NIST has said version 1.0 is being revised, so check the framework’s current status when using it.

Meet the proposed delivery lead and key technical contributors before selection. Ask who owns domain analysis, data work, engineering, model decisions, security, delivery, and commercial coordination; one person may cover several areas, but responsibility should be clear.
Find out which work will be subcontracted, who will have access to your systems or data, and how much of the named team’s time is actually committed. Agency credentials are not a substitute for knowing who will deliver this project.
7. How do you develop and secure the software and its dependencies?
Ask for a concrete account of development practices, testing, dependency management, and how vulnerabilities are identified, reported, and addressed. Request evidence proportionate to the sensitivity and exposure of your project, such as relevant process documentation or security review material.

NIST software procurement guidance encourages buyers to request information from producers about secure development practices. Use that as a prompt to ask for project-relevant evidence rather than treating a framework name or unsupported assurance as proof.
8. Who owns the deliverables, data, and rights to use the components?
Have the contract distinguish custom code and documentation from the agency’s pre-existing tools, third-party software, models, and libraries. Clarify your rights to project data and outputs, the licenses governing each component, and whether you can modify, operate, or transfer the work if you change suppliers.
NIST’s procurement workbook raises ownership and licensing as procurement issues; the actual allocation must be set in the contract for your deal. Do not assume that paying for development automatically transfers every underlying component or grants unrestricted rights to model outputs.
9. Can we stage the work and decide whether to continue at each gate?
Where feasibility is uncertain, consider separating discovery, a bounded proof of concept, integration, and deployment. For each stage, define its deliverables, evidence required to proceed, decision-maker, and what happens if either side stops.
UK government guidance describes discovery and proof-of-concept work as ways to test whether a system is likely to meet wider requirements. A staged approach is useful only if each gate answers a real decision question; agree its scope and exit conditions rather than treating a small prototype as proof of production readiness.

10. What will happen after launch?
Assign responsibility for monitoring whether the system continues to perform as intended, responding to incidents, supporting integrations, maintaining dependencies, and communicating material changes. Agree how users or staff can report problems and how those reports will be reviewed.
UK guidance says ongoing testing is necessary to maintain model accuracy and recommends agreeing with the supplier how efficacy will be monitored. Put the monitoring approach and operational handoffs into the delivery plan instead of leaving them implicit.
11. How will pricing, uncertainty, and changes be handled?
Ask the bidder to state assumptions and exclusions, milestone payments, acceptance criteria, and the process for approving scope changes. Separate one-time build costs from recurring costs and support costs, and ask what circumstances could change the estimate.
There is no universal pricing model or standard contract clause set established by the reviewed procurement guidance. Tailor commercial terms to the project, jurisdiction, and risk, and seek legal or commercial advice when needed.
12. What evidence supports your experience on work like this?
Request references and case studies close to your use case. For each, ask what the proposed team actually delivered, what outcome was measured, how it was measured, and whether results were compared with a baseline. Where possible, speak to a reference who can discuss delivery and operation, not only the sales process.

Treat logos, polished demos, and claims of expertise as leads for verification, not proof on their own. Official procurement guidance supports evidence-based evaluation, but it does not certify particular agencies or prescribe one universal reference-check method.

Give every bidder the same short written questions, interview the people proposed for delivery, and assess claims against evidence. Use a shared scorecard so that a polished presentation or one attractive price does not obscure gaps elsewhere. Weight criteria according to your goals and the consequences of failure.

For each criterion, record what the bidder stated, what evidence supports it, and what remains unresolved. NIST recommends tailoring procurement criteria to the buyer’s needs and focusing on outcomes; UK guidance likewise emphasizes output-based requirements. These are useful principles for a private buyer, not a vendor ranking.

Warning signs that deserve follow-up
- The agency starts with a model or product pitch but cannot define the user problem or the outcome it will measure.
- It promises accuracy without explaining the test data, measure, baseline, or limits behind the claim.
- It treats data access, permissions, quality, or sharing as something to sort out after work begins.
- It cannot identify the people doing the work, their responsibilities, or the subcontractors who may access your data.
- It presents a framework name or demo as a substitute for project-specific evidence and safeguards.
- It leaves ownership, licenses, acceptance, change control, or post-launch support unclear.
These are reasons to ask for clarification and evidence, not automatic proof of misconduct. A strong answer should be specific enough to verify and relevant to your application.
What official guidance can—and cannot—tell you
NIST’s AI procurement workbook and AI Risk Management Framework, UK government AI procurement guidance, and NIST software procurement guidance offer questions and practices buyers can adapt. They do not rank private agencies or establish that a particular company meets a standard. Contract rights and legal obligations can also vary by jurisdiction, sector, and use case.
In 2026, the U.S. Government Accountability Office reviewed 13 AI acquisitions across four selected federal agencies—DOD, DHS, GSA, and VA—and recommended systematic collection of lessons learned, including practices involving data-rights contract terms and testing requirements. This is evidence about those selected federal acquisitions, not a representative statistic about private AI development agencies.
