The Central Administrative Tribunal (CAT), Chandigarh Bench, quashed the termination of Sunil Kumar, a Data Entry Operator in the Office of the Accountant General (A&E), Haryana. News reports say the tribunal found the action punitive because Kumar had not received notice of the allegations or a regular inquiry in which he could answer the evidence. It ordered reinstatement without back wages, while counting the period out of service for seniority, promotion and notional increment.
What led to Sunil Kumar’s termination?
Kumar was appointed as a Data Entry Operator in 2015 on the recommendation of the Staff Selection Commission (SSC). The Tribune reported that his appointment included a two-year probation period that ended on August 19, 2017, and that no extension order was issued.
The department later said it found discrepancies in the photograph and handwriting in the recruitment records. It referred the matter to the SSC and the Central Forensic Science Laboratory (CFSL), Chandigarh. According to the department’s account reported by The Tribune, CFSL findings indicated that photographs, signatures and handwriting did not match those of the person who appeared in the examination. These were the department’s allegations and its account of the evidence; they should not be treated as a finding that Kumar impersonated someone.

Kumar denied impersonation and said he had taken the examination himself. The Deputy Accountant General (Administration), Lekha Bhawan, Chandigarh, issued the termination order on September 28, 2018. The Tribune reported that Kumar challenged it because he had not been notified of the allegations or given an opportunity to answer them.
Why did the CAT quash the termination?
As reported by The Tribune, the CAT found that Kumar had not received notice setting out the allegations or a meaningful opportunity to explain. It also found that no regular inquiry had tested the material relied on by the department in Kumar’s presence. The tribunal treated the termination as punitive in nature and quashed it.
