Carmine and cochineal extract come from insects; Red 40 is a synthetic color additive. Under U.S. FDA rules, Red 40 requires batch certification, while carmine and cochineal extract are exempt from batch certification—but still require FDA approval for food use. All three must be identified on food labels by name under the applicable rules.

“Exempt” here refers only to batch certification. FDA says all color additives and new uses must be approved before they are used in food. Certification-exempt additives remain regulated; the term does not mean unapproved or unregulated. What the names mean on a U.S. ingredient label
Red 40 must be identified
Look for “Red 40” or “FD&C Red No. 40,” among other accepted listed-name forms. Many certification-exempt colors may be declared collectively with wording such as “artificial color,” “color added,” or an equally informative term, but that general wording does not replace Red 40’s named declaration. FDA labeling guidance.
Carmine and cochineal extract must also be identified
Although many exempt colors can use general color wording, carmine and cochineal extract are an explicit exception: the ingredient statement must name whichever is present. FDA’s compliance guide says this applies to human food, including butter, cheese, and ice cream. FDA’s consumer Q&A lists Red 40 in food categories including cereals, beverages, gelatins, puddings, dairy products, and confections. These examples are not a complete authorization list. Exact permitted foods, limits, and restrictions depend on the applicable color-additive regulation; FDA’s summary is informational and is not a substitute for those rules. The FDA summary lists cochineal extract as approved in 1967 and carmine in 2009. Those are regulatory timeline entries, not measures of safety or how commonly the ingredients are used. FDA summary table.

Does one have a safety advantage?
The FDA information cited here does not establish that carmine is safer or less safe than Red 40, or that “insect-derived” or “synthetic” predicts an individual’s response. The labeling rule for carmine and cochineal extract reflects the potential for allergic reactions in some people; it is not evidence that all consumers will react. No prevalence, consumption, allergy-rate, or comparative-safety statistic is established by these FDA sources. For a specific food-use or compliance question, check the governing regulation rather than inferring a safety ranking from the additive’s source or certification category.
