Usually, no—not in a vehicle driven on public roads. The answer depends on local law, but off-road diesel is typically dyed or marked because it is sold for uses that do not qualify for road-fuel tax. In the United States, IRS guidance says not to use dyed diesel in a truck that travels both on a farm and on the highway. In the United Kingdom, red diesel is permitted only for specified vehicle categories and qualifying purposes. Check the rules where the vehicle is used before filling up.

What “off-road diesel” means

“Off-road diesel” commonly means diesel marked or dyed for a limited use that is not subject to the same fuel tax as ordinary road use. The dye is an identifier; it does not itself create permission to use the fuel. Whether a truck or car may use it depends on the jurisdiction’s tax rules, the vehicle’s category and registration or licensing status, and the activity being performed.

That distinction matters for farm and work vehicles: driving a vehicle off a public road does not automatically make its fuel use eligible, and doing farm-related work does not necessarily exempt a road vehicle.

United States: dyed diesel in a truck or car

Farm trucks that also use highways

The IRS’s 2025 Farmer’s Tax Guide says a buyer who purchases dyed diesel for a nontaxable use must use it only for that or another nontaxable use. It specifically says not to use dyed diesel in a truck used both on a farm and on the highway, even when the highway travel is connected to the farm business. The highway use is taxable, so the guide says to buy undyed, taxed fuel for that truck.

This means a trip to move farm supplies or equipment does not, by itself, make dyed fuel lawful in a truck that is also a highway vehicle. The IRS also notes that passenger automobiles and highway-type trucks are examples of highway vehicles; using a truck for a special cargo or off-highway task does not alone remove it from highway-fuel rules. See IRS Publication 510 (12/2025).

Tax credits and refunds are a separate question

The Farmer’s Tax Guide says taxpayers may be eligible for a credit or refund of excise tax on fuel used for farming on a farm in the United States. That potential tax benefit is separate from permission to put dyed fuel in a vehicle used on the highway. Keep fuel records and check the IRS rules for the specific credit or refund rather than treating it as an exception to the dyed-fuel restriction.

United Kingdom: when red diesel may be used

Eligibility depends on both vehicle and purpose

HMRC’s Excise Notice 75 allows rebated fuel only for specified vehicle or machine categories and qualifying purposes. Its categories include agricultural vehicles, railway vehicles, special vehicles, mowing machines and unlicensed vehicles, including vehicles with a Statutory Off Road Notification (SORN). The permitted purposes differ by category, so a use that qualifies for one type of vehicle may not qualify for another.

For agricultural vehicles, the listed qualifying purposes include agriculture, horticulture, aquatic farming or forestry, certain work maintaining public-road verges, hedges or trees, and specified snow, ice, frost or flood work. These examples do not establish a blanket farm-work exception for every truck or car.

General-haulage-licensed tractors and SORN vehicles

HMRC says a tractor with a vehicle excise licence for general haulage cannot use red diesel, on or off public roads, even while doing agricultural, horticultural or forestry work. The licence permits other work, so the tractor is not treated as being used solely for those qualifying purposes. HMRC’s agricultural vehicle guidance also explains that an unlicensed vehicle not used on public roads may qualify under the unlicensed category, subject to the rules. A SORN vehicle must not be used on a public road.

U.S. federal penalty for taxable use of dyed fuel

Under IRS Publication 510 (12/2025), knowingly holding or using dyed fuel for a taxable use can incur a penalty of the greater of $1,000 or $10 per gallon involved, in addition to any tax imposed. The $1,000 component increases after the first violation according to the number of violations. The publication also addresses limited exceptions to the penalty for altering dye; those are not general permission to use dyed fuel on the road.

How to check before fueling

  1. Identify the jurisdiction. Check the tax and vehicle rules for the country and, where relevant, state or region where the vehicle will be used. The U.S. and UK rules above are not universal.
  2. Confirm what the fuel is. Determine whether it is dyed or rebated fuel and what use its tax treatment permits.
  3. Check the vehicle’s class and status. Establish whether it is a passenger car, highway truck, agricultural vehicle, special vehicle or another defined category, and whether it is registered, licensed for general haulage, unlicensed or SORN.
  4. Match the activity and route to the rule. Consider whether the vehicle will travel on a public road and whether the specific purpose qualifies for that vehicle category. Do not assume that a farm connection or an off-road segment is sufficient.
  5. Keep records and use the right tax process. In the United States, the IRS advises keeping fuel records; investigate any eligible farm-fuel credit or refund separately from the question of which fuel may be used in the vehicle.
