Generally, OpenAI’s terms say you own the output you create with GPT Image, as between you and OpenAI and to the extent permitted by applicable law. That does not guarantee copyright protection, exclusivity, permission to use the source image or a person’s likeness, or compliance with disclosure rules. Before using an edit in an ad or other commercial work, check those separate issues as well as the terms governing your account.
What OpenAI’s terms say about commercial use
OpenAI’s consumer Terms of Use state: “As between you and OpenAI, and to the extent permitted by applicable law,” you retain ownership rights in your input and own the output. The terms also assign OpenAI’s right, title, and interest, if any, in output to you. This is the direct contractual answer to who owns GPT Image output in the relationship between you and OpenAI; it is not a blanket clearance for every commercial use.
The same terms make you responsible for the content you submit and generate, and require you to have the rights, licenses, and permissions needed to provide your input. They also warn that output may not be unique: other users may receive similar results. So, even where the terms assign output to you, they do not promise that your result is exclusive or free of third-party rights.
If you use a business account
OpenAI’s Business Terms, dated May 2025, similarly say the customer retains ownership rights in input and owns output, subject to applicable law. They also say OpenAI will not use customer content to develop or improve its services unless the customer explicitly agrees, and place responsibility for use and evaluation of output on the customer. Check the agreement that actually governs your account: business and consumer terms can differ by product and may change.

Ownership is not the same as copyright protection
A contract can allocate rights between you and OpenAI, but copyright law separately determines whether an image has protectable authorship and what that protection covers. In its January 29, 2025 summary of its Part 2 report, the U.S. Copyright Office said AI-assisted work is not automatically barred from copyrightability. Protection can apply where a human author determined sufficient expressive elements, such as human-authored expression perceptible in the result or creative human arrangements and modifications. The Office’s analysis says prompting alone does not suffice.
That is a U.S. copyrightability point, not a universal rule for every country. It also does not mean that every machine-generated element in an edited image is protected. If exclusivity or enforceable copyright matters to your business, do not assume that OpenAI’s contractual ownership language establishes either one.

Check the source image and any person’s likeness
Before editing, confirm that you are allowed to submit the source image and use the resulting image for the purpose you have in mind. This matters for client photographs, licensed stock, branded assets, and images that include other people. Possessing a copy of a file—or being able to edit it—does not itself clear the rights needed for a commercial publication.
OpenAI’s Service Terms prohibit using visual capabilities to reproduce a person’s likeness without express consent and all necessary rights. The permissions required for a particular image depend on the applicable law and context, such as how and where it will be used. For consequential campaigns, verify permissions with the rights holder and obtain appropriate consent rather than treating the output as a substitute for clearance.

When do you have to disclose an AI edit?
There is no single disclosure answer for every AI-edited image. Requirements depend on jurisdiction, what the image depicts, how it is used, and any applicable platform or publication rules. Do not infer that every edit must be labeled—or that none does—from OpenAI’s ownership terms.
EU rule for deepfakes
Article 50 of the EU AI Act requires deployers of an AI system that generates or manipulates image, audio, or video content constituting a deepfake to disclose that it was artificially generated or manipulated. For evidently artistic, creative, satirical, fictional, or analogous works, the disclosure should be appropriate and should not hamper display or enjoyment. The provision also states an exception for content that has undergone human review or editorial control where a natural or legal person holds editorial responsibility for publication. This is a specific EU rule; it should not be generalized to all AI edits or other jurisdictions. Check current implementation guidance for the use in question.

Provenance signals are not a legal clearance
OpenAI says images generated with ChatGPT, Codex, or the OpenAI API include Content Credentials and SynthID watermarks. According to its provenance guidance, such signals can help indicate origin, but do not guarantee that content is accurate, legally owned, unedited, or presented in the correct context. Their presence does not by itself establish that you have met a legal, platform, or publisher disclosure requirement.

- Identify the governing terms. Check the current OpenAI terms for the product and account you used, including any business agreement.
- Clear the input. Confirm you have the rights and permissions to submit the source image and use it in the intended commercial context.
- Review people and protected material. Get the required consent for recognizable likenesses and check any stock, client, brand, or other third-party rights.
- Assess copyright expectations. Separate your contractual rights to output from whether the result—or human-authored parts of it—qualifies for copyright protection in the relevant jurisdiction.
- Check disclosure rules. Consider the image’s content, audience, jurisdiction, and publication channel. If the EU deepfake rule may apply, assess its scope and any relevant exception rather than relying on metadata alone.
For a high-stakes advertisement or publication, verify the current terms and applicable local requirements before release; the contractual allocation and disclosure rules can change, and the legal result depends on the facts.
