Yes, potentially—but an AI tool’s ability to generate or license footage does not clear every right involved. For a commercial film, consider separately whether you have permission to use the footage, whether a human contribution supports copyright protection, whether a recognizable person or performance has been cleared, and whether disclosure rules apply where the film will be released. The guidance below focuses on U.S. copyright and performer-contract issues and the EU AI Act’s deepfake disclosure rule; it is not a worldwide legal survey or advice for a particular production.
What does “cleared” AI footage mean?
There is no single clearance test. Copyright in the film, permission to depict or replicate a person, contractual consent from a performer, and disclosure to viewers answer different questions. Satisfying one does not settle the others: for example, owning copyright in a scene does not automatically give you permission to use a person’s face or voice.
- Copyright: What expressive material in the footage or finished film was authored by a human, and what can be claimed in a U.S. registration?
- Identity and performance: Does the image, voice, or performance identify or replicate a real person, and do releases, applicable laws, or agreements permit the intended use?
- Contract: Is a performer covered by a collective agreement or another contract that sets consent, compensation, or reuse terms?
- Disclosure: Do the laws in the film’s release territories require viewers to be told that particular content was generated or manipulated?
Also review the AI service’s terms and the rights to any source material you provide. The official sources discussed here do not establish that a platform license resolves every copyright, identity, contract, or territory-specific issue.
Does prompting make you the copyright owner?
Not by itself under the U.S. Copyright Office’s stated approach. Its January 2025 report says AI output may qualify for copyright protection when a human determines sufficient expressive elements—for example, when human-authored material is perceptible in the output or a person makes creative arrangements or modifications. Merely providing prompts does not establish authorship. The Office also says using AI as an aid, or including AI-generated material in a larger human-created work, does not automatically prevent protection for the human-authored parts. For a film, keep track of the human creative work that shaped the result: source footage or artwork, selection among generated material, edits and alterations, and the arrangement of shots in the finished work. These facts may help identify what expression was human-authored, but the cited guidance does not make every selection or edit sufficient in every case. Do not assume that a prompt, a paid subscription, or possession of an output establishes copyright ownership over machine-determined expression.
What must you disclose when registering a film in the United States?
Registration disclosure is separate from telling an audience about AI use. The Copyright Office’s March 2023 guidance says applicants must disclose AI-generated content in works submitted for registration, identify the human-authored material claimed, and exclude material that is not human-authored when the application process requires it. This is a filing obligation; it is not, by itself, a general requirement to label every AI-assisted film for viewers. Review the Office’s announcement on its registration guidance and current filing instructions when preparing an application.
Do you need permission to use someone’s AI-generated face or voice?
Treat a recognizable or replicated real person as a separate clearance issue, even if the footage is fictional or the film’s copyright claim is otherwise supportable. Review releases, applicable privacy and publicity rights, contracts, and the scope of any consent for the planned depiction, distribution, promotion, and reuse. The relevant answer can depend on the production and release locations as well as the person and material involved.

In its 2024 report, the Copyright Office described gaps in protections against unauthorized digital replicas and recommended that Congress enact a federal law addressing knowing distribution. That recommendation is not an enacted, general federal consent statute. It does not eliminate other potentially relevant state-law or contractual protections. When a real person’s identity or performance is involved, obtain appropriate permission and legal review rather than treating the tool’s output terms as a substitute.
What if a performer is covered by a SAG-AFTRA agreement?
SAG-AFTRA says its 2023 TV/Theatrical agreement secured informed-consent and compensation provisions for creation and use of covered members’ digital replicas. Those are contractual protections, not universal rules for every film or performer. Check the agreement that applies to the production, the performer’s status, any consent form or rider, the intended uses described to the performer, compensation terms, and provisions for future reuse. SAG-AFTRA’s 2023 TV/Theatrical Contracts page and AI resources describe the contract materials; verify current successor terms for a present-day production.
Do viewers have to be told that a scene is AI-generated?
There is no single audience-label rule established here for every country or every AI-generated image. In the EU, Article 50(4) of the AI Act requires deployers of an AI system that generates or manipulates image, audio, or video content constituting a deepfake to disclose that it has been artificially generated or manipulated. The rule is tied to its defined deepfake scope, not to every use of AI in filmmaking. Read the consolidated AI Act, Article 50 for the statutory text and check the provisions and dates applicable to a planned release.

For content forming part of an evidently artistic, creative, satirical, fictional, or analogous work or programme, Article 50(4) accommodates the work’s context: the disclosure obligation is limited to disclosing the existence of generated or manipulated content in an appropriate manner that does not hamper its display or enjoyment. The cited text does not mean every artistic film must carry a visible on-screen label in every scene. Decide how to make any required disclosure in light of the film’s form and the applicable rule; do not confuse that audience-facing decision with U.S. registration disclosure.

- Map the footage and its inputs. Identify generated shots, any source footage, images, voices, or performances used to make them, and whether a real person is recognizable or replicated.
- Record the human contribution. Preserve relevant source files, prompts, generated alternatives, selection decisions, edit history, and the human-authored changes and arrangement that shape the final film.
- Clear identity and performance rights. Locate releases and written permissions, and confirm that their scope covers the particular AI use, intended distribution, promotion, and future reuse. Check applicable performer agreements and compensation terms.
- Check the tool’s terms and source rights. Confirm that the service terms in effect when the footage was generated permit the intended commercial use, and separately consider rights in material supplied to the service.
- Plan for each release territory. Identify the laws and contracts relevant to production and distribution. For an EU release, assess whether the content meets the AI Act’s deepfake definition and whether the artistic or fictional-work accommodation applies.
- Handle registrations and audience notices separately. For a U.S. copyright application, identify human-authored material and disclose AI-generated content as the Office’s process requires. Determine any viewer disclosure under the rules for each territory.
- Keep the supporting record. Retain tool terms at generation time, source and edit records, releases, contract documents, and the decisions made about registration and disclosure.
