Yes. Nearby construction or noise does not automatically prevent a home sale, but it can raise disclosure, pricing, and complaint questions. What you must disclose—and whether you have any remedy—depends on your location, the type of work, and what you know. Check local rules before completing seller disclosures or making claims about the property’s value.

What to establish before you list

First pin down what is happening. Active construction noise, noise from a completed development, a known future project, a formal dispute, and physical damage to your home are different issues. The rules and possible next steps depend on the location and type of work.

  • Identify the project, its current or expected schedule, and whether it is private development or public infrastructure.
  • Separate intermittent construction activity from noise that is likely to continue after the work ends.
  • Keep relevant notices, correspondence, complaint records, and dated observations. This is practical recordkeeping, not a universal legal requirement. For a significant dispute, ask a local attorney or qualified acoustics professional what documentation is useful.

Check disclosure requirements where the home is located

There is no single disclosure rule established across all locations. In the United States, the National Association of REALTORS says seller-disclosure requirements vary by state and recommends consulting a local real-estate professional or attorney. Nearby construction may be relevant even if it is not part of the home itself. For example, North Carolina REALTORS says brokers in North Carolina must disclose material facts they know or reasonably should know, and identifies known commercial construction next to a listed property as material. That is a state-specific example, not a rule for every U.S. seller. See North Carolina REALTORS’ guidance on conditions around a home.

Describe known conditions accurately to your listing agent and ask what the local forms and laws require. Do not assume that nearby work must always be disclosed—or that it never needs to be disclosed. If you are uncertain about a legal duty, ask a local attorney or qualified conveyancing professional before signing disclosure documents.

Check whether local noise rules or notice procedures apply

Construction noise complaints in New York City

New York City’s Department of Environmental Protection says construction is generally allowed from 7 a.m. to 6 p.m. on weekdays. Affected residents can call 311 or report a problem online; check the NYC DEP construction-noise rules for current requirements and exceptions. The page also identifies a noise-monitoring rule effective April 21, 2026, for specified projects using alternative mitigation plans. These procedures apply to New York City, not other locations.

Specified party-wall work in England and Wales

In England and Wales, notice is required for certain work on or near a party wall or boundary. Party-wall procedures are separate from planning permission and building regulations, and Scotland has different rules. Check GOV.UK’s party-wall guidance to understand whether the work next door falls within those procedures. This notice process does not by itself resolve every noise or sale-disclosure question.

Seller disclosure in Queensland

Queensland’s mandatory seller-disclosure scheme began on 1 August 2025, according to the state government. The scheme’s start date does not establish what a particular seller must disclose about nearby construction; review the Queensland Government seller-disclosure guidance and get advice about how it applies to the property.

Consider compensation only if the specific framework fits

UK Government guidance describes compensation for depreciation caused by specified public works, listing noise as one of seven physical factors that may be relevant. It is not a general right to compensation for noise from any nearby construction project. The guide also explains that selling within a specified 12-month period can affect when a claim must be made. Check the eligibility conditions and timing in GOV.UK’s public-works compensation guidance and seek professional advice before relying on a claim. This framework should not be assumed to apply outside the circumstances it covers.

Set price and marketing expectations with local evidence

The sources do not establish a standard percentage discount for homes affected by construction or noise. Any effect on value depends on the property, the nature and duration of the noise, buyer demand, and comparable local sales. Ask a local agent to explain the relevant comparable sales and how the condition may affect marketing. Avoid presenting an unsupported estimate as a guaranteed loss or compensation amount.

  6. Discuss pricing using local comparables. Do not rely on a generic noise-related discount figure.
