Stake.us’s terms do not list Texas among the states where it expressly excludes access, but that does not establish that every form of play is legal under Texas law. The terms also bar play where applicable law prohibits it. Texas statutes make chance, consideration and something of value relevant to gambling definitions; the sources reviewed do not establish a Texas court or regulator ruling specifically on Stake.us.

Can you play Stake.us in Texas?

Stake.us’s published Terms & Conditions name several excluded U.S. states, but Texas is not on that list. The terms also exclude jurisdictions where applicable law legally precludes play and reserve the operator’s discretion to exclude other locations. So the terms suggest Texas is not specifically blocked by the named-state list, subject to those broader restrictions.

This describes Stake.us’s access policy, not a legal determination. A state’s omission from the list does not prove that the platform or every way of using it complies with Texas law.

What Stake.us says about its games

Stake.us describes itself as a social casino on its homepage, which also says sweepstakes are void where prohibited by law. Its terms say no purchase or payment is necessary to participate or play, and state: “THE PLATFORM AND GAMES DO NOT OFFER REAL MONEY GAMBLING, AND NO ACTUAL MONEY IS REQUIRED TO PLAY.”

Those are the operator’s descriptions of its service and rules. They do not bind Texas authorities or determine how state law applies to the games’ actual mechanics, prizes or redemption arrangements.

How Texas law frames gambling

Texas Penal Code Chapter 47 uses concepts including chance, consideration and something of value in its gambling-related definitions. For example, Texas Penal Code §47.01(1) defines a bet as “an agreement to win or lose something of value solely or partially by chance.” The chapter also defines a gambling device in terms of consideration, an opportunity to obtain something of value and an award determined wholly or partly by chance. Its lottery definition concerns chance-based prize distribution among people who paid or promised consideration.

These definitions make the details of a particular product relevant. The operator’s label for a game does not, by itself, answer whether its mechanics fit a statutory definition. Read the current Texas Penal Code Chapter 47 text for the statutory language.

What Texas’s sweepstakes statute does—and does not—establish

Texas Business and Commerce Code Chapter 622 addresses specified links between sweepstakes entries and purchases of goods or services, including requiring a purchase to enter or automatically entering someone because of a purchase. That provides context for no-purchase-entry mechanics, but it is not a blanket approval of every sweepstakes casino and does not resolve every issue under Texas gambling law. The chapter is available in the Texas Legislature’s text of Business and Commerce Code Chapter 622.

What remains unresolved for Stake.us in Texas

The statutes set out legal tests, while Stake.us’s terms and homepage describe the operator’s policy and product. The sources reviewed do not establish an official Texas ruling specifically deciding whether Stake.us’s current games or its sweepstakes and redemption arrangements are lawful. They therefore do not support a definitive claim that all Stake.us play in Texas is either legal or illegal.
