Yes. If Delta asks for volunteers to give up seats on an oversold flight, you can counter its offer—but Delta decides whether to accept. A report published October 1, 2026, says passenger Maxwell Cohen negotiated after Delta raised its offer from $300 to $500, ultimately receiving acceptance of a $1,300 counteroffer. That is one reported outcome, not a standard payout or a guarantee that negotiating will work.
What happened in the reported Delta incident?
According to an October 1, 2026 report by Attack of the Fanboy, Delta first offered volunteers $300 and later increased the offer to $500. The report says Cohen asked whether there was room to negotiate, countered at $1,300, and Delta accepted after roughly 20 minutes without another volunteer.
The report’s headline refers to Delta accepting Cohen’s counteroffer, not just allowing him to make one. The account does not show that $1,300 is typical, that a counteroffer will usually succeed, or that waiting a particular amount of time will prompt an airline to raise its offer. The reported exchange has not been independently verified here against the primary video.

Yes. The U.S. Department of Transportation (DOT) says an airline may offer any amount in money or vouchers and passengers are free to negotiate. That means you can propose different compensation or conditions; it does not require Delta to agree. Delta’s U.S. Contract of Carriage says it determines the amount and form of volunteer compensation in its sole discretion.

Negotiation applies to volunteering to give up a seat. It is separate from involuntary denied-boarding compensation, which may apply if you are bumped against your will from a qualifying oversold flight departing a U.S. airport. DOT’s published compensation tiers include 200% of the one-way fare, capped at $1,075, for an applicable shorter-delay tier, and 400%, capped at $2,150, for an applicable longer-delay tier. Eligibility requirements and exceptions apply. These caps are not limits on what you may negotiate as a volunteer. See the DOT’s Bumping & Oversales guidance and its Fly Rights information.
What to check before giving up your seat
Do not compare an offer with your original ticket on cash amount alone. A later arrival, uncertain rebooking, or overnight expenses can outweigh a seemingly attractive voucher or payment. Before agreeing, get the terms for your specific flight in clear, preferably written form.

- Alternate flight: Ask which flight you will take, when it departs and arrives, and whether your seat is confirmed or you will be flying standby.
- Compensation: Confirm the exact amount and whether it will be cash, a travel voucher, or another form of credit.
- Voucher terms: If the offer is a voucher or ticket, ask about its expiration date, blackout dates, eligible routes, and any limits on international travel.
- Delay costs: If the new itinerary could require a long wait or overnight stay, ask whether meals, hotel accommodation, and ground transfers are included and who arranges them.
- Conditions for acceptance: State any terms that matter to you, such as a confirmed seat on a named later flight, before you relinquish your place.
DOT advises passengers to ask about alternate-flight timing, amenities, voucher validity, blackout periods, and international use. Delta’s U.S. Contract of Carriage says volunteers will receive transportation on Delta’s next available flight to the next stopover or destination at no additional cost. For an arrangement requiring an overnight stay, the contract describes hotel accommodation or a capped credit voucher when accommodation is unavailable. Confirm how those provisions apply to your particular offer, especially if another carrier operates the flight. The contract is the Delta U.S. Contract of Carriage, last modified August 18, 2026.
How to make a counteroffer
Keep it calm and specific. You might say: “I’m willing to volunteer for [amount] if you can confirm a seat on [flight] and tell me what happens with meals or a hotel if I have to stay overnight.” This is a way to make your priorities clear, not a formula for getting the airline to agree. The available guidance establishes that passengers may negotiate, but does not establish a standard counteroffer amount or guarantee that a gate agent can approve a particular deal.
