Usually not if you are subject to U.S. sanctions jurisdiction and the recipient is blocked—but cryptocurrency is not automatically prohibited in every case. OFAC says the same sanctions obligations apply to digital currency as to traditional fiat. Whether a transfer is lawful depends on the sender’s jurisdiction, the recipient and its ownership, the applicable sanctions program, the transaction and any license or exemption that covers it.
Does OFAC sanctions law apply to cryptocurrency?
Yes. OFAC’s FAQ 560 says, “Yes, the obligations are the same,” whether a transaction uses digital currency or fiat. OFAC’s digital-currency guidance covers virtual currency, sovereign cryptocurrency and digital representations of fiat currency. A blockchain transfer is not a way around a prohibition that would apply to the same transaction using dollars.
For U.S. persons and others subject to OFAC jurisdiction, dealing in the property or interests in property of a blocked person is generally prohibited unless an authorization or exemption applies. Prohibitions can also cover attempts, evasion, causing another person to violate sanctions, or certain support for a designated person. The precise restrictions depend on the sanctions program and its regulations.
Who has to comply, and what counts as a blocked recipient?
U.S. jurisdiction
OFAC generally covers U.S. citizens and permanent residents wherever they are, people and entities in the United States, and U.S.-organized entities and their foreign branches. Some programs also reach certain foreign subsidiaries of U.S. persons. Non-U.S. persons may face restrictions for conduct such as causing or conspiring to cause a U.S. person’s violation, evading sanctions, or conduct covered by a particular program. OFAC FAQ 11, updated August 21, 2024, explains that the specific program determines reach; OFAC FAQ 1021 addresses virtual currency under Russia-related sanctions.

Listed people and entities owned by blocked persons
Do not limit screening to whether a recipient’s name appears on a list. Under OFAC’s 50 Percent Rule, an entity is also blocked when one or more blocked persons own, directly or indirectly and in aggregate, at least 50 percent of it. An unlisted company can therefore be blocked because of its ownership. Check relevant ownership facts, not just the company name or wallet address.
Does the answer differ in the European Union?
The EU has its own sanctions framework, so U.S. rules should not be treated as a universal answer. European Commission guidance on Russia-related measures treats crypto-assets as potentially covered funds or economic resources. Where a measure prohibits making funds or economic resources available to a listed person, crypto-assets can fall within that prohibition too.

EU restrictions are measure-specific. Commission and Council materials published in July 2026 describe additional restrictions concerning certain crypto-assets, providers and platforms in the Russia context; those examples do not establish a blanket rule for every crypto transfer or every EU sanctions program. The applicable EU measure, the parties and the transaction’s connection to the relevant jurisdiction all matter.

| How crypto is treated | OFAC applies the same sanctions obligations to digital currency and fiat; see FAQ 560. | Crypto-assets can qualify as funds or economic resources under relevant measures; see European Commission guidance on Russia-related measures. |
| What determines the restriction | The applicable OFAC program, the person’s status and property interest, and any authorization or exemption. | The specific EU measure and its restrictions; Russia-related examples are not a substitute for checking other programs. |
| Ownership question | OFAC’s 50 Percent Rule treats entities owned in aggregate at least 50% by blocked persons as blocked, even if not separately listed. | The relevant EU measure governs; the materials cited here do not establish one universal ownership test for all EU sanctions programs. |

What should you check before sending crypto?
- Identify the relevant jurisdiction. Consider the sender’s citizenship, residence, location and organizational status, along with any U.S. or EU connection and the rules that may apply to intermediaries.
- Check the recipient and ownership. Screen the recipient against the current official sanctions list and assess direct and indirect ownership by blocked persons. A name search alone may not reveal an ownership-based block.
- Determine what the measure actually prohibits. It may block a person’s property, prohibit a particular transaction or service, or restrict a sector, location, asset, provider or platform. Do not assume every sanctions measure works the same way.
- Review the whole transaction. Consider exchanges, custodians and other intermediaries, and whether the transfer could cause or facilitate a covered person’s violation or evade a prohibition.
- Confirm permission before proceeding. Check whether a specific license, general authorization, statutory exemption or other permission covers this transaction, these parties and this purpose. The technical ability to send the asset is not legal authorization.
Use current official lists, regulations and jurisdiction-specific guidance on the date you plan to transact. OFAC’s Sanctions List Search can return exact address matches when an address hash is entered, but no exact match is not legal clearance: it does not resolve identity, ownership or other applicable prohibitions. A wallet provider’s willingness to process a transfer, or an explorer’s failure to flag an address, likewise does not establish that the transfer is lawful.

What if you already hold cryptocurrency that must be blocked?
If a U.S. person determines that virtual currency in their possession or control is required to be blocked, OFAC FAQ 646 says to deny all parties access, maintain appropriate controls and meet the reporting requirements. OFAC says to report blocked virtual currency within 10 business days and annually for as long as it remains blocked. It need not be converted to fiat or placed in an interest-bearing account. These are handling rules for property already held; they do not authorize sending it to a blocked person or returning it without permission or the end of the prohibition.

OFAC can impose civil penalties under a strict-liability standard in many cases, so civil liability may apply even when a person did not know or have reason to know of the violation. OFAC considers the totality of circumstances, including compliance controls and remedial measures. Penalty amounts vary by program and are adjusted; consult current OFAC Civil Penalties and Enforcement Information rather than relying on an old figure.
