Yes, the U.S. government has historically sold Bitcoin after it was forfeited, but the rules changed in 2025. Executive Order 14233 directs that qualifying Bitcoin held by the Treasury and deposited in the Strategic Bitcoin Reserve not be sold, subject to specified exceptions. A seizure alone does not make Bitcoin government property: the asset may still be subject to legal proceedings before forfeiture is final.
Seized Bitcoin is not automatically forfeited
Seizure secures Bitcoin while the government pursues legal proceedings; it does not, by itself, transfer final ownership to the government. The distinction matters because the Strategic Bitcoin Reserve order applies to qualifying Bitcoin that has been finally forfeited and deposited in the Reserve, not simply every wallet or token in government custody. The Department of Justice’s Asset Forfeiture Program covers seizure, management, forfeiture, and disposition under federal law.
Forfeiture may follow criminal or civil proceedings. The legal status of a particular asset—and any court order or statutory requirement affecting it—helps determine what may happen next. DOJ policy treats seizure authority and later disposition as separate issues.
What happens to Bitcoin after the government seizes it?
Secure custody comes first
Handling cryptocurrency presents custody and security issues that do not arise in the same way with ordinary physical property. The 2025 DOJ Asset Forfeiture Policy Manual instructs prosecutors and agents to consult the U.S. Marshals Service (USMS) about whether it or a contractor can store and liquidate the specific cryptocurrency. Before custody is transferred, the seizing agency must use a government-controlled self-custodial or cold-storage wallet.

- BITCOIN EXCLUSIVE, PHONE VERIFICATION: Bitkey is designed from the ground up exclusively for bitcoin — a dedicated hardware wallet for secure bitcoin storage. Approve transactions with a tap using your phone and NFC. No device screen is required.
- SELF-CUSTODY, NO EXCHANGE OR CUSTODIAN REQUIRED: You hold two of the three keys in the Bitkey system – one on your phone and one on your Bitkey device. The third is stored on Bitkey’s server and cannot move your bitcoin on its own.
- NO SEED PHRASE: Set up and use Bitkey without creating or storing a seed phrase.
- 2-of-3 MULTISIG: Three keys are stored separately across your phone, Bitkey device, and Bitkey’s server. Any two keys are required to move your bitcoin.
- BUILT-IN RECOVERY: Encrypted backup and recovery tools can help you regain access if you lose your phone or Bitkey device. You can also designate a Recovery Contact.
Pre-forfeiture sale requires consultation
If prosecutors seek an interlocutory sale or pretrial conversion—selling or converting an asset before final forfeiture—the manual says they must consult the Money Laundering and Asset Recovery Section (MLARS). That is distinct from disposing of property after forfeiture. Whether a particular cryptocurrency can be securely stored or liquidated is an operational question, not a blanket authorization to sell it.
Why the government used to auction forfeited Bitcoin
Before the 2025 Reserve order, federal practice included selling forfeited Bitcoin. DOJ disposition guidelines generally call for prompt sale of forfeited property when it is not put to official use or transferred. A 2022 DOJ Office of Inspector General audit describes USMS auctions of Bitcoin as historical practice.

The audit says that approvals, advertising to reach suitable buyers, and accumulating enough cryptocurrency to justify an auction could affect how long assets remained in USMS custody. It also reported a planned contractor process intended to liquidate cryptocurrency within five business days after forfeiture. That was a plan described in the 2022 audit, not confirmation of a current service standard.

Executive Order 14233, signed March 6, 2025, directs the Treasury Department to establish custodial accounts collectively called the Strategic Bitcoin Reserve. It provides for the Reserve to be capitalized with qualifying Bitcoin held by Treasury that was finally forfeited through criminal or civil asset forfeiture, or received in satisfaction of a civil money penalty, subject to the order’s conditions and statutory needs.

The order’s operative direction is: “Government BTC deposited into the Strategic Bitcoin Reserve shall not be sold and shall be maintained as reserve assets of the United States utilized to meet governmental objectives in accordance with applicable law.” The direction is about Bitcoin deposited in the Reserve; it is not a declaration that every seized Bitcoin has been transferred there.
The order also establishes a separate U.S. Digital Asset Stockpile for qualifying non-Bitcoin digital assets held by Treasury. It distinguishes Reserve Bitcoin from other Government Digital Assets, allowing Treasury to exercise lawful stewardship over the non-Bitcoin Stockpile subject to applicable law and the order’s exceptions. The order therefore should not be read as a blanket no-sale rule for every cryptocurrency.

When can the government still sell or dispose of digital assets?
The order says agency heads shall not sell or otherwise dispose of Government Digital Assets except under its specified authorities and exceptions. It does not give agencies unrestricted discretion to sell assets. The stated exceptions include:
- Court orders or legal requirements: disposition may occur pursuant to a court order or as required by law.
- Return to victims: the Attorney General or other relevant agency head may determine that assets or proceeds can and should be returned to identifiable and verifiable crime victims.
- Law-enforcement operations: assets or proceeds may be used for law-enforcement operations where the relevant official makes the required determination.
- Equitable sharing: disposition may support sharing with state and local law-enforcement partners.
- Specified statutory obligations: the order names requirements under 31 U.S.C. 9705, 28 U.S.C. 524(c), 18 U.S.C. 981, and 21 U.S.C. 881.
These are exceptions to the order’s direction, not a claim that every seized asset can be sold whenever the government chooses. The asset’s status, the order’s scope, and applicable statutes or court orders all matter.

How far has implementation progressed?
The White House’s July 2025 report, Strengthening American Leadership in Digital Financial Technology, said Treasury had delivered legal and investment considerations for establishing and managing the Reserve and Stockpile, and would continue coordinating on next steps. That dated update does not establish that every agency transfer or custody step was complete. It is the latest implementation status established by the available official information cited here.
