Not automatically. India’s available official rules restrict doctors’ patient solicitation and self-promotional publicity, while consumer guidance sets credential-disclosure, disclaimer and substantiation expectations for health-related influencer endorsements. The sources reviewed do not create an AI exemption or a specific AI rule. The NMC also listed new advertising and public-communication guidelines dated 6 October 2026; their contents and legal effect need to be checked before treating this as a definitive statement of the current position.

What rules apply to doctors’ promotion?

The NMC’s 2023 amendment put the Registered Medical Practitioner (Professional Conduct) Regulations, 2023, in abeyance and adopted the Medical Council of India’s 2002 Code of Medical Ethics Regulations until further Gazette notification. Check for a later notification before relying on that framework as current. The 2002 Code, hosted by the NMC and marked amended up to 8 October 2016, says: “Soliciting of patients directly or indirectly, by a physician, by a group of physicians or by institutions or organisations is unethical.” Read the 2002 Code and the 23 August 2023 amendment.

The Code also bars publicity likely to draw attention to a doctor’s professional position, skills, qualifications, achievements, specialties, affiliations or honours in a way that amounts to self-aggrandizement. It prohibits using a doctor’s name, signature or photograph to endorse commercial products, and boasting about cases, operations, cures or remedies.

Announcements and public-health communication

The Code permits certain formal announcements, including starting or changing a practice, changing an address, temporary absence or resumption, succeeding to another practice and publicly declaring charges. It also allows doctors to write or speak about public health and hygienic living, including in internet chats, provided the communication does not become self-advertising or solicitation. Medical institutions may advertise in the lay press within stated limits, including their name, type of patients admitted, facilities and fees.

That makes purpose and presentation important. A factual public-health explanation is different from a campaign that trades on a doctor’s reputation, highlights patient stories or claimed outcomes, or urges viewers to book. The Code does not support a blanket claim that every doctor profile or educational post is forbidden; assess the actual material and its purpose. It also says: “A physician should not contribute to the lay press articles and give interviews regarding diseases and treatments which may have the effect of advertising himself or soliciting practices.”

What must health influencers disclose?

A Department of Consumer Affairs release issued by the Press Information Bureau on 10 August 2023 summarizes additional guidance for health and wellness influencers. Certified medical practitioners and recognized health or fitness experts should disclose their credentials when sharing health information, promoting relevant products or services, or making health-related claims. Influencers—including virtual influencers—who present themselves as health experts or medical practitioners should clearly say that an endorsement is not a substitute for professional medical advice, diagnosis or treatment. Read the PIB release.

The release describes these disclosures as relevant to claims about health advantages, disease prevention, treatment or cure, medical conditions, recovery methods and immunity. It says specific health claims should be backed by substantiated facts, and personal views should be distinguished from professional advice. It describes general wellness advice as exempt from these additional requirements when it is not associated with a product or service and does not target a specific condition or outcome.

The PIB release is a government summary of the guidance, not its full text. It says violations may lead to penalties under the Consumer Protection Act 2019 and other relevant provisions, but does not state a particular penalty amount. A disclaimer does not by itself establish that an endorsement is accurate or that a doctor’s promotion complies with professional ethics.

Does using AI change the answer?

The cited sources do not explicitly address generative AI, synthetic doctors or AI-written promotional copy. They establish neither an AI-specific ban nor a safe harbor. The cautious inference is that drafting, voicing, illustrating or distributing a message with AI does not, by itself, make its claims or promotional conduct compliant. Review the finished communication under the professional rules for doctors and the applicable consumer guidance for endorsements; do not present that inference as an express AI-specific regulation.

What the NMC’s October 2026 notice means

The NMC notice listing includes “Guidelines on Ethical Advertising and Public Communication by Hospitals/Medical Institutions and Registered Medical Practitioners,” dated 6 October 2026. The notice confirms that a document with that title and date was listed, but the document’s substantive provisions and legal effect could not be confirmed from the available material. In particular, it is not established here whether it addresses AI, influencers or paid promotion, or whether it replaces or supplements earlier rules. A practical review before publishing

  1. Identify who is speaking. Separate a registered doctor’s communication from an influencer’s endorsement; different professional and consumer requirements may apply.
  2. Check the purpose and call to action. Look for patient solicitation, self-promotional claims, booking prompts, or claims about a doctor’s skills, results or standing.
  3. Verify claims and evidence. Substantiate specific health claims and avoid presenting patient outcomes or testimonials as permitted simply because AI generated them or an influencer posted them.
  4. Make relevant disclosures. Where the influencer guidance applies, disclose credentials or provide the required clear disclaimer, and distinguish personal opinion from professional advice.
  5. Confirm the current NMC position. Review the 6 October 2026 guidelines and any later Gazette notification, then assess the final post, video, image or campaign rather than just its production method.
