Sometimes—but there is no single U.S. rule. State law may let a physician dispense medication directly to a patient under specified conditions, often with a separate physician-dispensing registration or permit. A medical license alone does not necessarily authorize office dispensing, and permission to dispense does not by itself answer whether a particular facility also needs a pharmacy permit. The answer depends on the state, medication, dispensing location, and arrangement.

Prescribing is different from dispensing

A doctor who writes a prescription for a patient to fill at a pharmacy is prescribing. A doctor who supplies the medication directly from a clinic or office is dispensing. State laws may regulate those activities differently, so a physician’s authority to prescribe should not be treated as automatic permission to keep and provide prescription drugs at a practice.

Rules commonly use the word “dispense,” not “sell.” Whether a practice charges for the medication is only one fact to check: the state examples below also address registration, location, drug category, records, and patient counseling. The cited rules do not establish when a specific facility must hold a pharmacy permit, so that question must be checked separately with the relevant regulators.

How the rules differ by state

These examples illustrate several state approaches; they are not a nationwide survey. The cited regulations are hosted by Cornell’s Legal Information Institute. Before dispensing, verify the current rule, any statutes it incorporates, and current board guidance with the state medical and pharmacy boards.

State Registration or permit approach Other rules highlighted
Florida Under Fla. Admin. Code Ann. R. 64B8-4.029, a physician may dispense drugs to the physician’s patient in the regular course of practice if registered as a dispensing physician with the Board of Medicine. The rule refers to compliance with the cited statute and fee rule. The source does not state the fee amount.
Arizona Ariz. Admin. Code § R4-16-301 requires a currently licensed physician seeking to dispense controlled substances, prescription-only drugs, or devices to register with the Board and provide required information. For controlled-substance dispensing, the rule calls for a current DEA certificate for each dispensing location. Registration renewal matters: dispensing is barred until renewal is approved if registration is not renewed. Ariz. Admin. Code § R4-16-303 also addresses practice requirements, including records, review of the prepared item, patient information, and permitted sourcing.
Oregon Under Or. Admin. Code § 847-015-0025(1), an actively licensed physician who dispenses drugs must register with the Board before beginning. Dispensing must be documented in the patient record. Verbal counseling is required for new medications. The rule treats no-charge sample distribution separately from dispensing.
Louisiana La. Admin. Code tit. 46, § XLV-6505 requires a physician, apart from bona fide medication samples, to be registered as a dispensing physician to dispense. Dispensing must occur in the usual and ordinary course of medical practice for a legitimate medical purpose. The rule restricts dispensing on another practitioner’s prescription and generally restricts controlled substances and drugs of concern, subject to an exception in another section.
Maryland Md. Code Regs. 10.32.23.04 describes a dispensing-permit process. An applicant must hold a Maryland medical license and be in good standing, demonstrate basic knowledge of applicable dispensing laws, apply, and pay the fee. The application must identify dispensing locations, and the process allows inspection.

What to check before a practice dispenses

The state examples show why a general answer is not enough. Confirm the rules for the specific combination of physician, medication, site, and supply arrangement.

  1. Identify the state and every dispensing site. Check whether the medical board requires physician-dispensing registration or a permit, whether each location must be reported or separately documented, and whether the registration must be renewed.
  2. Identify the drug category. Check rules for prescription-only drugs, devices, controlled substances, and any specially restricted drugs. Do not assume that permission for one category covers another.
  3. Check the supply and handling requirements. Determine which sources are allowed and what rules apply to preparing or reviewing the medication, storage, labeling, and patient information. Arizona’s rule, for example, specifies sourcing from an FDA-approved manufacturer or distributor or a currently permitted pharmacy.
  4. Set up records and patient communication. Check what must be entered in the patient record and whether directions or counseling must be provided. Arizona specifies record and patient-information duties; Oregon requires documentation and verbal counseling for new medications.
  5. Ask whether the site needs a pharmacy permit. A physician-dispensing registration is not necessarily the same thing as a pharmacy license or facility permit. The cited examples do not resolve the facility-permit question for every kind of practice, so ask the state pharmacy board directly.
  6. Verify special cases with both relevant state boards. Confirm current medical-board and pharmacy-board requirements, applicable state statutes, and federal rules—especially for controlled substances—before starting. The cited state examples do not provide a complete statement of federal requirements.

Controlled substances and samples can change the answer

Controlled substances

Do not infer controlled-substance authority from a general physician-dispensing rule. Arizona’s rule calls for a current DEA certificate for each dispensing location when dispensing controlled substances. Louisiana’s rule generally prohibits dispensing controlled substances or drugs of concern except as provided by another section. The applicable state and federal requirements must be checked for the specific drug and site.

Free samples

A sample exception is not a blanket exemption from all dispensing rules. Louisiana excepts bona fide medication samples from its registration requirement, while Oregon says distribution of no-charge samples is not dispensing under that rule. Those are jurisdiction-specific provisions; they do not establish how another state treats samples or other no-charge supplies.
