Yes, police can ask Discord for information that may help identify an account or investigate its activity, but they do not have automatic, unrestricted access. Discord says it reviews legal requests and discloses data when required by valid, appropriately scoped process. What it can provide depends on the data sought, the applicable law, and what records it still retains.
What does “track a Discord account” mean?
“Track” can refer to several different things: identifying an account, obtaining account or device-related records, seeking stored messages, or asking Discord to preserve data while investigators seek the legal authority to obtain it. These are separate requests, with different requirements.
Discord’s law-enforcement guidance says investigators should provide a usable identifier, such as a 17- or 18-digit user ID, username, email address, phone number, server ID, or message ID. Those details help Discord locate the relevant account, server, or message; a username alone does not give police direct access to an account.
What information might Discord have?
Discord’s privacy policy identifies information it processes that includes IP address, operating-system and browser information, and device settings such as microphone or camera settings. Its policy also says it may disclose information when required by law.

That does not establish that every listed record is available for every account or request. Whether Discord can provide a particular IP address, message, or other record depends on what it retains, the request’s scope, and the legal authority presented. The public guidance does not establish that police can use Discord to see a user’s live location or continuously track their movements.
What legal process does Discord require?
Discord says it responds to valid legal requests consistent with laws including the U.S. Stored Communications Act, Pen Register Act, and Wiretap Act. The appropriate process depends on the type of information sought and the applicable jurisdiction. A subpoena, court order, warrant, and wiretap authority are not interchangeable labels: each has its own legal requirements, and the relevant law determines which applies.

Discord says it reviews requests for legal compliance and limits disclosures to the specific circumstances the request authorizes. Investigators submit requests through Discord’s Government Request Portal and should identify the account, server, or message as specifically as possible. A request is not a guarantee that Discord has the data or will disclose it.
How do emergency and preservation requests differ?
Emergency disclosure
Discord says it may disclose information without ordinary legal process when it has a good-faith belief that an emergency involving an imminent risk of death or serious bodily injury requires disclosure without delay. The requesting authority must provide specific details, identify the types of data sought, and explain how the information would address the emergency. This is a narrow emergency standard, not a general shortcut for routine investigations.

Preservation
Under 18 U.S.C. § 2703(f), Discord says it will preserve account data for an initial 90 days. It may extend preservation once for another 90 days when it receives an extension request. Preservation holds data while investigators seek the appropriate legal process; it is not itself authorization to disclose the data. Discord asks investigators to include its internal preservation reference number in later legal process.
Will Discord notify you?
Discord’s policy is generally to notify users when a government entity seeks account data through legal process and to provide a copy of the relevant process, unless notice is legally barred or an exception applies. U.S. authorities seeking nondisclosure should identify the applicable statute or provide a finite nondisclosure order under 18 U.S.C. § 2705(b). Discord says it may also withhold notice in circumstances such as child exploitation or an imminent threat to life.

Discord says it does not notify users about preservation requests or emergency disclosure requests. So, lack of a notice does not establish that no request was made.

Does the process change outside the United States?
Yes. Discord says most foreign authorities should use mutual legal-assistance procedures. Requests involving users in the European Economic Area should generally be directed to Discord Netherlands B.V. and, where possible, submitted through a European Investigation Order under Directive 2014/41/EU. Requests concerning other users are directed to Discord Inc.; Discord says it may provide information to foreign authorities when a request is valid under the requesting country’s law.

What do Discord’s published figures show?
Discord reported that in Q3 2022 it received 1,450 legal-process requests; it found 1,342 legally valid and specific enough to identify an account and produce relevant information. The company also reported 213 emergency disclosure requests for that quarter. These are historical figures for Q3 2022, not current totals or a measure of how often any particular user’s data is disclosed. Discord’s Transparency Hub lists reporting through 2026.
What can’t be concluded from the public guidance?
- It does not promise that Discord can provide an IP address, deleted message, voice recording, or complete account history in any particular case.
- It does not mean that police can search Discord accounts at will or that a username alone gives them access.
- It does not establish a capability for continuous live-location tracking through Discord.
- It does not make preservation equivalent to disclosure; investigators still need appropriate legal authority to obtain preserved information.
