In the United States, the reviewed federal guidance describes AI as software that may support clinical decisions—not as a licensed prescriber. An AI tool might help a clinician review information or consider options, but an AI-generated medication suggestion is not itself a prescription. A prescription obtained through telehealth is different: an authorized clinician evaluates the patient and makes the prescribing decision.

Can an AI prescribe medication without a doctor?

Based on the U.S. federal guidance discussed here, AI can assist with medication-related decisions, but the guidance does not give AI systems prescribing authority. It distinguishes software that supports a health care professional from software that issues a specific treatment directive. Neither an AI response to a patient nor a recommendation to a clinician should be mistaken for a prescription.

This is a U.S.-focused explanation of federal sources, not a determination of the rules in every state or for any particular product. Prescribing authority and professional licensing rules can also depend on state law. The reviewed sources do not establish the regulatory status of any named AI prescribing service.

How AI medication support differs from a prescription

The practical difference is who receives the output, what the software does, and who makes the clinical decision. FDA’s January 29, 2026 Clinical Decision Support Software Guidance explains how certain software functions may be treated under federal device law; it does not grant software the authority to prescribe.

Use What happens Who makes the prescribing decision?
Patient-facing AI information The tool gives a patient information or a medication-related response. FDA says software intended for patients or caregivers does not meet the cited criterion for software limited to supporting or recommending actions to health care professionals. The AI response is not a prescription. It does not replace an authorized clinician’s decision.
Clinician-facing decision support Software may present information or recommendations for a health care professional. FDA’s examples include evidence-based order sets and drug-interaction or allergy notifications. A qualified professional must be able to independently review the basis for the recommendation and retain clinical judgment.
Specific treatment directive Software that provides a specific preventive, diagnostic, or treatment course or directive raises a different regulatory question under FDA’s criteria. The software’s intended use and function matter; its classification cannot be inferred just from the label “AI.”
Prescription through telehealth A patient receives remote care from an authorized practitioner, who assesses the case and may prescribe when applicable requirements are met. The authorized practitioner—not the AI—prescribes.

FDA’s criteria are about how particular software functions are treated, not a blanket statement that every medication-related AI tool is—or is not—a regulated medical device. A recommendation that helps a clinician consider options is not equivalent to software directing a treatment course, and device status alone should not be confused with professional prescribing authority.

What happens when AI helps a clinician consider medication?

  1. Information is entered or reviewed. Depending on the tool, this may include details relevant to the clinical question. The reviewed sources do not establish the capabilities or data practices of any specific product.
  2. The software presents information or a recommendation. For example, clinician-facing decision support may flag a possible interaction or allergy concern, or organize options for a professional to consider.
  3. The clinician evaluates the basis and the patient’s situation. FDA’s non-device clinical decision support criteria include enabling the professional to independently review the basis for a recommendation and not replacing or directing professional judgment.
  4. An authorized clinician decides whether to prescribe. If a prescription is appropriate and the relevant requirements are met, the clinician—not the AI—issues it.

That distinction matters even when software appears to produce a confident, personalized answer. FDA says patient- or caregiver-intended software does not meet the cited criterion for software limited to supporting health care professionals. A patient-facing answer should therefore not be treated as though a clinician has evaluated the patient or issued an order.

Can telehealth provide a prescription without an in-person visit?

Sometimes an authorized clinician can prescribe through telehealth without first seeing the patient in person, but the answer depends on the medication and applicable requirements. HHS says a DEA-registered practitioner may prescribe a Schedule II–V controlled substance to a patient using telemedicine without a prior in-person medical evaluation when the required conditions are met. This is a rule about authorized practitioners and controlled substances—not autonomous AI prescribing or a universal rule for every medication.

HHS reports that the full set of federal telemedicine flexibilities for controlled-medication prescriptions is extended through December 31, 2026. That date applies to the federal policy described by HHS; it does not settle every state-specific prescribing or licensing question. Because the policy is time-sensitive, check current federal and state requirements when arranging care.

How to tell whether a service is using AI support or offering clinician care

  • Who is responding? Is the output for you as the patient, or is software supporting a health care professional?
  • What does the output do? Does it present information or options, or provide a specific treatment directive?
  • Who reviews the decision? Can a qualified clinician independently examine the recommendation and make the prescribing decision?
  • What care pathway and medication are involved? Controlled medications prescribed by telehealth have specific federal policy conditions; that does not determine the rules for every drug or state.
  • What is the product intended to do? The word “AI” alone does not establish a tool’s regulatory status or prescribing authority.

If a service says it can get you a prescription, distinguish whether it connects you with an authorized clinician for an evaluation or merely generates an AI recommendation. The former may be telehealth care; the latter, by itself, is not a clinician-issued prescription.

What the FDA guidance does—and does not—establish

FDA’s final Clinical Decision Support Software Guidance, dated January 29, 2026, explains that some clinical decision support functions may fall outside the statutory definition of a medical device when specified criteria are met, while other software functions can remain medical devices subject to FDA oversight. The Digital Health Policy Navigator describes criteria that include clinician-facing recommendations, not replacing or directing professional judgment, and allowing independent review of the recommendation’s basis.
