Yes—some AI-enabled software can support diagnosis or treatment, but that does not mean any consumer health app can safely do so or has FDA authorization. In the United States, the app’s intended use, inputs, outputs, users, and the risks if it fails help determine whether FDA medical-device requirements apply. A wellness feature, a clinician-facing aid, and an app that gives a patient a specific diagnosis or treatment directive are not automatically treated alike.
What determines whether an AI health app is regulated?
AI is a technology, not a regulatory category. The U.S. Food and Drug Administration (FDA) regulates medical devices, including qualifying AI-enabled devices, using a risk-based approach that considers intended use and technological characteristics. The agency puts it plainly: “The FDA does not regulate AI as such; it regulates medical devices, including AI-enabled medical devices.” See the FDA overview of AI-enabled medical devices.
FDA’s software policies are function-specific and apply across platforms. Running on a phone neither automatically exempts an app nor automatically makes it a regulated device. A key question is whether a software function is intended for a medical purpose and whether its failure could pose a risk to patient safety.

Software that analyzes a person’s information and gives a specific diagnostic or treatment output is an important signal of possible device oversight. Examples include a disease-specific risk score, a patient-specific treatment plan, or a directive about what care to seek. The app’s claims, intended users, data inputs, and actual functions all matter; the label “AI,” “wellness,” or “clinical decision support” does not decide its status.

Wellness and self-management are different cases
FDA identifies some lower-risk functions, such as wellness tracking, coaching to support behavioral change, and self-management support that does not give specific treatment suggestions, as areas that may be outside the focus of its oversight or subject to enforcement discretion. These are not blanket exemptions for every app marketed as wellness. Classification depends on the particular function and circumstances.
Can an AI app provide clinical decision support?
Some software can support clinical decisions, but “clinical decision support” does not mean “automatically exempt from FDA oversight.” FDA’s final Clinical Decision Support Software Guidance for Industry and Food and Drug Administration Staff, issued January 29, 2026, clarifies statutory criteria for certain software functions excluded from the device definition. FDA also says existing digital health policies continue to apply to functions that meet the device definition, including functions intended for patients or caregivers.
The criteria described in FDA’s Digital Health Policy Navigator include whether recommendations are made to health care professionals, whether the software supplies a specific output or directive, how time-sensitive the decision is, and whether a professional can independently review the basis for the recommendation rather than primarily relying on it.
Functions that may fail those non-device criteria include specific preventive, diagnostic, or treatment courses; specific follow-up directives; time-critical alerts; patient-specific treatment plans; and disease-specific risk scores. Patient-facing software is not exempt simply because it presents information or calls itself decision support.

What can FDA-authorized AI medical devices do?
AI is already incorporated into some medical devices used for diagnosis-related tasks and treatment. FDA’s examples include an imaging system that provides diagnostic information for skin cancer, software that detects diabetic retinopathy from retinal images, a sensor that estimates heart-attack probability, and algorithms that automate insulin dosing from continuous glucose monitor readings. These examples demonstrate possible medical uses; they do not establish that a general chatbot or symptom checker has the same authorization, evidence, or intended use.
FDA reported more than 1,600 AI-enabled medical devices authorized for marketing in the United States as of September 2026. That is a device count—not a count of consumer health apps and not a measure of accuracy. Depending on the device, relevant premarket pathways can include 510(k) clearance, De Novo classification, or premarket approval.
How can you check a particular app’s claims?
- Identify the exact purpose and intended user. Look for the condition and use the manufacturer claims to address, and whether the intended user is a patient, caregiver, or clinician.
- Classify what the app actually does. Distinguish general education or wellness support from triage, diagnosis support, a patient-specific risk score, treatment recommendations, or control of a medical device. Note whether it processes self-entered information, images, sensor signals, or medical-device data.
- Verify any FDA claim against the exact product and function. Ask the manufacturer for the specific FDA status and pathway, then match the product identity to FDA’s public device information. “FDA registered,” “AI-powered,” or an app-store listing by itself does not establish clearance or approval.
- Look for evidence for the intended use. Ask whether performance has been evaluated for the app’s claimed use and target population. Evidence for another product or FDA’s overall device count cannot establish this app’s performance.
- Consider consequences and safeguards. Check what the app says about its limits and whether it directs users to professional or emergency care when appropriate. Consider what could happen if an output is missed or wrong.
- Read the privacy notice and data practices. Check what information is collected or shared and whether a covered entity or business associate is involved; privacy obligations are a separate question from FDA device status.
These checks can help you scrutinize a product’s claims, but they do not replace a product-specific FDA determination or professional medical advice.
Does HIPAA protect information in every AI health app?
No. Whether HIPAA applies depends on the app’s role and relationships, including whether its developer handles protected health information for a covered entity or business associate. A consumer app not offered by a HIPAA-covered entity or its business associate may fall outside HIPAA, but that does not mean no rules apply. FTC laws and other federal requirements may be relevant depending on the app and its data practices.

The FTC Mobile Health Apps Interactive Tool helps developers identify potentially applicable federal laws based on an app’s function, data, and services. HHS also lists potentially relevant frameworks in its health-app resource, including the FTC Act, FTC Health Breach Notification Rule, HIPAA Rules, FD&C Act, and COPPA. The particular app’s circumstances matter.
Why is there no single accuracy score for AI health apps?
“AI health app” covers products that answer different questions, use different inputs, and have different intended users. A performance claim is meaningful only in relation to the specific product, intended use, target population, and evidence supporting it. An app that provides wellness coaching cannot be compared fairly with a device that analyzes retinal images or controls insulin dosing using a generic accuracy ranking.
FDA’s reported device count does not establish the performance of an individual product. Nor do the cited official sources establish the authorization, safety, or effectiveness of any unnamed symptom checker or chatbot. Verify those claims for the specific app rather than inferring them from the technology or from other devices.
