Yes. A store can accuse you or report a suspected unpaid item, but an accusation is not a finding of guilt. Whether a missed self-checkout scan is a crime depends on the law where it happened and the facts, including any intent required by that law.
What a store accusation does—and does not—mean
It helps to separate four stages that are often blurred together:
- Suspicion or accusation: An employee notices an item that appears unpaid and may question you or report the incident.
- Detention: Store personnel may be permitted under some state laws to briefly detain a suspected shoplifter, but only under the conditions set by that law.
- Police or prosecutor action: Law enforcement may investigate, and a prosecutor may decide whether to pursue a charge.
- A court decision: Guilt is determined in a criminal proceeding, not by a store employee’s accusation.
A checkout discrepancy may prompt scrutiny, but it does not by itself explain why the item was not scanned or establish criminal intent.
Why the state and the checkout details matter
There is no single nationwide answer to whether a particular missed scan amounts to shoplifting. The applicable offense and its elements vary by jurisdiction. For example, Florida’s 2026 statute defines retail theft to include taking possession of or carrying away merchandise with intent to deprive the merchant of possession, use, benefit, or full retail value. Florida Statutes § 812.015

North Carolina separately makes willfully concealing merchandise while still on store premises an offense. Its statute also says that, for the price-tag or product-code transfer provision, mere possession of goods or presenting improperly priced merchandise for checkout does not itself constitute prima facie evidence of guilt under that provision. That specific rule should not be generalized to every shoplifting or theft allegation. North Carolina General Statutes, Chapter 14, Article 16
In assessing a self-checkout incident, the surrounding circumstances can matter: whether you tried to scan the item, whether its barcode failed, where it was in the cart, what the register displayed, what happened before you left, and what was said after an employee stopped you. Video, employee observations, and statements may be evidence, but they are not a fixed legal test applicable in every case. Can store employees detain you?
Some states authorize a merchant or employee to detain someone suspected of shoplifting, subject to statutory limits. Florida’s 2026 law permits detention when the merchant or employee has probable cause and requires the detention to be in a reasonable manner and for a reasonable time for recovery of merchandise or prosecution. North Carolina’s statute likewise conditions merchant detention protection on probable cause and detention on or reasonably near the premises, in a reasonable manner and for a reasonable length of time. These are state-specific examples, not a rule for every state.
A self-checkout case is not a forecast for every mistake
In State of New Jersey v. Shamecca Whitfield, a shopper who failed to scan a detergent bottle at self-checkout was convicted of shoplifting, and the appellate court affirmed. The opinion shows that a self-checkout incident can be prosecuted; it does not establish that every missed scan is intentional or that another shopper’s case will have the same outcome. What to do if you are stopped or contacted later
- Stay calm and avoid escalating the interaction.
- If an item was missed, explain what happened truthfully; do not guess about facts you do not remember.
- Keep any receipt, transaction record, or other information that may help document the checkout.
- If police contact you, you are detained, or you receive official notice of a charge, seek advice from a licensed attorney in the state where the incident occurred.
An honest mistake does not guarantee that a store will not accuse or report you. Conversely, an unpaid item alone does not automatically prove shoplifting; the applicable law and evidence determine what follows.
