No, not under New York’s general at-will employment rule: an employee may leave without giving two weeks’ notice. A manager’s statement that a two-week clock will start anyway does not, by itself, establish a legal obligation to keep working. A contract or union agreement may change the rules for a particular job.
An October 2, 2026 report described a hotel pastry worker who gave four days’ notice and whose manager said he would start a two-week clock anyway. The report framed her reply as citing New York law. It does not establish her contract, union status, the hotel’s benefit policy, or what happened afterward, so the general legal rule cannot settle every detail of her individual case. Is two weeks’ notice required in New York?
Generally, no. The New York State Department of Labor (NYSDOL) says New York is an at-will employment state and that an employee may leave at any time without needing to defend or explain the decision. The New York State Bar Association (NYSBA) likewise states that there is no legal requirement to give an employer two weeks’ notice before resigning.

Two weeks’ notice is a common professional courtesy, not a general state-law requirement. The NYSDOL’s Wages and Hours FAQ and the NYSBA’s employment guide explain the general rule and its qualifications.

Can a manager make you work two weeks after you quit?
A manager cannot create a general two-week legal notice requirement simply by declaring that a clock has started. Under the general at-will rule, an employee may leave. But a specific employment contract or union agreement can set different terms, so the worker’s actual agreement matters more than a manager’s assertion or a broad summary of state law.
Check for a contract or union agreement
- Review any signed employment contract for provisions about resignation, required notice, or consequences for leaving early.
- If you are covered by a union, check the collective bargaining agreement or ask your union representative what it says about resignation and related terms.
- If no such agreement changes the terms, the general New York at-will rule applies.
The NYSDOL notes that a contract restricting termination can qualify the at-will rule; the NYSBA guide also says that union labor contracts govern terms and conditions for represented workers. Those qualifications mean the general rule should not be treated as a finding about the pastry worker’s particular job.

Can an employer withhold your final paycheck if you leave without two weeks’ notice?
New York’s final-wage rule concerns pay for work already performed: the NYSDOL says wages must be paid by the regular payday for the pay period in which the work was done. It also says employers may not deduct fines or business losses from wages. The hotel report does not say the manager threatened to withhold the worker’s wages.
For unpaid wages or certain promised wage supplements, including vacation pay, the NYSDOL explains claim options and eligibility on its unpaid or withheld wages page. Whether a particular claim is accepted depends on its facts and the applicable policy.

Can you lose unused vacation pay if you quit without notice?
Unused vacation is not the same as wages already earned. Under NYSDOL guidance, vacation payout depends on the employer’s written vacation or resignation policy. If vacation has been earned and there is no written forfeiture policy, the employer must pay accrued vacation. Any conditions for losing that pay must have been provided to employees in writing.
The NYSDOL also says some claims for promised benefits may not be accepted when an employer policy excludes collection for a specific reason, such as quitting without notice. Read the policy that applies to your job and consider the agency’s claim guidance before assuming that a resignation without notice automatically preserves—or forfeits—vacation pay.

What the hotel pastry-worker report does and does not establish
The reported exchange is a useful example of why a manager’s statement and the law’s general rule are not the same thing. The report says the worker gave four days’ notice and the manager said he would start a two-week clock anyway; it frames her response as citing New York law. It does not establish whether she had a contract, was union-represented, had a relevant vacation policy, or what the ultimate outcome was. Those details would be needed to assess the individual situation.
