California Attorney General Rob Bonta announced on October 2, 2026, that California is leading a coalition of 26 states, counties and cities suing the National Highway Traffic Safety Administration (NHTSA) over its final rule weakening fuel-economy standards for new passenger cars and light trucks. Filed in the U.S. Court of Appeals for the First Circuit, the case argues that the rule violates federal law. The court has not ruled on those claims in the available sources.
What the lawsuit challenges
The state-and-local coalition’s petition targets NHTSA’s final rule changing corporate average fuel economy standards, commonly called CAFE standards. These standards apply to manufacturers’ fleets of new passenger cars and light trucks. California’s announcement describes the rule as weakening the prior standards, but the available sources do not provide the final rule’s full numerical targets or model-year requirements.
The coalition filed in the First Circuit on October 2, 2026. The Associated Press reported a separate same-day lawsuit by environmental organizations challenging the relaxed rule; that is distinct from the state-and-local coalition’s case. Why the coalition says the rule is unlawful
The coalition alleges violations of both the Administrative Procedure Act (APA) and the Energy Policy and Conservation Act (EPCA). Under the coalition’s reading of EPCA, NHTSA must set CAFE standards at the “maximum feasible” level after considering technological feasibility, economic practicability, the effect of other motor-vehicle standards and the need to conserve energy.

California’s announcement says NHTSA’s interpretation of that mandate and its analysis fail the statutory test and are arbitrary and capricious. Those are allegations made by parties challenging the rule, not findings by a court. The available sources do not establish a ruling on the merits or any order changing the rule’s status.

What the competing savings estimates mean
The parties describe consumer costs differently. Their figures refer to different effects and time frames, and the underlying analyses are not included in the available sources. Other effects disputed by California
California says the rule ends the CAFE credit-trading program in 2028 and alleges that the change will significantly harm electric-vehicle industries employing Californians. Both the rule description and the forecasted industry effect are the state’s claims in its announcement; the available sources do not include the final rule text or an independent assessment of the projected harm.
The state also alleges that NHTSA’s analysis is deficient in its treatment of affordability, vehicle sales, fleet turnover, fuel savings and vehicle safety, and that the agency excludes future climate-damage costs.
