Brazil’s data protection authority did not impose a permanent, countrywide ban on AI. In July 2024, the Autoridade Nacional de Proteção de Dados (ANPD) ordered Meta to suspend a specific privacy-policy change and related use of personal data for generative-AI training in Brazil. On August 30, the authority approved a compliance plan and lifted that preventive suspension. The final outcome of the supervisory case is not established by the latest dated case information available here.

What happened, and when?

Date ANPD action or development Effect
May 2024 Meta said it was offering additional transparency in response to ANPD recommendations and described plans to develop AI for Brazil. This was Meta’s stated position, not confirmation that ANPD accepted every part of its approach.
June 26, 2024 Meta’s updated privacy policy took effect. It covered Meta services including Facebook, Messenger and Instagram, and allowed public information and content shared on those services to be used to train or improve generative-AI systems. The policy change and associated processing became the subject of ANPD’s intervention.
July 2, 2024 ANPD ordered a preventive suspension of the relevant policy provision and related personal-data processing for AI training in Brazil. It announced a daily fine of R$50,000 for noncompliance. The order applied to personal data of both users and non-users of Meta platforms. It was not a general prohibition on AI development.
July 10, 2024 After Meta sought reconsideration, ANPD maintained the preventive measure, allowed more time to document compliance, and called for technical review and a compliance plan with an implementation schedule. The suspension remained in force at this stage.
August 30, 2024 ANPD approved an updated compliance plan. The authority suspended the preventive measure and said it would monitor implementation.

Why did ANPD intervene?

ANPD described its concerns as preliminary, not as a final ruling that Meta had violated the law. The authority cited questions about whether Meta had an adequate legal basis for the processing, whether people received clear and sufficient information, whether it was too difficult to exercise the right to object, and whether there were adequate safeguards for processing involving children and adolescents.

The case concerned compliance with Brazil’s Lei Geral de Proteção de Dados Pessoais (LGPD), or General Personal Data Protection Law, in the context of Meta’s policy change and generative-AI training. In English: “It should be emphasized that ANPD’s action was intended to promote compliance with the General Personal Data Protection Law and clarify data subjects’ rights.” This statement describes the regulator’s purpose; it is not a determination that Meta’s practices were compliant.

What did Meta’s approved compliance plan require?

The August 30 plan changed the immediate regulatory position from a halt to monitored compliance steps. ANPD said the plan required Meta to:

  • Provide clearer notices, including notifications in its apps and by email.
  • Update its privacy communications.
  • Make it simpler for users and non-users to object to the use of their data.
  • Commit not to use data from accounts belonging to people under 18 until a definitive decision in the supervisory case.

The commitment about under-18 accounts was part of the approved plan pending a definitive decision; it should not be mistaken for a final resolution of the case.

What the order does—and does not—mean

The July action was a preventive measure focused on a particular Meta policy change and personal-data processing for generative-AI training in Brazil. It did not amount to a ban on AI systems generally, nor does the August plan establish that every use of Meta data was approved. The ANPD notice announcing the order cited about 102 million active Facebook users in Brazil; that was the authority’s figure in July 2024, not a current audience estimate.

Is the suspension still in effect?

ANPD’s public listing identifies the Meta generative-AI supervision process as 00261.004509/2024-36. The latest substantive case outcome established here is the authority’s August 30, 2024 approval of the plan and suspension of the preventive measure. The public process reference and that dated action do not establish the supervisory case’s final disposition as of October 5, 2026. They therefore do not support a present-tense conclusion about whether Meta may currently use Brazilian data for AI training.
