Spot Bitcoin exchange-traded products give investors another regulated-securities-market route to Bitcoin exposure, but their arrival does not by itself prove that Bitcoin is more liquid than other assets—or that large Bitcoin trades now have lower costs. To judge a liquidity advantage, compare executable spreads, order-book depth, and price impact for a defined market, venue, and time period.
What does “liquidity advantage” mean?
Liquidity is not a single number. A market may report high trading volume yet offer little reliable depth at the prices a large trader needs. A useful comparison specifies the asset, venue, period, and order size, then separates several measures:

| Trading volume | How much trading was reported over a stated period and on a stated venue. | Whether that volume represents genuine, executable liquidity or can be accessed at low cost. |
For Bitcoin, the comparison also needs to distinguish spot-market trading from Bitcoin ETP-share trading and CME Bitcoin futures. They are related markets, not interchangeable measures of liquidity. A claim that Bitcoin has an “advantage” therefore needs a named comparison—such as another asset class or a particular venue—and comparable measurements taken over the same period.

What changed when the SEC approved spot Bitcoin ETPs?
On January 10, 2024, the U.S. Securities and Exchange Commission approved the listing and trading of a number of spot Bitcoin ETP shares. The decision opened a securities-market channel for Bitcoin exposure. It did not approve Bitcoin itself, endorse crypto trading platforms or intermediaries, or establish that every Bitcoin venue is a regulated securities exchange.

SEC Chair Gary Gensler described the scope directly: “While we approved the listing and trading of certain spot bitcoin ETP shares today, we did not approve or endorse bitcoin.” The SEC cited features of the listed-securities channel, including disclosure requirements, listing on registered national securities exchanges, exchange rules designed to prevent fraud and manipulation, Regulation Best Interest obligations for broker-dealers recommending ETPs to retail investors, and fiduciary duties for investment advisers. Those protections apply to the relevant securities and regulated firms; they do not extend automatically to every crypto market participant.
Calling these products “ETFs” can blur a legal distinction. Commissioner Caroline Crenshaw’s dissent noted that the approved products were not registered investment companies under the Investment Company Act of 1940. For a discussion of market structure, “spot Bitcoin ETP” is the more careful description.

Does the SEC’s futures rationale show that Bitcoin spot markets are deep?
No. In its approval rationale, the SEC did not find that the CME Bitcoin futures market was of “significant size” relative to the Bitcoin spot market. Instead, it concluded that its correlation analysis supported another route to approval: fraud or manipulation affecting spot Bitcoin prices would likely also affect CME futures prices, where CME surveillance could help detect those effects.
That is a surveillance rationale, not a finding about spot-market depth, uniformity, or execution costs. Correlation between futures and spot prices does not tell a trader how much Bitcoin can be bought or sold at a given price. Commissioner Mark Uyeda’s concurrence criticized the Commission’s approach to “significant size,” describing its use in other commodity ETP contexts as apparently involving liquidity and volume at a futures venue compared with the overall futures market for that commodity. That was his criticism of the SEC’s reasoning, not a current measurement of Bitcoin liquidity.

Why can reported volume mislead?
Volume records reported trading activity; it does not necessarily show how much genuine interest is available to execute an order. In her 2024 dissent, Commissioner Crenshaw argued that global spot-market data were incomplete and raised concerns about wash trading and surveillance. She cited a 2023 analysis by Cong and coauthors estimating that wash trading averaged as high as 77.5% of volume across a sample of 29 major unregulated crypto exchanges.
The scope matters: the estimate concerns the study’s sampled exchanges and four crypto assets. It is historical, is not a current Bitcoin-only measurement, and should not be treated as the present wash-trading rate for the whole market. It illustrates why volume alone cannot settle a claim about executable liquidity.

How do ETP shares and Bitcoin liquidity connect?
ETP shares trade on national securities exchanges during exchange trading hours. Authorized participants can create and redeem shares to help keep the share price aligned with the value of assets in the investment pool. That process links ETP-share pricing to the underlying assets, but it does not guarantee that every underlying Bitcoin market has deep order books or low trading costs.

Those are implementation tradeoffs raised in the SEC record, not measured current costs for every product. In a volatile market, the timing between valuation and execution can matter.

Institutional access can add venues and arbitrage mechanisms and broaden the ways investors obtain exposure. How much those changes affect liquidity in underlying spot markets—and where the effect appears—depends on actual trading and execution data. The SEC’s approval record does not quantify a post-approval change in Bitcoin spot spreads, depth, or institutional execution quality, or establish that approval caused one.
How should investors compare routes to Bitcoin exposure?
Compare the route, not just a headline volume figure. An ETP’s exchange liquidity and the liquidity of Bitcoin on a spot venue answer different questions. A practical comparison should keep these dimensions separate:
- ETP-share trading: Examine the share spread and executable depth during the hours the listing exchange is open.
- Underlying spot execution: Check venue-specific depth and the expected price impact for the order size being considered.
- Costs: Account for fund fees as well as spreads and transaction costs involved in trading or creating and redeeming shares.
- Custody and operations: Review the product’s custody and operational arrangements rather than assuming the SEC’s approval endorses them. Gensler explicitly said the approval did not endorse particular custody arrangements.
- Access and protections: Identify which securities-market rules and investor obligations apply to the product and intermediary, and which crypto venues or services fall outside that channel.
For a defensible liquidity claim, compare spreads, depth within stated price bands, and execution costs for the same order size across named venues and periods. Keep spot, ETP shares, and CME futures data distinct, and examine how the measures behave during volatility as well as in ordinary trading. Without those comparable observations, institutional access is evidence of a broader route to exposure—not proof of a quantified Bitcoin liquidity advantage.
