Using an ATM in your bank or credit union’s network generally avoids ATM fees. At an out-of-network machine, you may face both a fee from the ATM operator and a separate fee from your own account provider. There is no established general safety winner based on who owns the ATM. If a machine gives you the wrong amount, contact your bank or credit union promptly; if another party owns the machine, contact that operator too.
What counts as a bank or independent ATM?
“Independent ATM” is common shorthand, not a precise category that tells you who owns a machine or whether your account treats it as in-network. An ATM outside your bank’s network might be owned by another bank, a credit union, or a nonbank business. A bank-branded machine can still be outside your own account’s network.
For the fee-notice rule, the CFPB’s Regulation E defines an ATM operator as someone who operates a machine used for an electronic fund transfer or balance inquiry and does not hold the account involved. That definition is about the relationship to your account, not whether the operator is a bank. Check your institution’s ATM locator and account terms rather than relying on branding alone.

At an out-of-network ATM, two separate fees may apply: one from the machine’s operator and another from your own bank or credit union. The ATM’s on-screen notice covers the operator’s fee; it does not necessarily show a fee your account provider may charge.

| Possible fee | Who charges it | Where to check |
|---|---|---|
| ATM operator fee | The party operating the ATM, if it charges one | The machine must display the amount on screen or on paper before you commit to the transaction, and you must be able to choose whether to continue. CFPB Regulation E § 1005.16 |
| Account-provider fee | Your bank or credit union, if your account charges for using another institution’s ATM | Review your account’s fee schedule. The CFPB says the institution must disclose its fee in writing when you open the account or when it adds a new fee. CFPB guidance on ATM fees |
Using an ATM in your own bank or credit union’s network generally avoids ATM fees, and some institutions reimburse fees charged by other ATMs. The applicable network and reimbursement terms depend on your specific account; confirm them with your provider. CFPB guidance on avoiding ATM fees
Which type of ATM is safer?
The available CFPB material establishes fee and dispute rules, not comparative safety rates for bank-owned and independently operated machines. Ownership or branding alone does not establish that a particular ATM is safer.

Assess the machine and its setting: use a location where you feel comfortable, look for signs that the card reader or keypad may have been altered, and stop if anything seems suspicious. These are practical precautions, not evidence that one ownership category is generally safer.

What to do if an ATM gives you the wrong amount
- Contact your bank or credit union immediately. Explain the amount you requested and what the machine dispensed. This is the institution that handles your account and the Regulation E error process.
- Contact the ATM owner if it is a different party. The CFPB recommends notifying the owner as well when another party operates the machine. CFPB guidance on an ATM dispensing the wrong amount
- Keep the receipt and record the details. The CFPB specifically advises keeping the receipt. Also note the machine’s location, the date, the amount requested, and the amount received so you can describe the discrepancy clearly.
- Report suspected unauthorized activity promptly. If you believe someone used your card or account without permission, notify your institution right away. Reporting times can affect your rights.
Regulation E error reporting and investigation timelines
Under Regulation E, errors include unauthorized electronic fund transfers, incorrect transfers, and receiving an incorrect amount from an electronic terminal. Notice generally must reach your financial institution within 60 days after it sends the statement that first shows the error. CFPB Regulation E § 1005.11

The institution generally has 10 business days to investigate. If it needs longer, it may generally take up to 45 days if it provisionally credits the disputed amount within 10 business days, subject to exceptions and additional notice requirements. ATM transactions do not receive the longer special investigation periods that apply to certain point-of-sale debit transactions.
Lost or stolen cards and unauthorized withdrawals
Separate liability rules apply to unauthorized transfers involving a lost or stolen card. Regulation E describes different potential liability tiers—up to $50 or $500 in certain circumstances—and possible unlimited liability for transfers made after a statement is sent if you do not notify the institution within 60 calendar days. The applicable result depends on the facts and when you report the loss or activity; a refund is not guaranteed. CFPB Regulation E § 1005.6 and official interpretation

How to choose an ATM for a withdrawal
- Check the account’s network: Use your provider’s locator to identify machines treated as in-network; another bank’s logo does not necessarily mean the ATM is in your network.
- Check both fee sources: Read the machine’s operator-fee notice before proceeding and consult your account fee schedule for any separate provider charge.
- Check for reimbursement terms: If you often use out-of-network ATMs, verify whether your account reimburses any fees and under what conditions.
- Assess the individual machine: Choose a location where you are comfortable and do not use a machine that appears altered.
- Keep the receipt: It can help document a transaction if the amount dispensed is incorrect.
