Australia’s privacy regulator has opened an investigation into Shenzhen Qingcheng Future Technology Co Ltd, the maker of the HeyCyan app used by many low-cost smart-glasses models. The Office of the Australian Information Commissioner (OAIC) says the company did not answer preliminary questions about how the glasses record information, who can access it and where it is stored. The investigation is ongoing; the OAIC has not announced a finding that the company or any retailer breached privacy law.
What the OAIC is investigating
The OAIC announced its investigation on 7 October 2026. It says HeyCyan is needed for the full functionality of many lower-cost smart glasses made in China and sold under different brands. The regulator specifically identifies Anko glasses sold by Kmart and products sold through Big W Marketplace, Amazon and other retailers. Users connect a smartphone to the app for functions such as music, calls and a voice assistant; information gathered by the glasses is collected through the app for processing. OAIC announcement
The regulator says it began preliminary inquiries to manufacturers and distributors on 12 August 2026, including inquiries to Shenzhen Qingcheng. It asked how the glasses work and record information, who can access that information, and where it is stored. According to the OAIC, Shenzhen Qingcheng did not respond. Privacy Commissioner Carly Kind said the lack of a response left the regulator with “no assurance” that Australians’ personal data was being protected as required by the Privacy Act.
Kind also said the company’s failure to answer raised concerns about its practices, procedures and systems for protecting personal information under Australian Privacy Principle 1 (APP 1). Those are the Commissioner’s stated concerns, not a final determination that the company violated the Act.

What security flaws have been reported
Separately from the OAIC investigation, ABC News reported on 22 September 2026 that independent testing by NSB Cyber and Abstract Shield found more than a dozen flaws across the glasses, app and website. ABC reported that an attacker could connect to glasses over Bluetooth without a password, and that email addresses, dates of birth, images and videos could be exposed. These technical findings are reported by ABC and attributed to the testing firms. They are not findings announced by the OAIC, which has not concluded its investigation.

What this means for buyers and users
The investigation concerns the HeyCyan app and the company that makes it; it does not establish that every smart-glasses brand has the same risks, or that other brands are safe. If you are assessing a pair of glasses, the relevant questions supported by the available information are whether the model uses HeyCyan, which features depend on the app, what information those features collect or process, and which retailer is selling it.

The OAIC says it has written to retailers of devices using HeyCyan to express its concerns. Kind urged responsible retailers to consider whether continuing to make the devices available is appropriate. That is an appeal to retailers, not an announced order to remove products from sale. The sources available on 7 October 2026 do not establish any retailer’s subsequent stock decision or identify a specific current listing or model.

What could happen next
The OAIC says the Commissioner may investigate an act or practice that may interfere with an individual’s privacy or breach APP 1 under section 40(2) of the Privacy Act 1988. If an investigation supports a finding of interference, possible outcomes include a determination requiring steps to prevent the conduct from continuing or recurring and to redress loss or damage. For serious or repeated interferences, the Commissioner may seek civil penalties in the Federal Court of Australia. These are statutory possibilities, not predictions about this investigation. The OAIC says it will wait until the investigation concludes before commenting further. As of 7 October 2026, no findings, compulsory notices or final enforcement outcome had been announced.

Why smart glasses are drawing privacy scrutiny
In an August 2026 blog, Privacy Commissioner Kind discussed risks from surveillance wearables, including covert recording, consent, location data and heightened risks to vulnerable people. The OAIC said five entities providing smart-glasses hardware or software had been included in its preliminary inquiries since August; that figure describes the broader inquiry process, not five formal investigation targets.
