The Arizona Court of Appeals upheld Gabriel Paul Horcasitas’s manslaughter conviction but vacated his 10.5-year manslaughter sentence and ordered resentencing. It ruled that an AI-generated video portraying the deceased victim as speaking his sister’s imagined words was unreliable and unduly prejudicial in this sentencing because the judge relied on it. The ruling does not overturn the conviction or establish a blanket ban on AI in court.
What the Arizona court decided
In State v. Horcasitas, No. 1 CA-CR 25-0191, filed September 30, 2026, the Arizona Court of Appeals, Division One, affirmed Horcasitas’s manslaughter conviction and vacated only the manslaughter sentence, sending the case back for resentencing. The court also rejected his claim that text messages from the victim’s phone had been improperly excluded.
The appeal concerned the sentencing hearing, not the jury’s determination of guilt. The court’s judgment was “AFFIRMED IN PART; VACATED AND REMANDED IN PART.” Presiding Judge D. Steven Williams wrote the opinion, joined by Judge Anni Hill Foster and Vice Chief Judge David D. Weinzweig.

The case followed a road-rage confrontation at a red light in which Horcasitas shot and killed Christopher Pelkey. A jury found Horcasitas guilty of manslaughter; he later pleaded guilty to an endangerment count. The superior court imposed a presumptive 10.5-year prison term for manslaughter and a concurrent presumptive 2.25-year term for endangerment.

At sentencing, Pelkey’s friends and relatives spoke about his life and the loss caused by his death. His brother read a statement Pelkey had written about his beliefs and hopes. His sister, Stacey Wales, then described what she imagined Pelkey might say if he could speak. An AI video followed, combining authentic footage of Pelkey with generated imagery and speech. In the synthetic segment, a recreation of Pelkey addressed his family and Horcasitas and expressed forgiveness.
Why the court distinguished real footage from generated speech
The appeals court did not treat all of the video the same way. It said the embedded real footage was permissible. Its concern was the generated portion, which did not document an event or capture an actual moment in Pelkey’s life. Instead, it turned his sister’s imagined message into words, expressions and apparent speech presented as if they came directly from him.

The court explained: “Indeed, rather than documenting an event or recording a particular moment, the AI video presents a depiction of the victim and his thoughts created from the imaginings of the victim’s sister.” It said the video “erases the interpretive distance between the family’s belief about what the victim would have said and the victim’s own voice and opinions.” The distinction is about attribution: a relative can describe what they believe the deceased might have said, but a generated performance can make that interpretation appear to be the deceased person’s own recorded message.

Horcasitas had not objected to the video at sentencing, so the Court of Appeals reviewed the claim for fundamental error. It concluded that the video was unreliable and unduly prejudicial on this record, and that its consideration made the sentencing fundamentally unfair.

The opinion says the sentencing judge, Judge Todd F. Lang, expressly responded to the video. He said he “loved” it and felt it “was genuine,” referring to the AI portrayal’s “obvious forgiveness” and describing that forgiveness as coming from the victim’s “heart.” The appellate court observed: “And it clearly impacted the sentencing judge, who said he ‘loved’ the video and felt it ‘was genuine,’ pointing to the AI victim’s ‘obvious forgiveness’ of Horcasitas, which he characterized as coming from the AI victim’s ‘heart.’”
“Genuine” describes Lang’s reaction; it is not the appeals court’s finding that the generated words were authentic. The appellate opinion said the record did not reveal precisely how much the video affected the sentencing calculation, but concluded there was no question it played a role. That demonstrated reliance, together with the video’s presentation of imagined speech as the victim’s own, led the court to find prejudice sufficient to require resentencing.

What the ruling does—and does not—mean for AI in court
The decision addresses AI-generated victim-impact material at sentencing under the facts of this case. The court described the issue as novel in Arizona and applied existing victim-impact and due-process principles. It did not announce a categorical rule barring AI-generated material from every court proceeding, nor did it invalidate victim-impact statements generally. The opinion recognizes the right of victims to be heard while focusing on this portrayal’s reliability, attribution, emotional presentation and demonstrated influence on the judge.

The court also said no disclaimer could cure the error in this video because it continued to present the generated statement as coming directly from Pelkey. That is a conclusion about this particular video, not a general ruling that every disclosure or label for synthetic material is ineffective.
What happens next
The manslaughter conviction remains affirmed. The appellate court vacated the 10.5-year manslaughter sentence and remanded for resentencing. Its mandate specifies that sentence; the opinion also describes the concurrent 2.25-year endangerment term, so the result should not be described as vacating every sentence in the case.
