In the United States, owning a game cartridge or disc does not automatically make it lawful to download a ROM of that game from an unauthorized website. The answer depends on the source of the copy and whether a specific legal exception applies. U.S. law also treats copying a game and bypassing access controls as separate issues. Other countries may have different rules.
Why owning the cartridge or disc is not enough
Owning a physical game copy is not the same as owning its copyright. Under 17 U.S.C. § 106, copyright owners generally hold exclusive rights to reproduce a work and distribute copies, subject to statutory limitations. A ROM downloaded from a website is another copy; possession of the original does not, by itself, authorize that separate reproduction.
That is why the source matters. A download offered by the copyright owner or someone authorized to distribute it is different from a copy posted without permission. The fact that a game is old, unavailable for sale, or described as “abandonware” does not by itself make an unauthorized download lawful.

Section 117 applies to an owner of a copy of a computer program and permits certain additional copies or adaptations in defined circumstances. It is not a general permission to obtain any copy from any source just because you own the game.

- Transfer limits: An exact copy prepared under the section may be transferred only with all rights in the program. Adaptations have additional conditions.
Those are statutory limits, not a blanket “personal backups are always legal” rule. Whether a particular console game, license, copying method, and use satisfy § 117 depends on the circumstances. The statute does not expressly say that downloading a ROM from a third-party website is permitted merely because the downloader owns a physical copy. See the text of 17 U.S.C. § 117.
How common ROM situations differ
| Situation | What the U.S. rules establish |
|---|---|
| Download a ROM from an unknown or unauthorized site while owning the original | Ownership alone does not establish authorization for the separate copy. The reproduction right and any applicable exception still matter. 17 U.S.C. § 106; § 117. |
| Make a copy from a program copy you own | Section 117 allows limited essential-use and archival copies under its conditions; it does not establish that every personal ROM dump qualifies. 17 U.S.C. § 117. |
| Bypass a technological access control | This raises a distinct anti-circumvention question under § 1201. A possible copyright exception for copying does not automatically resolve it. Copyright Office, 2024 proceeding. |
| Preserve a game as an eligible library, archive, or museum | Specific institutional preservation permissions exist, subject to conditions on eligibility, purpose, and access. They are not general consumer ROM-download permissions. 37 C.F.R. § 201.40. |
Copying and bypassing access controls are separate legal questions
Section 1201 generally prohibits circumventing technological measures that control access to copyrighted works. The Copyright Office periodically adopts limited exemptions, but an exemption for a defined situation does not create blanket permission to download or distribute ROMs.

Limited rule for certain games with discontinued authentication servers
The current regulation includes a narrow provision for certain lawfully acquired complete games when the game’s owner or authorized representative has ceased providing access to an external authentication server. The provision concerns restoring personal local gameplay, not downloading any game from an unauthorized source or sharing a ROM. Under the regulation, server access is considered ceased if support has been affirmatively declared ended and unavailable, or has been discontinued for at least six months without being restored. “Local gameplay” means play on a personal computer or console, or locally connected computers or consoles, rather than through an online service or facility. See 37 C.F.R. § 201.40(b)(19).

Separate provisions cover preservation work by eligible libraries, archives, and museums. They impose institutional, purpose, and access restrictions, and include a category for certain games that no longer require an external server and are no longer reasonably available commercially. Those terms do not make unavailable games free for the public to download.

The Copyright Office’s 2024 Section 1201 proceeding records the final rule date as October 28, 2024. The Office’s 2027 proceeding page says the current exemptions, if renewed, would remain in force for an additional period from October 2027 to October 2030; as of October 4, 2026, that renewal proceeding is active. Check the current regulation for any later changes.

- Check whether the ROM source is authorized; owning the physical game does not itself authorize a third-party download.
- Do not assume a copy you make qualifies for § 117; its essential-use and archival conditions are specific.
- Consider access controls separately from copyright copying rules, especially if a process requires circumvention.
- Do not treat a game’s age, commercial unavailability, or server shutdown as automatic permission to download or share it.
- Apply the law of the country involved. The rules explained here concern U.S. federal law, not a worldwide standard.
This is general information about U.S. law, not legal advice for an individual situation.
