There is no reliable yes-or-no answer that applies to every prediction market, contract, and U.S. state. The Commodity Futures Trading Commission (CFTC) says federally regulated prediction markets may operate nationwide, while some state officials argue that state gambling and consumer-protection laws apply to certain event contracts, especially sports contracts. Those positions are being contested; they do not amount to a settled rule for every location or product. To check your situation, identify your location, the exact platform and contract, then verify current regulator guidance, laws, and court orders.

This guide covers the United States, with selected state-policy developments. It does not establish the law for every state, locality, tribal jurisdiction, U.S. territory, or any other country.

Why the answer depends on where you are and what you want to trade

“Prediction market” is a broad label for platforms that offer contracts tied to the outcome of an event. The legal analysis can turn on more than the platform’s name: where you are, which operator offers the contract, what the contract concerns, and how it is structured may all matter. Sports, elections, and other event categories can raise distinct questions.

There are two issues to keep separate:

  • Legal status: Whether federal, state, or local law permits the operator to offer a particular contract to a person in a particular place.
  • Platform access: Whether the operator currently allows residents of that place to open an account or trade that contract. A platform’s location restrictions are useful to check, but they are not a substitute for a legal determination.

A contract being available in an app does not, by itself, settle the legal question. Nor does a general statement about a platform necessarily answer the question for every contract it offers.

What the federal-state dispute means

The CFTC describes prediction markets as markets trading event contracts. Its consumer guidance says federally regulated markets can operate in all 50 states. That is the CFTC’s position, not a conclusive resolution of every state-law dispute.

Issue What the cited source says What that establishes
Federal regulator’s position The CFTC says federal law gives it exclusive authority over event contracts offered by its registrants, and its consumer guidance says federally regulated markets can operate in all 50 states. Sources: CFTC, “Understanding Prediction Markets and Event Contracts,” and CFTC, “CFTC Seeks to Enjoin Arizona Criminal and Civil Enforcement Against Prediction Markets,” April 9, 2026. The agency’s stated position; not a final ruling that resolves every state’s law or every contract.
State officials’ position The Maryland Attorney General’s office says a coalition of 41 attorneys general urged the CFTC to recognize state authority over sports-related event contracts. Source: Maryland Office of the Attorney General, “Attorney General Brown Urges CFTC to Recognize State Authority Over Sports-Related Prediction Markets.” An advocacy position by state officials; not a judicial ruling.
Litigation On April 9, 2026, the CFTC said it filed complaints against Arizona, Connecticut, and Illinois, seeking declarations of federal authority and injunctions against state enforcement. Source: CFTC, “CFTC Seeks to Enjoin Arizona Criminal and Civil Enforcement Against Prediction Markets.” The filing and requested relief show an active dispute; a complaint is not a final judgment.

The practical takeaway is to distinguish what an agency or state official argues from what a court has ordered or finally decided. A lawsuit, regulator statement, proposed rule, temporary order, and final judgment have different legal significance.

How federal oversight fits in

The CFTC’s framework focuses on event contracts offered by federally regulated entities, including designated contract markets (DCMs). The CFTC’s educational material explains the DCM framework, and its March 12, 2026 staff advisory reminded DCMs of obligations under the Commodity Exchange Act and Commission regulations. If a platform says its exchange is registered, verify the claim against official CFTC materials rather than relying only on the platform’s description.

Registration is relevant, but it does not by itself settle every contested state-law question. The Commodity Exchange Act also gives the CFTC authority to prohibit certain event contracts after a public-interest determination. A Federal Register notice, “Prediction Markets; Public Interest Determinations,” 91 FR 35806 (2026), describes ordinary listing requirements, including self-certification or voluntary prior-approval routes, as well as market-monitoring and anti-manipulation obligations. The notice also recounts that the CFTC withdrew its 2024 proposed event-contract rules in February 2026 and sought information about significant issues and possible future agency action. A proposal or request for information is not a final rule.

What the state activity snapshot does—and does not—show

Pew Research Center reported on June 23, 2026, that at least 16 states had attempted to regulate prediction markets in 2026. Its snapshot reflects legislative activity through June, not a current 50-state legal directory. It also says its map does not account for executive actions and that additional bills may have been pending or failed.

In that June snapshot, Pew reported at least 12 states with related bills pending and at least four states where such bills had failed. It also discussed Kentucky and Tennessee legislation and executive orders in Maryland and New York concerning state employees’ use of prediction markets. “Attempted to regulate” does not mean that 16 states enacted bans. To determine the current status in a particular state, check the enacted statute or regulation and any relevant executive action, not just a bill headline or map.

How to check the rules for your location

  1. Pin down your location. Identify your country, state, and locality. Do not assume the rule in a neighboring state—or a nationwide platform statement—answers the question for your location. If you are outside the United States, consult sources for that country; the U.S.-focused information here does not establish its law.
  2. Name the exact platform and operator. Read the platform’s legal and market information to identify the exchange or entity offering the contract and the relevant U.S. operator. If it claims CFTC registration as a designated contract market, check official CFTC materials. Treat the claim as one part of the check, not the final answer.
  3. Identify the exact contract. Note whether it concerns sports, elections, or another event. Read the contract rules, settlement criteria, and any location restrictions. A platform-level description may not resolve a question about a specific contract category.
  4. Check state and local primary sources. Search the relevant gaming regulator and attorney general’s official notices, then check statutes and regulations for enacted text. Look for effective dates, exceptions, and whether an action concerns operators, customers, a particular contract type, or another group.
  5. Check the status of any legal challenge. Use official court opinions or docket information to see whether a case has produced an order or judgment. Distinguish a complaint seeking relief from relief actually granted, and check whether an order is temporary, limited, stayed, or final.
  6. Recheck before relying on the result. Agency actions, court orders, state legislation, and platform access policies can change. Check the relevant official sources again shortly before creating an account or trading.

How to read a result without overclaiming

  • If you find only a platform statement, you have learned its stated access policy—not necessarily the full legal status of the contract where you live.
  • If you find a bill, check whether it became law and when it took effect. A proposal, failed bill, or legislative snapshot is not the same as an operative statute.
  • If you find a regulator announcement or lawsuit, identify what the agency alleges or seeks. Do not describe the allegation as a court’s conclusion.
  • If you find a court order, read its scope and status. A ruling in one case or jurisdiction may not resolve the rules for other states, platforms, or contract categories.
  • If the official sources do not clearly answer the question for your location and contract, the result is unresolved from those sources. Consider getting advice from a lawyer familiar with that jurisdiction before acting.
