In the United States, downloading or sharing a copyrighted game ROM without the rights holder’s authorization can infringe copyright. Owning the original cartridge or disc does not automatically authorize downloading a copy from a third-party site. A narrow rule permits certain owner-made archival copies, while separate, limited exceptions cover specified preservation work and some games whose authentication servers have shut down. The source of the copy, what you do with it, the game’s license, and your location all matter. This is general information, not legal advice for a particular situation.
Is it illegal to download ROMs?
In the U.S., an unauthorized game ROM download can infringe the copyright owner’s reproduction rights. Sharing or hosting ROMs may also implicate distribution rights. A ROM is a digital copy of game software; creating one duplicates the game. WIPO’s overview of ROM enforcement explains that this can implicate copyright rights in many jurisdictions, subject to local law and the rights holder’s authorization.

The U.S. Copyright Office’s Copyright and Digital Files FAQ states that uploading or downloading copyright-protected works without the copyright owner’s authority infringes the owner’s exclusive reproduction and/or distribution rights. It also advises assuming a work is protected unless there is clear information to the contrary. Whether a particular copy is authorized depends on the facts.

What can happen if someone infringes?
The Copyright Office’s FAQ, observed in 2026, describes possible U.S. statutory damages of up to $30,000 per infringed work, or up to $150,000 per work if willful infringement is proven, as well as possible attorney’s fees. These are statutory maximums, not automatic fines or predictions of what a particular person would owe.

WIPO’s enforcement paper describes legal action against ROM websites and reports that the 2021 Storman decision found direct, contributory, and vicarious infringement connected to uploading and making Nintendo ROMs available. That example concerns distribution operations; it does not establish that every individual downloader has been adjudicated in the same way.
Is downloading a ROM legal if I own the game?
Not automatically. Owning a cartridge or disc is not, by itself, permission to download a separate copy supplied by someone else. The U.S. Copyright Office describes a limited archival-copy rule for the legal owner of a computer-program copy—not a general right to obtain a ROM from a third-party site.
Under Section 117, the Copyright Office says a legal owner, or someone the owner authorizes, may make a copy of an original computer program only for archival purposes. The archival copy must be destroyed or transferred with the original if the original is sold, given away, or otherwise transferred. The Office also advises checking the software’s sale terms or license agreement for conditions that may affect backup rights.
Can I make a backup of my game cartridge?
Section 117 may cover an owner-made archival copy of a lawfully owned computer program when its conditions are met. It does not establish that every console extraction method is lawful, nor does it authorize another person to distribute a copy. Bypassing access controls to make or use a copy can raise a separate question under the Digital Millennium Copyright Act (DMCA).
What do the DMCA exceptions allow?
Section 1201 of the DMCA generally restricts circumventing technological measures used to control access to copyrighted works, including video games. The law provides for temporary, limited exemptions through a rulemaking process; an exemption is not a blanket permission to copy or download games. The U.S. Copyright Office’s ninth triennial proceeding issued its final rule on October 28, 2024.
Local play after an authentication server shuts down
A current exemption covers specified copying or modification of certain lawfully acquired, complete games that require an external authentication server for gameplay, when the rights holder or its representative has ceased providing access. The permitted purpose is restoring local gameplay on a personal computer or console, subject to the regulation’s conditions.
The regulation defines “ceased to provide access” as either an affirmative statement that support has ended and is unavailable, or support being discontinued for at least six months without being restored. That definition does not turn every unavailable game into an authorized download.

Separate provisions allow qualifying libraries, archives, and museums to perform specified preservation activities. The rules include conditions such as a lawfully acquired collection, a public-service mission, trained staff or volunteers, reasonable digital security, and no direct or indirect commercial advantage. For the relevant game-preservation provisions, distribution outside the institution’s physical premises is restricted. Other provisions address preservation of certain complete games that are no longer reasonably available commercially and do not require an external server.
These are targeted institutional exceptions, not a general consumer right to download, share, or play any game described as “abandonware.” The operative conditions are in 37 C.F.R. § 201.40(b)(19).

An emulator and the game files it runs are separate questions. The sources discussed here address copyright and anti-circumvention rules, but do not establish a comprehensive rule covering every emulator, its implementation, or every use. The source of any firmware or system software, whether access controls are bypassed, how the ROM was obtained, and the applicable jurisdiction can all affect the analysis. An emulator does not make an unauthorized game copy lawful.
Does the answer change outside the United States?
Yes. Copyright and anti-circumvention rules vary by country, so a U.S. explanation should not be treated as a worldwide legal conclusion. WIPO provides comparative enforcement context, but country-specific conclusions require checking local law.
For a publisher-specific example, Nintendo UK’s online-piracy guidance says its authentic games can be purchased for download online through the Nintendo eShop or Nintendo website only, and calls downloads offered through peer-to-peer networks or third-party file links unauthorized copies. It also says uploading and downloading pirate copies of Nintendo games is illegal. This is Nintendo UK guidance for its relevant audience, not a statement of U.S. law or a universal rule for every publisher.
How to assess a particular ROM situation
Before copying, downloading, or sharing a game, consider the relevant facts rather than relying only on whether you own the physical game or whether it is still sold.
- Source: Is the copy supplied by the rights holder, made by you as an owner-made archival copy, or offered by a third-party ROM site or peer-to-peer network?
- Conduct: Are you making a private archival copy, downloading, uploading, hosting, or bypassing an access control? Those actions can raise different legal issues.
- User and purpose: Is this individual local play or preservation activity by an institution that meets the exemption’s conditions?
- Game and service status: Does the game require an external authentication server, and has its support ended in the manner the regulation defines? For an institutional exception, is the game reasonably available commercially under the relevant provision?
- License and location: What terms accompanied the lawful copy, and which country’s law applies?
The U.S. Copyright Office’s posted compilation of Title 17 includes enacted amendments through December 18, 2025. For an individual dispute or a question involving a particular console, license, or jurisdiction, consult a qualified lawyer.
