For a typical Indian employer that contracts with a third-party canteen provider, pays its invoice and recovers only a nominal or subsidized meal amount from employees through payroll, official ruling materials support the view that the recovery is generally not a taxable supply by the employer. This is a fact-dependent position, not a blanket rule for every canteen arrangement. The employer’s input tax credit (ITC) on the provider’s invoice is a separate question.
Why the employee deduction is not the same as the canteen provider’s charge
In a common arrangement, the canteen provider supplies food services to the employer, and the employer recovers part of the cost from employees. The GST question about the payroll deduction is whether that recovery amounts to a taxable supply by the employer; it is distinct from GST charged by the provider on its service.
An earlier GST Council appellate-index summary reports that GST was not payable on an employer’s recovery of a nominal canteen amount. A Gujarat AAR order excerpt similarly states that a subsidized deduction from employees availing food was not a supply and that the applicant was not liable to GST on the recovery. Separate the recovery question from input tax credit
Whether the employee deduction attracts GST and whether the employer can claim ITC on GST charged by the provider are separate analyses. An earlier appellate-indexed outcome reported ITC on canteen-service GST where the employer was legally obliged to provide the canteen. That does not establish a general entitlement for all workplace meal arrangements: the statutory restrictions and any applicable exception must be checked against the employer’s facts. The legal character of a transaction depends on its actual structure—not just the payroll label used for a deduction. Review the provider contract and invoices alongside employee deductions, and distinguish an employer’s purchase-and-recovery model from a direct transaction between provider and employees.

What recent Maharashtra listings do—and do not—tell employers
The GST Council index lists a Maharashtra AAR order for Mukand Limited dated 24 March 2026. The listed questions cover whether a nominal factory-canteen recovery is taxable and whether ITC is available on canteen services, but the indexed excerpt does not state the ruling’s answer. The same index lists a KSB Limited order dated 28 November 2025 concerning a third-party canteen, including questions about no recovery and partial or full recovery of the provider’s charge. Its listing confirms the questions and date, not the operative holding. The index also lists March 2025 canteen matters for Bridgestone India, Ferrero India, Lear Automotive and Spicer India. Multiple listings show that these issues continue to be considered on particular facts; they do not prove that every case reached the same conclusion. AAR outcomes arise from the applicant’s circumstances and jurisdiction. An employer should review the full applicable order and its own state’s position before treating a ruling as determinative for its arrangement.

Records to review before applying the position
- The canteen service agreement, including which party contracts with the provider and the services covered.
- Provider invoices and evidence of who pays them.
- Canteen policy and payroll records showing whether deductions are absent, nominal or subsidized, or recover some or all of the cost.
- Documents establishing whether the employer is legally required to provide the canteen, if relying on that fact in an ITC analysis.
- Accounting records that separately identify provider GST, employee recoveries and any ITC claimed.
- The relevant state ruling and the full text of any order being relied on, rather than only an index entry.
