Usually, you should not treat a consumer AI chat as confidential. A chat may be stored, reviewed for limited purposes, used to improve models depending on settings, or retained longer for safety or legal reasons. The details depend on the provider, account type, workspace, settings, and applicable law. OpenAI and Anthropic publish specific consumer-policy details; those details should not be assumed to apply to other chatbot services.
What does “confidential” mean for an AI chat?
Confidentiality is not one setting or promise. It can mean that a conversation is not visible to other users, is not kept in a provider’s systems, is not used to improve models, is not accessible to staff, or cannot be disclosed in response to a legal obligation. Those are separate questions. A chat can be absent from your history yet still be retained temporarily, or be excluded from model improvement while remaining subject to safety review.
For a useful answer, check the provider’s rules for the specific product and account you use—not just whether the interface looks private or whether you ask the chatbot to keep something secret.
How long do OpenAI and Anthropic keep consumer chats?
The following periods are policy statements, not independently measured deletion times. They apply to the named consumer services and can have exceptions.

Separate chat history from other saved material
Deleting a conversation may not remove files stored separately. OpenAI says files saved to Library can remain there after the related chat is deleted, so remove those separately if you want them gone.
Are AI chats used to train or improve models?
Storage and model improvement are different. Turning off an improvement setting does not itself delete stored chats or guarantee that no safety review can occur.

- OpenAI: For consumer services, model-improvement use depends on the user’s settings. OpenAI says ChatGPT Business, Enterprise, Edu, Healthcare workspaces and the API Platform are not used to improve models by default, although an organization may choose to share data when that option is available.
- Anthropic: For Claude Free, Pro, and Max, enabling improvement can allow new or resumed chats and coding sessions to be retained in de-identified form in training pipelines for up to five years. Anthropic says turning the setting off stops future use of previous or new chats for future training, but does not remove data from training runs already underway or undo models already trained.
These are provider-specific terms, not a general rule for every chatbot. Check the setting and policy for the account and product you actually use.

OpenAI says a limited number of authorized employees and trusted service providers may access content when needed for abuse or security investigations, customer support or troubleshooting, legal matters, or model improvement unless the user has opted out. It describes this access as controlled and need-to-know, with monitoring and logging. OpenAI also says it does not sell user data or share ChatGPT conversations with advertisers; that statement is not a guarantee that no authorized person can ever access a chat.

OpenAI’s consumer-services data guidance puts the risk plainly: “Please do not enter sensitive information that you would not want reviewed or used.”
Anthropic’s covered-model retention rules for certain organizational configurations describe a controlled access path, such as when safety systems flag content. That special arrangement is not a description of all Claude consumer chats. The cited consumer retention article does not specify comparable human-access details for Free, Pro, and Max conversations.

Can an AI company give chats to law enforcement?
Do not assume that deleting a chat prevents disclosure or that every government request is automatically granted. OpenAI’s deletion guidance allows longer retention when security or legal obligations require it, and its privacy policy lists compliance with legal obligations as a purpose for processing personal data. Those statements establish that routine deletion can have exceptions; they do not specify one universal legal standard for every request or jurisdiction.

The Anthropic materials cited here distinguish consumer and commercial retention, but do not establish a comparative legal-request standard for all Claude conversations and jurisdictions. Provider terms and applicable law govern. Requirements can vary by geography and by the legal process involved, so a general chatbot policy cannot answer what would happen in every country or case.

Do business and API chats have different protections?
They can. Consumer terms should not be treated as the terms for a managed workspace or API, and the reverse is also true. OpenAI says content in business offerings such as API data is governed by customer agreements rather than its consumer privacy policy; it also says specified business workspaces and API data are not used to improve models by default. Organizations may have options to share data when offered.
Anthropic’s zero data retention is an organization-level arrangement for eligible API endpoints and features, with exclusions—not a general incognito mode for Claude consumers. Its covered-model retention update, effective June 9, 2026, concerns designated organizational configurations using zero data retention, including certain API and cloud-provider arrangements. It says prompts and outputs for those covered models are retained for 30 days for safety work. The update does not change consumer Free, Pro, and Max plans, which already retain inputs and outputs.
If an employer, client, or regulated organization requires confidentiality, verify the exact product, contract, configuration, retention controls, and applicable rules. A business label or paid subscription alone does not establish legal privilege or satisfy a professional duty.

How to reduce the risk before you share information
- Check the product and account type. Confirm whether you are using a personal consumer account, a managed workspace, or an API integration, and review the terms for that specific service.
- Review model-improvement controls. If the provider offers a setting to limit improvement use, check its current state before entering sensitive content. Remember that this does not necessarily disable storage or safety review.
- Use temporary mode only within its stated limits. For ChatGPT, Temporary Chat does not appear in history unless saved, but a copy may be kept for up to 30 days for safety. It also does not create or update memories or contribute to model improvement while temporary. Existing memories, custom instructions, or plugins can still affect personalization, so review those controls too.
- Remove content in each place it is stored. Delete the conversation and separately stored files or project material where applicable; check the workspace’s retention policy as well.
- Keep high-risk secrets out of consumer chats unless you have verified a sound basis. This includes passwords, authentication codes, trade secrets, identifying medical records, financial account details, and another person’s sensitive information.
