Apple and the U.S. Department of Justice were in early settlement talks in July 2026, but no deal was guaranteed. Developers’ central concern is that an agreement could preserve much of Apple’s control over App Store distribution, payments and iPhone features while making only limited changes. No public term sheet establishes what Apple would have to change, how compliance would be monitored or whether developers would receive lower commissions.
What Apple and the DOJ are negotiating
The talks concern the DOJ’s civil antitrust lawsuit filed on March 21, 2024, according to Apple’s Q3 2026 Form 10-Q. The DOJ and state attorneys general allege that Apple monopolized or attempted to monopolize the “performance smartphones” and “smartphones” markets. The government is seeking equitable relief, meaning court-enforced changes to conduct rather than a damages award alone.
The Information reported in July 2026 that Apple and the DOJ had begun discussing a settlement. MacRumors reported that Apple had made several offers, but that negotiations could fail and no trial had been scheduled. Those reports do not provide a final agreement, proposed compliance timetable or binding list of remedies.

Why developers fear a limited remedy
The reported developer objection is not simply whether Apple changes a rule; it is whether the change materially reduces Apple’s leverage. The Information said developers were concerned that a settlement might formalize changes Apple has already made without opening distribution, payment processing or access to iPhone capabilities to meaningful competition. PayPal and Epic Games were among the developers reported to have discussed concerns with the DOJ.
For developers, the unresolved questions include whether Apple would have to offer objective access to protected iPhone functions, stop favoring its own services in rankings or messaging, and permit alternatives to App Store-controlled payment flows. A promise stated in broad terms would be less useful than a rule defining covered services, deadlines, technical standards and penalties for noncompliance.

The App Store payment issue is tied to a separate Epic case
The DOJ lawsuit and the Epic litigation are separate proceedings. Apple’s SEC filing says the Epic case produced a 2025 injunction that barred Apple from imposing commissions or fees on certain purchases made outside an app and from restricting how developers direct users to those purchases.
On December 11, 2025, the Ninth Circuit allowed Apple to charge some commission on purchases reached through those links and sent the matter back for modification. Apple petitioned the Supreme Court, which granted review on June 30, 2026. That review can affect the rules for external purchase links independently of any DOJ settlement.

Consequently, developers should not assume that a DOJ agreement would automatically eliminate commissions on every outside-App-Store transaction. The eventual U.S. framework could depend on both the settlement’s wording and the Supreme Court’s treatment of the Epic injunction.
What the UK approach demonstrates
The UK Competition and Markets Authority offers a concrete comparison, although it is not a template that the U.S. must adopt. On February 10, 2026, the CMA announced commitments from Apple and Google covering fair, objective and transparent app review and ranking; protection of developer data collected during review; and a clearer process for requesting iOS interoperability. The CMA said it would monitor implementation and could impose formal conduct requirements if the commitments failed.

The CMA says Apple and Google platforms account for around 90–100% of mobile devices in the UK. It estimates that the mobile ecosystem represents 1.5% of UK GDP and supports around 400,000 UK jobs. Those figures explain why the regulator treated review practices, ranking and interoperability as economy-wide issues rather than only contractual disputes between a platform and individual developers.
Sarah Cardell, the CMA’s chief executive, said: “Following designation of Apple and Google’s mobile platforms in October last year, the CMA has moved swiftly to secure a package of commitments from Apple and Google that will boost the UK’s app economy, giving developers the opportunity and confidence they need to invest and innovate.”

What developers should watch next
A meaningful settlement will become easier to evaluate when Apple or the DOJ publishes enforceable terms. Developers should look for:
- Definitions: which apps, services and iPhone capabilities are covered, including super apps, cloud gaming, wallets, smartwatches and messaging.
- Objective access rules: whether Apple must publish technical criteria, response deadlines and reasons for refusals.
- Payment language: whether the deal changes commissions, permits external links without steering restrictions, or leaves those questions to the Epic Supreme Court review.
- Anti-discrimination protections: whether Apple’s own apps must follow the same review, ranking and access standards as competitors.
- Oversight: who receives complaints, what reports Apple must file, how violations are investigated and what penalties or corrective steps apply.
- Duration and review: whether obligations expire, can be modified, or remain in force through a court-supervised process.
Until those details are public, developers cannot reliably calculate lower fees, guaranteed access to iPhone features or permission to route customers around Apple’s payment system. The July 2026 talks are therefore a potential turning point, not a settled change to the App Store.
