Amherst’s Town Council reportedly approved a 200-foot solar-related no-disturbance area and a 400-foot distance for battery energy storage systems (BESS) from private wells. The council vote was on September 14, 2026; the figures and vote details come from Amherst Indy’s meeting report, not verified final town code.
What distances did Amherst approve?
Amherst Indy reported that the Town Council adopted Article 18, the Small Clean Energy Infrastructure Bylaw, with two amendments at its September 14, 2026 meeting. The vote was unanimous, with one council member absent. Councilor Lynn Griesemer proposed the well-protection changes.

The two numbers regulate different things: one is a solar-related no-disturbance area; the other is a BESS distance requirement. They should not be treated as interchangeable setbacks or as rules applying to all public water sources.

Why did councilors debate the changes?
Supporters argued for stronger protection of private wells, citing concerns about land disturbance, tree removal, erosion, and possible contamination. These were arguments raised in the local debate, not scientific findings established by the meeting report.

Opponents warned that larger distances could leave less usable land, increase sustainable-energy costs, or make some projects economically infeasible. Amherst Indy quoted Planning Board Chair Doug Marshall as saying, “I fear that it would, at best, increase local sustainable energy costs, and at worst, render many potential installations economically infeasible.” The statement describes his position in the council debate, not a measured outcome.
The reported rationale for the BESS amendment was to match the 400-foot distance from private wells to the distance required from public water supplies. The sources here do not establish a scientific conclusion that either amended distance is necessary or sufficient to prevent contamination.

How many Amherst homes rely on private wells?
Amherst Indy estimated that private wells serve about 5% of homes in town and reported that nearly all are in Amherst’s northeast section. Meeting participants disagreed about the precise number of households, so the percentage is a reported estimate rather than an official well count.
Is the final bylaw text available?
The final codified text and effective date have not been verified. The town-hosted document available for review is explicitly a September 25, 2025 draft, not the adopted 2026 bylaw. That draft contains a 100-foot private-well no-disturbance provision and allows the permit-granting authority to require a larger distance based on site conditions.
