The Allahabad High Court reportedly set aside a ₹18,15,902 penalty under Section 129(3) of the GST law after the authority failed to consider an appearance and documents from a person claiming ownership of detained goods. The court directed the authority to reconsider the matter under the law, including serial 6 of CBIC Circular No. 76/50/2018-GST. It did not, according to the case reports, finally decide that the claimant was the owner.
What happened in the GST detention case?
The case is reported as Rambabu and Another v State of U.P. Through Principal Secretary, Department of State Tax, Lucknow and Another, Writ Tax No. 1114 of 2026, before the Allahabad High Court. Taxscan reports that the judgment was delivered on 3 September 2026 by Justice Abdhesh Kumar Chaudhary and Justice Shekhar B. Saraf.
According to JurisHour, a vehicle carrying 14,130 kg of old battery scrap was detained on 14 August 2026. The goods were reportedly covered by a tax invoice dated 11 August and an e-way bill. The authority issued a detention order and notice on 14 August, then imposed a penalty of ₹18,15,902 in an order dated 20 August 2026.

Petitioner No. 2 reportedly appeared before the authority, claimed ownership of the goods and produced an e-way bill, e-tax invoice and bilty. The reports say the authority imposed the penalty without considering his appearance and those documents.
#1 Best Overall
- Two-Part Carbonless Invoice Book: Each invoice book has 50 sets of invoices, each with a white/light yellow section, with the yellow section retained in the invoice book to maintain detailed records.
- Consecutively Numbered: Enlarged red 6-digit numbers in the upper right corner of each invoice receipt book help you quickly navigate through your orders.
- Wraparound Divider Flap: A thick folded cardboard divider is integrated into the back of each invoice book for use between each two-part sales order to prevent the written content from rubbing off on subsequent copies of the invoice, resulting in wasted invoices.
- 2 Packs/50 Sets (100 Sets Total): Each invoice book provides 50 sequentially numbered carbonless sets of 2 invoice books for long-term use.
- Customizable Space: Each invoice book for small business has space at the top to add a company seal or sticker.
What did the High Court reportedly decide?
Taxscan reproduces the court as saying: “we are of the view that since the owner has appeared and produced the e-way bill, e-tax invoice and bilty, the same ought to be considered by the authority in accordance with law.”
The reported outcome was to quash and set aside the penalty order and direct the authority to consider the documents produced by petitioner No. 2 and decide the matter in accordance with law, with reference to serial 6 of CBIC Circular No. 76/50/2018-GST. The reports describe a direction for reconsideration, not a final finding that petitioner No. 2 owned the goods or that no penalty could ultimately be imposed.

How does the CBIC circular address ownership?
CBIC Circular No. 76/50/2018-GST, issued on 31 December 2018, addresses who should be treated as the owner of goods for Section 129(1) of the CGST Act. Serial 6 clarifies that when an invoice or another specified document accompanies the consignment, either the consignor or consignee should be deemed the owner. If no such document accompanies the goods, the proper officer should determine who should be declared the owner.
That guidance explains why the documents mattered in the reported case. The circular does not, by itself, establish that a particular claimant owns goods; the High Court reportedly left that claim for the authority to reconsider in light of the documents and the law.

What the ruling does—and does not—establish
- It establishes, as reported, a duty to consider relevant evidence. The authority was directed to consider the claimant’s appearance and the e-way bill, e-tax invoice and bilty before deciding the matter.
- It does not create automatic immunity from Section 129 penalties. The reports describe a fact-specific order and do not establish that a penalty fails whenever documents are produced after detention.
- It does not conclusively resolve ownership. JurisHour says the court sent the claimant’s ownership issue back for reconsideration rather than finally declaring him the owner.
Why the account should be read with care
The case outcome and quoted sentence are reported by Taxscan and JurisHour. The full High Court order was not located in the court’s official repository, so the reports do not establish all of the judgment’s reasoning or any additional operative conditions. Anyone relying on the decision for a live GST dispute should verify the official order and consider the facts of that case before treating the reports as authority for a broader proposition.
