Justice Samuel Alito said the Supreme Court justices who formed the majority in Dobbs v. Jackson Women’s Health Organization showed courage in overturning Roe v. Wade. His remarks appeared in a preview of a CBS News interview reported on October 2, 2026; they are Alito’s characterization of the decision, not an objective finding about judicial courage.

What Alito said about courage and Dobbs

In the CBS News interview preview, Alito identified Dobbs as the leading example of a case requiring courage from the justices in the majority. He said the justices did not know the implications when they produced the draft opinion that was later leaked. The previewed remarks were reported by AOL/The Hill and Mediaite on October 2, 2026.

Alito also said he had lost friends over the decision. Discussing threats and harassment directed at justices, he said: “The physical threats and the harassment represent something new in our society and something that’s quite disturbing, and I think it’s a danger.” The accounts establish what Alito said in the preview; they do not independently verify particular threats, identify people involved, or quantify harassment.

What the Supreme Court decided in Dobbs

The Supreme Court issued Dobbs on June 24, 2022. Alito wrote the majority opinion. The Court overruled Roe v. Wade and Planned Parenthood v. Casey, ending the federal constitutional protection those precedents had recognized for abortion access. The majority concluded that authority to regulate abortion was returned to the people and their elected representatives. The official decision is available from the Supreme Court.

What the interview preview does—and does not—show

The available accounts quote remarks from a CBS News interview with chief legal correspondent Jan Crawford, but they report a preview rather than provide a full transcript. Alito’s comments therefore show how he described the majority’s experience and the personal costs he associated with the ruling; they should not be treated as a complete account of his reasoning or the full interview’s context.

Calling the decision courageous is Alito’s assessment. Readers may agree or disagree with that judgment, but it is distinct from the legal holding: Dobbs changed the constitutional framework for abortion regulation and left policy authority, as the majority framed it, to elected representatives and the people.
