Voluntary AI principles can improve how companies identify and manage risks, but they cannot by themselves guarantee compliance or impose public penalties. Credible oversight requires evidence outsiders can check—and, where failures breach legal duties, institutions with authority to require remedies or impose sanctions. That is a case for limits on self-regulation, not proof that every AI company is untrustworthy.
What self-regulation can—and cannot—do
A voluntary framework sets expectations that a company may choose to adopt. It can give teams a shared way to discuss risk, make internal practices more systematic, and encourage transparency. But participation alone does not establish that a company followed the framework, that anyone independent verified its claims, or that a public authority can penalize a failure.
The distinction is visible in two widely used sources of guidance. The Organisation for Economic Co-operation and Development’s AI Principles, adopted in 2019 and updated in 2024, call for accountability, traceability, and continuing risk management across an AI system’s lifecycle. The OECD says AI actors should be accountable “based on their roles, the context, and consistent with the state of the art.” These principles inform policy and practice; they are not a regulator or binding law. The US National Institute of Standards and Technology says its AI Risk Management Framework is intended for voluntary use. It helps organizations incorporate trustworthiness considerations into the design, development, use, and evaluation of AI. NIST released AI RMF 1.0 on January 26, 2023, and published a generative AI profile on July 26, 2024. What the evidence on company commitments shows
A 2025 preprint by Jennifer Wang, Kayla Huang, Kevin Klyman, and Rishi Bommasani assessed companies’ publicly disclosed behavior against eight voluntary commitments made to the White House in 2023. Using the authors’ rubric, the companies averaged 52% overall. For the model-weight security commitment, the average was 17%, and 11 of the 16 companies assessed received a zero on that part of the rubric. The authors’ preprint
Those numbers are a warning about the limits of promises that are difficult to verify, not an official government compliance finding or a direct measurement of hidden practices. The assessment concerns what the authors could establish from public disclosures. A low score may reflect missing disclosure as well as missing action; it does not prove that an undisclosed safeguard did not exist, nor does it establish that every AI company performs poorly. The authors argue that future initiatives should define commitments clearly and require proactive, verifiable disclosure.

How the EU pairs voluntary guidance with enforceable duties
The European Union offers a useful example of the difference between a voluntary code and a legal obligation. The EU AI Act is a regulation that establishes duties and enforcement provisions. Article 95 also calls for the AI Office and Member States to encourage and facilitate codes of conduct for voluntary application of certain requirements in specified contexts. It has chapters on Transparency, Copyright, and Safety and Security. The first two address all general-purpose AI model providers; the Safety and Security chapter concerns providers of models with systemic risk. Dates and scope matter
The Commission says general-purpose AI provider obligations apply from August 2, 2025. Models placed on the market before that date must comply by August 2, 2027. It states that full enforcement of provider obligations with fines begins August 2, 2026; this is the Commission’s stated start date, not a claim that every obligation applies identically to every provider or model. The Commission also describes a collaborative first year for providers adhering to the code. That transition support does not turn the code into law or remove the underlying binding duties. The Commission identifies the AI Office and national market surveillance authorities as responsible for implementing, supervising, and enforcing the AI Act. The institutions can cooperate on incidents that may implicate rights such as privacy and non-discrimination. The Commission has said third-party evaluation capacity in the EU is expected to become operational by 2027; that is a stated plan, not evidence that such capacity is already operational. How to judge whether an AI commitment is meaningful
Instead of asking only whether a company has signed a pledge, examine what would make the promise testable and consequential:
- Legal force: Is it optional guidance, a contractual commitment, or a binding legal duty?
- Verification: Is the company assessing itself, publishing evidence outsiders can examine, or subject to review by an independent body or public authority?
- Transparency: Does it disclose methods, limitations, incidents, and remediation in enough detail to check its claims?
- Scope: Which models, uses, lifecycle stages, downstream providers, and supply-chain actors are covered?
- Consequences: Can a failure lead to correction, restriction, withdrawal, liability, or a penalty—and who can require it?
- Adaptability and legitimacy: Can the rules keep pace with technical change while incorporating independent expertise and the perspectives of affected communities?
These questions also clarify why disclosure matters without making it a substitute for performance. A company can publish a detailed account of its controls and still fail to manage risk; without disclosure, outsiders may be unable to assess whether the controls exist or work. The strongest arrangements connect specific duties to checkable evidence, incident reporting, and a route to remedy when a duty is breached.

Why external oversight is necessary, not sufficient
Rules and enforcement can create obligations beyond what a company chooses to promise, but they do not guarantee safe outcomes. Effective oversight still depends on clear duties, capable institutions, access to relevant evidence, and remedies proportionate to the failure. The EU example illustrates a governance structure that combines optional implementation guidance with binding obligations and named enforcement authorities; it does not, by itself, establish how effective enforcement will be in every case.
Voluntary frameworks are most useful as tools for organizing risk management and making practice more legible. They become more credible when commitments are specific, progress can be independently checked, and failure has consequences outside the company. Self-regulation can contribute to responsible AI governance, but it cannot stand in for enforceable public accountability.
