HR should investigate the specific conduct, protect company and client information, clarify the rules, and take proportionate action only if the facts establish a policy breach or other legitimate concern. Using AI for a second job is not, by itself, proof of misconduct. The key questions are whether the employee used paid work time or company resources, exposed confidential information, created a conflict, affected performance, or failed to meet a disclosure obligation.
What counts as AI-enabled moonlighting?
“Moonlighting” generally means taking on work outside a person’s primary job. AI tools can make that work easier to produce or conceal, but they do not change the basic HR questions: what work was done, when and with which resources, what information was used, and whether the outside work conflicts with the employee’s obligations.
Keep three situations distinct. An employee may use an AI tool for an approved task in their primary job; use AI privately for a personal project; or use it to perform paid work for another party. The first may be governed by workplace AI rules, the second by ordinary acceptable-use and privacy rules, and the third may also raise outside-employment, conflict-of-interest, confidentiality, or performance issues. They should not be treated as interchangeable.

Why should HR clarify rules now?
Workplace AI use and formal guidance are not moving at the same pace. Gallup reported that the share of U.S. employees who used AI at work at least a few times a year increased from 40% in Q2 2025 to 45% in Q3 2025. A 2026 PagerDuty survey found that 66% of surveyed office professionals had used unauthorized AI tools at work; among respondents who used potentially unauthorized tools, 53% said they received informal feedback or guidance to stop and 48% reported formal consequences. Those consequence figures are not stated to be mutually exclusive, and the survey is not a universal estimate of workers.
In the UK, the Department for Science, Innovation and Technology’s 2025–2026 Business Data Survey found that among businesses using AI, 17% had policy or guidance: 5% had a formal written policy and 12% informal guidance. These findings describe different populations and questions; they should not be read as a single trend or as evidence that a particular employee has violated a rule.

What should HR establish before deciding?
Start with the allegation and the applicable obligation, not the presence of AI. Identify what evidence supports the concern and what remains uncertain. The following questions help keep the review focused:
- Time: Was outside work performed during paid hours, or did it interfere with assigned duties, availability, or agreed working hours?
- Resources: Were company devices, accounts, paid subscriptions, networks, or other employer resources used, and what do the applicable rules say about that use?
- Information: Was confidential, personal, client, proprietary, or regulated information entered into an unapproved AI service or otherwise disclosed?
- Work product: Did the employee reuse employer materials, code, prompts, data, or other work product in outside work?
- Conflict: Does the outside role compete with the employer, conflict with the employee’s duties, or create another interest that must be disclosed?
- Performance and disclosure: Is there a documented impact on work, or a clear disclosure requirement the employee did not follow?
- Notice and fairness: Was the relevant rule written or communicated, and has it been applied consistently to comparable employees?
Do not infer paid-time use, data exposure, or a conflict from an AI detector, a productivity score, or the fact that an employee has outside work. Separate a performance issue from a disclosure or conflict issue so each is assessed under the right standard.

How should HR investigate and respond?
- Define the concern. Record the specific suspected conduct, the relevant dates, and the policy or obligation that may apply. Avoid broad searches for “AI use” where the issue can be stated more narrowly.
- Preserve relevant evidence. Use established HR and security processes to retain records that are genuinely relevant, such as access events or work records. Limit collection to the purpose of the investigation and follow applicable retention, access, and privacy rules.
- Explain the allegation. Tell the employee what conduct is being reviewed and which rule may apply. Give them a reasonable opportunity to explain the activity, tools, timing, and any use of employer information or equipment.
- Verify rather than assume. Check the source, context, and reliability of logs, monitoring flags, or AI-generated analysis. Consider alternative explanations and information that does not support the allegation.
- Apply consistent standards. Compare the conduct with how similar cases and roles have been handled, taking account of differences in duties, access, policy notice, and evidence.
- Choose a proportionate response. Depending on what is established, the response may be clarification or training, a direction to stop a particular use, security remediation, or discipline under an applicable policy. Do not escalate solely because AI was involved.
Before imposing discipline, consider jurisdiction, contract terms, role duties, intellectual-property and confidentiality obligations, union agreements, and any applicable rules on outside employment and privacy. These factors vary; this article does not establish a universal right to prohibit moonlighting or a universal basis for discipline. Seek jurisdiction-specific employment and privacy advice for a consequential case.
How can HR protect information without over-monitoring?
If there is a credible risk that sensitive information has been exposed, use established security procedures to contain or remediate access. Tell employees which AI tools are approved for work and what information must not be entered into unapproved services. Provide a workable approved route for legitimate tasks, rather than leaving employees to guess which tools or data practices are acceptable.

Monitoring should answer a defined question and use the least intrusive effective method. Under UK Information Commissioner’s Office guidance, employers should identify a clear purpose and lawful basis, minimize collection, explain what is monitored and why, and take particular care with homeworking, where monitoring can capture family or private activity. A notice to employees does not by itself make excessive monitoring lawful. The ICO says this guidance is under review following the Data (Use and Access) Act, so UK employers should check current guidance and obtain advice for their circumstances.

AI-generated monitoring scores, prompt-log analysis, or performance recommendations should not make consequential employment decisions on their own. The ICO’s guidance calls for meaningful human involvement: a reviewer should check and interpret the recommendation, consider other relevant information, and have the competence and authority to depart from it.

What should an AI and outside-work policy cover?
Make the rules specific enough for employees and managers to follow. Explain:
- Which AI tools are approved for work, and how employees can request approval for another tool.
- What personal, client, confidential, proprietary, or regulated information may not be entered into an AI service, and how to report a suspected disclosure.
- When AI-generated work must be checked, attributed, or disclosed, and who is responsible for its accuracy and use.
- What the organization means by outside work, conflicts of interest, use of paid time, use of company resources, and relevant disclosure requirements.
- How employees can ask questions or disclose outside work confidentially, and how managers should route a concern to HR or security.
- What monitoring occurs, its purpose, what information is collected, who can access it, and how it may be used.
Train managers not to treat AI use as automatic evidence of dishonesty or poor performance. NIST’s AI Risk Management Framework and Generative AI Profile are voluntary resources for organizational risk management, not employment law; they can help structure broader governance but do not answer whether a particular employee’s side work is permitted.
Can employees use AI for a second job?
There is no single answer that applies across countries, contracts, roles, and workplaces. The relevant question is whether the outside work violates a valid obligation or creates a demonstrable problem—for example, misuse of confidential information, a conflict, use of paid time contrary to policy, or failure to meet a clear disclosure requirement. Review the applicable agreement and local law before treating the work itself as prohibited.

Should employees disclose AI side work?
Employees should follow the employer’s stated disclosure rules. If the policy is unclear, HR should explain what kinds of outside work need disclosure, how to disclose them, and how the information will be used. A disclosure rule should focus on relevant conflicts and obligations rather than treating every personal AI project as a workplace matter.
How should HR handle employees using AI at work?
Distinguish approved work use from unauthorized tool use and from paid outside work. Address data and security exposure through established controls, clarify which tools are permitted, and investigate any suspected policy breach with verified evidence and a chance for the employee to respond. Use a human decision-maker for consequential outcomes.
