AI model theft can mean stealing a model’s files or parameters, or copying its behavior by querying it and building a substitute. The term is a technical umbrella, not a legal verdict: what happened, whether access was authorized, and which law applies all matter.

What does AI model theft mean?

FS-ISAC’s 2024 Adversarial AI Framework defines model theft as “the unauthorized access, copying, or exfiltration of proprietary GenAI models.” That is an industry framework’s definition, not statutory language. In practice, the phrase can refer to direct access to model files or to attempts to reproduce a model’s capabilities through its outputs.

A model’s weights are learned numerical parameters that help determine its outputs. But weights are not the whole model: architecture, training procedures, training data, and other elements also affect performance. The National Telecommunications and Information Administration (NTIA) explains the role of weights and the broader factors that contribute to a model’s behavior in its report on open-weight dual-use foundation models.

What can be taken or copied?

Term What is targeted What it means in practice
Weight or parameter theft Trained parameters, weights, or related model files The actor obtains model internals or a direct copy.
Model extraction A model’s behavior, commonly through queries The actor uses responses to construct or train a substitute; the original weights may not be recovered.
Training-data theft Data used to train a model It may expose sensitive or valuable material and support model development, but it is not the same as taking the trained model.
Reconnaissance or inference Information such as architecture, hyperparameters, training data, outputs, or relationships It may be a precursor to an attack or a separate security concern; information gathering alone does not prove a complete model was stolen.

A foundational paper on prediction APIs describes black-box extraction as duplicating a target’s functionality without prior knowledge of its parameters or training data. That is why reports may call behavior-copying “model theft” even if no one obtained the original model file. NIST’s adversarial machine learning taxonomy offers a broader way to describe an incident by its lifecycle stage, objective, and attacker capability.

Is model distillation theft?

Not automatically. Distillation is a technique that can be used in legitimate AI research, but it can also be used to extract restricted proprietary capabilities. In a September 8, 2026 release, the National Security Agency characterized certain China-based companies’ use of distillation against U.S. models as a way to reproduce capabilities without comparable research and development investment. That is the agency’s characterization of alleged activity, not a general legal rule or a court finding.

To assess a particular use, look at which model was queried, whether the access was permitted, what restrictions applied, and whether the activity crossed those boundaries. The technique’s name by itself does not establish authorization or unlawfulness.

Is downloading open model weights illegal?

Public availability alone does not establish theft. NTIA describes “widely available” weights as downloadable by the public in its 2024 report. Whether a particular download or use is permitted depends on the model’s license and terms, its provenance, and applicable rights. Publicly downloadable weights and secretly copied restricted weights therefore call for different analyses.

When does “model theft” have a legal meaning?

The phrase does not decide whether a crime or civil wrong occurred. In the United States, DOJ guidance on the federal trade-secret provisions explains that copying can count as theft even when the original remains with its owner: “Through copying, information can be stolen without asportation, and the original object remains intact.” The guidance also describes authorization in terms of the owner’s permission, approval, consent, or sanction. Whether the information qualifies as a trade secret and whether conduct violates a particular law depend on the facts and legal theory. See the DOJ Criminal Resource Manual discussion of 18 U.S.C. § 1831.

Copyright questions are related but not interchangeable with model theft. The U.S. Copyright Office’s AI study addresses issues including the copyrightability of AI-generated works and the use of copyrighted material in training, while identifying unresolved questions. Those issues do not create one universal definition of AI model theft. The legal analysis also depends on jurisdiction; a U.S. trade-secret explanation should not be treated as a global rule.

How to describe a specific allegation accurately

Instead of relying on the broad label alone, identify the conduct and the evidence supporting it:

  • What was targeted? Specify weights or files, model behavior, training data, or metadata.
  • How was access obtained? Distinguish file access or privileged access from queries to an API.
  • Was access authorized? Identify the relevant permissions, license, or service restrictions.
  • What was produced? Distinguish an exact copy from an approximate substitute that reproduces some functionality.
  • What legal claim is being made? Name the jurisdiction and legal theory, and attribute allegations to the organization making them unless they have been adjudicated.

No topic-specific prevalence rate or total financial-loss figure is established by the cited material. A general cybercrime or intellectual-property statistic should not be presented as an AI-model-theft statistic.
