Some AI-generated or altered sexual depictions involving minors can fall within U.S. federal criminal laws, even when no real child appears in the image. But there is no single rule that makes every synthetic depiction illegal. The answer depends on the statute’s definition of the image, the conduct involved, and other required elements. This article covers federal law as of October 4, 2026; state and non-U.S. laws may differ.
What “AI-generated CSAM” means under federal law
“Child sexual abuse material” (CSAM) is a widely used term for sexual material involving children. Title 18 of the U.S. Code uses the statutory term “child pornography.” For AI-generated or altered material, two federal provisions are especially important: 18 U.S.C. § 2256 defines categories of qualifying depictions, while 18 U.S.C. § 1466A addresses specified obscene or graphic depictions, including some involving fictional minors.
These provisions are related but not interchangeable. A depiction’s appearance alone does not answer whether a crime occurred: prosecutors must establish the elements of a particular offense, including the relevant conduct and any applicable jurisdictional requirements.

When computer-generated or altered images fall under 18 U.S.C. § 2256
Section 2256’s definition includes more than images made during actual abuse. It covers a visual depiction of sexually explicit conduct when production involved a minor, when a computer-generated image is indistinguishable from an image of a minor engaging in that conduct, or when an image was created, adapted, or modified to make it appear that an identifiable minor is engaged in it.

“Indistinguishable” has a specific statutory meaning
The question is whether an ordinary viewer would conclude that the image is of an actual minor engaging in the conduct. Section 2256 expressly excludes drawings, cartoons, sculptures, and paintings from this particular definition. That exclusion does not establish how every other federal provision applies to fictional depictions; § 1466A has separate terms.
An identifiable minor need not be named
For the altered-image category, an identifiable minor is one recognizable as an actual person through a face, likeness, or another distinguishing characteristic. The statute says the government need not prove the person’s actual identity. The legal question is whether the image appears to depict an identifiable minor in the specified conduct, not whether the viewer knows the child’s name.
How 18 U.S.C. § 1466A can apply when no real child exists
Section 1466A establishes separate routes for certain depictions. One concerns an obscene depiction of a minor engaging in sexually explicit conduct. Another concerns a depiction that is, or appears to be, of a minor engaged in particular graphic conduct and that lacks serious literary, artistic, political, or scientific value. The statute also addresses knowing possession within its terms and circumstances.

For offenses within § 1466A, the government is not required to prove that the depicted minor actually exists. That does not make every synthetic image criminal: the specified depiction, conduct, obscenity or applicable graphic-conduct/value test, offense conduct, and jurisdictional circumstances still matter. The section refers to penalties in § 2252A, but the applicable consequences depend on the precise offense and current penalty provisions.
How the main federal routes differ
| Question | 18 U.S.C. § 2256 definition | 18 U.S.C. § 1466A | TAKE IT DOWN Act platform process |
|---|---|---|---|
| What material is addressed? | Specified depictions involving an actual minor, an indistinguishable computer-generated image, or an altered image appearing to show an identifiable minor. | Specified obscene depictions or depictions meeting the separately stated graphic-conduct/value test; the depicted minor need not actually exist. | Qualifying nonconsensual intimate visual depictions and digital forgeries, within the Act’s scope. |
| What is the legal issue? | A statutory definition used in federal child-pornography offenses; liability depends on the charged offense and conduct. | Criminal prohibitions with distinct depiction, conduct, and jurisdictional elements. | A covered platform’s notice-and-removal duty after a valid request, not a general definition of criminal CSAM. |
| Does the law cover every fictional or AI-made image? | No. The definition has specific categories, and its “indistinguishable” category excludes drawings, cartoons, sculptures, and paintings. | No. The specified categories and tests must be met. | No. The removal duty applies to covered platforms and qualifying depictions under the Act. |
What the TAKE IT DOWN Act does—and does not do
The TAKE IT DOWN Act addresses certain nonconsensual intimate visual depictions and digital forgeries. Its criminal provisions and the federal CSAM statutes are separate legal routes; the Act should not be treated as a replacement for the elements of §§ 2256 or 1466A.
Separately, 47 U.S.C. § 223a requires covered platforms to establish a notice-and-removal process within one year after May 19, 2025. After receiving a valid removal request, a covered platform must remove the depiction as soon as possible and no later than 48 hours, and make reasonable efforts to identify and remove known identical copies. This is a duty for covered platforms with a defined scope, not a guarantee that every online service is covered or that every reported image qualifies.

If an intimate image or deepfake is posted without consent
Use the platform’s reporting process for nonconsensual intimate imagery and provide the information its valid-request process requires. The Act’s 48-hour deadline applies after a covered platform receives a valid request; it is not a general deadline triggered by any message or report. For advice about a particular image, platform, or legal risk, consult a qualified lawyer or appropriate authorities.
What federal enforcement examples show
DOJ announcements illustrate enforcement, but a case outcome does not decide how every possible AI-generated image is treated.
- February 6, 2026 conviction: DOJ reported a federal jury conviction for receipt and possession involving both actual CSAM and AI-generated depictions. The release also described the court’s denial of a First Amendment challenge to the obscene generative-AI material in that case. That is a case-specific trial-court ruling about the material and charges before that court, not a universal resolution of First Amendment questions. DOJ reported that sentencing had not yet been set at the time of the release.
- April 7, 2026 guilty plea: DOJ’s Southern District of Ohio reported a plea that included production of obscene visual representations of child sexual abuse and publication of digital forgeries under the TAKE IT DOWN Act. A plea resolves that case; it does not establish the full reach of either statute for other facts.
- Indictment reported in 2025: DOJ described charges involving production, distribution, and possession of obscene depictions involving AI-generated images. An indictment is an accusation, not proof of guilt; the defendant is presumed innocent unless proved guilty.
In a May 2024 announcement, Deputy Attorney General Lisa Monaco said, “Put simply, CSAM generated by AI is still CSAM.” That statement conveys DOJ’s enforcement position, but it is not a substitute for applying the statutes’ definitions and elements to a particular image and alleged conduct.

Why a simple yes-or-no answer can mislead
Whether a federal offense may apply turns on more than whether software generated an image. Relevant distinctions include whether the depiction involves an actual or identifiable minor, meets the statutory indistinguishability definition, or falls into a category under § 1466A; whether the alleged conduct is production, distribution, receipt, possession, or publication; and whether the applicable statutory and jurisdictional conditions are met. A platform’s separate removal duty asks a different question from criminal liability.
