ATF has proposed allowing federally licensed firearms dealers to complete certain remote sales to unlicensed buyers who live in the same state, while retaining applicable background checks. The proposal is not a blanket authorization for interstate sales or unregulated home delivery. A report published October 2, 2026, says Donald Trump Jr. is a GrabAGun shareholder and board member, making the proposal’s potential business effects a legitimate subject for scrutiny—but the available material does not establish that he influenced the rule or that he will profit from it.
What the proposed ATF rule would change
The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) proposed changing how federally licensed firearms dealers, or FFLs, may complete certain non-over-the-counter (NOTC) transfers. These are sales in which the buyer does not appear in person at the dealer’s business premises. The proposal would remove restrictions that currently limit NOTC sales to transfers exempt from background checks, and allow qualifying sales to proceed with applicable checks and other safeguards.
ATF’s proposed-rule summary states: “Federal law permits federal firearms licensees (“FFLs”) to transfer firearms to a person residing in the same state but who does not appear in person.” The proposal is about conditions for completing those transfers; it does not eliminate the distinction between a licensed dealer and an unlicensed buyer.

Would online gun sales still require a background check?
The proposal would not abolish background checks. It would make a qualifying remote transaction possible even when the transfer is subject to an applicable check. That is the central regulatory change: the buyer’s absence from the dealer’s premises would no longer, by itself, confine a NOTC transfer to an exemption from background-check requirements.

“Remote” describes the buyer’s absence from the dealer’s premises during the transaction; it does not mean the buyer avoids the dealer or the proposed verification steps. The materials describe remote identity proofing and electronic law-enforcement notices, but do not specify every operational detail a dealer would use in a particular sale. They also do not establish that every online order would qualify.
Can guns be shipped directly to your home?
Not on the basis of this proposal alone. The stated scope is a qualifying transfer by an FFL to an unlicensed buyer residing in the same state as that dealer. It should not be read as permission for any seller to ship any firearm across state lines to a buyer’s home, or as a general exemption from federal or state requirements. The materials summarized here do not set out a universal delivery method or promise doorstep delivery for all eligible transactions.

What is the proposal’s status and timeline?
ATF’s notice is a proposed rule, not a final rule. The agency lists May 8, 2026, as the release and comment-start date and August 6, 2026, as the comment-end date. Those dates mark the proposed rulemaking’s stated comment period; they do not mean the proposal automatically took effect when comments closed.

The notice is identified as RIN 1140-AB05 and Docket ATF-2026-0266. ATF’s proposed-rule analysis counts 45,605 active Type 01 dealer FFLs as of December 23, 2025. That is an agency figure about the number of active dealer licenses, not a count of retailers that would adopt the proposed process.

Why the Trump Jr. connection is drawing attention
An October 2, 2026, report says Donald Trump Jr. is a shareholder and board member of GrabAGun, an online firearms retailer. The report also says GrabAGun launched PEW Logistics in January 2026 to offer manufacturers white-label direct-to-consumer fulfillment, and that the company presented itself as positioned to benefit from possible expansion of remote transactions. Those are reported corporate ties and business positioning—not proof of a gain from this specific proposal.
The chronology makes the connection a reasonable accountability question: the reported logistics business predates the May 2026 proposal. But the available material does not show that Trump Jr. had advance knowledge, influenced ATF’s work, or would receive a particular financial benefit if the proposal were finalized. A shareholder or board role alone does not establish any of those claims.

The same October 2 report says senators questioned whether Trump Jr.’s business interests affected the proposal; his spokesperson denied his involvement; and ATF Director Robert Cekada said the agency had no engagement with a retailer in developing the rule. These are reported statements and competing claims, not findings that misconduct occurred. The proposed rule and the reporting do not, on their own, resolve whether anyone outside ATF influenced the agency’s decision-making.
What ATF says about costs and market effects
ATF estimates the proposal would produce $236 million in annual deregulatory savings and $2.36 billion over ten years. These are the agency’s projections, not observed savings or guaranteed benefits to consumers, dealers, or any named company.

ATF also says the ultimate market effects are unknown. Its analysis recognizes that larger retailers could compete for customers of smaller regional and community-based dealers, while describing participation as voluntary for FFLs. That means a projected reduction in regulatory costs does not establish who would capture the savings or how remote sales would change competition in practice.
What the safety debate does—and does not—show
Gun-violence-prevention advocates and the National Shooting Sports Foundation have raised concerns, according to the October 2 report, that fewer face-to-face interactions could make it harder to detect straw purchasing. A straw purchase is when one person buys a firearm on behalf of another person who is the actual buyer.
That is a concern about a possible effect, not a measured outcome of this proposal. Because ATF’s action remains proposed in the materials described above, there is no demonstrated result here showing that the proposed procedures increase or reduce straw purchasing. The debate turns in part on whether remote identity proofing and the other required safeguards can work effectively without the buyer appearing at the dealer’s premises.
