Anthropic’s published policies say it may review conversations flagged for safety and may disclose information to authorities in an emergency involving imminent physical harm or death. Decrypt reported that a human review team referred a Florida woman’s Claude chats to law enforcement after automated systems flagged them. The reported arrest is an allegation—not a finding of guilt—and the case’s outcome has not been verified.
What Decrypt reported about the Florida case
In an October 5, 2026 report, Decrypt said investigators alleged that Carli Michelle Heller, of Bonita Springs, Florida, wrote in a Claude conversation on September 26 that she would attack the Lee County Sheriff’s Office, then said the next day that she had a new gun. According to Decrypt’s account of an arrest report, Anthropic’s automated systems flagged the entries, a human review team escalated them, and the team reported them to law enforcement.
Decrypt reported that deputies detained Heller without incident and that she faced a written-threat charge. The arrest report itself was not independently available in the material reviewed here, so the account of the alleged messages and referral should be understood as reporting attributed to that document, not as a verified finding about what happened.
The case is unresolved in the available information
Decrypt said a court date was set for November 2026. As of October 7, 2026, no official docket or reliable later disposition was verified. An arrest and charge do not establish guilt; this report does not establish that the court date took place or how the case was resolved.

Can Anthropic read Claude chats?
Anthropic’s consumer guidance says conversations flagged for safety review may be analyzed to improve detection and enforcement of its Usage Policy, including training models for its Safeguards team. That describes a possible safety-related use of flagged conversations. It does not establish that Heller’s chat was used to train a model, nor does it mean every customer conversation is routinely read by a person.
Anthropic’s privacy-update information also describes model-improvement use of consumer chats as something users may choose to allow, and lists five-year retention for data used to improve Claude. Those statements concern the published policy information, not what happened to Heller’s account. The available information does not confirm every detail of the policy version cited in Decrypt’s report, including the report’s claim about a three-month period for users who opt out. Check Anthropic’s current, dated privacy terms and account controls for the rules that apply to your use.

Can Claude conversations be sent to the police?
Anthropic’s government-request guidance says it generally discloses customer or end-user information in response to valid legal process, such as a validly issued subpoena or warrant. It also describes an emergency exception: “We will make an exception to this policy if we believe there is an emergency that may result in imminent physical harm or death, and providing such information without delay may avert that emergency.”

The available reporting does not establish whether authorities used legal process, whether Anthropic relied on its emergency exception, or how the company assessed the specific referral. The policy language also does not support a claim that Claude chats are routinely sent to law enforcement.

Is Claude a private diary?
A hosted AI chat should not be treated as a confidential diary or as a protected communication with a lawyer, doctor, or other professional. Anthropic’s published material allows safety-related review of flagged conversations and describes circumstances for emergency disclosure. Those policies do not prove routine human reading of chats, but they do mean that entering something into Claude is not the same as keeping it in a private journal under your sole control.
