Why the headline said “as early as next week”
Tate Ryan-Mosley’s MIT Technology Review story was published on May 21, 2021. It reported that the George Floyd Justice in Policing Act was expected to reach the Senate in the coming week, ahead of the May 25 anniversary of George Floyd’s death. The story also described pressure on technology companies and lawmakers. Amazon had extended indefinitely its moratorium on police use of Rekognition, while advocacy groups were seeking a permanent ban. Those are reports about the situation in May 2021, not statements of Amazon’s current policy. The article noted that company decisions would not regulate the whole market and that Congress had not enacted a broad federal law covering facial recognition across law-enforcement, government, or commercial settings at that time. What the 2021 proposals would have done
The 2021 debate involved several different legislative paths, not one settled federal rule. The proposals varied in which actors and uses they covered and in how they would impose limits.

In 2021, Kate Ruane, then senior legislative counsel at the ACLU, described a moratorium as the best-case outcome in her view: “I think best-case scenario is that Congress passes a moratorium on the use of it.” That was her assessment of the policy debate, not a description of law or a current institutional position. A later proposal: the Facial Recognition Act of 2025
Federal legislative activity continued after 2021. H.R. 4695, the Facial Recognition Act of 2025, was introduced on July 23, 2025, and referred to the House Judiciary Committee and the Committee on Science, Space, and Technology. The available procedural information establishes introduction and referral only; it does not establish whether H.R. 4695 later advanced, passed, or became law. It is also not interchangeable with the 2021 moratorium proposal: the 2025 bill is described as addressing law-enforcement use, while the 2021 bill text proposed limits on federal biometric surveillance and certain grants tied to state and local government conduct.

- Who is covered? Federal agencies, state and local authorities, private companies, or some combination.
- Which uses are covered? Law enforcement, government activity more broadly, commercial applications, or a narrower category.
- What is the mechanism? A ban or moratorium, conditions on federal funding, or procedural safeguards.
- How far has it progressed? Introduction, committee action, passage by one or both chambers, or enactment. A bill’s introduction is not a change in law.
These distinctions matter because a limit on federal agencies would not automatically govern local police or private commercial systems. Likewise, a funding condition is different from a direct nationwide prohibition.
