Protect customer data by limiting what an AI sales feature can access, checking exactly how the vendor uses and retains it, securing accounts and integrations, and preparing for incidents. Treat each feature—not just the vendor’s general privacy statement—as its own data flow: a CRM assistant, call-transcription tool, prospecting feature, and email generator may handle different records and outputs.

1. Map what the AI feature can access and where data goes

Before connecting a sales tool, ask your CRM administrator and sales operations team to trace the information the feature can read, receive, create, and share. The Federal Trade Commission (FTC) recommends tracking where information comes from, where it is stored, and who can access it.

  • List inputs: contact and account fields, notes, email threads, call recordings or transcripts, support history, and connected records.
  • Trace destinations: the AI provider, connected applications, subprocessors, caches, exports, and locations where generated summaries or other outputs are stored.
  • Identify access: note which employees, contractors, administrators, vendors, and integrations can reach each copy.
  • Include endpoints: account for employee devices and third-party platforms where customer information could be copied or retained.

2. Minimize the customer information the tool receives

Give an AI feature only the information needed for its approved sales task. The FTC advises businesses not to collect or keep sensitive information without a legitimate business need; it does not set one universal retention period for AI sales tools.

  • Define the minimum fields and context needed for each use case, such as drafting a follow-up email or summarizing a call.
  • Do not paste payment credentials, government identifiers, authentication secrets, or sensitive personal details into free-text prompts unless a documented need and approved controls justify it.
  • For testing, remove unnecessary identifiers. Prefer a limited, approved CRM integration or record view over copying a customer’s entire history into an unapproved tool.
  • Set retention and deletion rules for prompts, transcripts, and generated content, including copies retained outside the CRM.

3. Check the exact feature’s terms and vendor commitments

Read the applicable product terms, privacy documentation, and contract, and confirm how they apply to your plan and configuration. Ask the vendor for clear answers before enabling the feature:

  • Are prompts, connected CRM records, call transcripts, and outputs retained? For how long, and can your organization delete them?
  • May customer data be used to train, fine-tune, evaluate, or improve models? Does the answer differ across consumer, business, enterprise, or API offerings?
  • Which subprocessors receive data, where is it processed, and what restrictions apply to those providers?
  • Can data-use or retention terms change, and how will material changes be communicated?
  • What do the contract and product settings promise about security controls, access logs, incident notification, investigation support, and data deletion or return?
  • At termination, what happens to backups, derived artifacts, and data in model-related systems?

Keep the answers with the feature’s data-flow record, and reassess them when the product, settings, contract, or connected services change. The FTC says AI services must honor privacy commitments and that material data practices and changes should be clearly disclosed. NIST’s Generative AI Profile recommends vendor due diligence, monitoring third-party risks, reviewing contracts for unauthorized secondary data use, and defining incident responsibilities and notification expectations. These are due-diligence considerations, not claims that every vendor handles data the same way.

4. Secure access, integrations, and stored information

Use role-based or least-privilege permissions across the CRM, AI features, integrations, and exports. Review who can access customer information, revoke access when roles change, and periodically confirm that permissions remain necessary. Enable multifactor authentication, encrypt customer information at rest and in transit, assess connected applications, and monitor access.

The FTC describes access review, data inventories, encryption, third-party app assessment, and multifactor authentication as safeguards for financial institutions covered by the Safeguards Rule. Other organizations should choose controls based on their applicable obligations and a documented risk assessment.

5. Set employee rules and review customer-facing outputs

Publish an acceptable-use policy that names approved AI tools, permitted sales tasks, allowed data classes, prohibited prompt content, and a route for escalating questions or mistakes. Train employees and contractors who can access customer information. NIST recommends acceptable-use policies that address generative AI tools and third-party personnel.

Have a person review AI-generated material before sending it when it contains customer-specific claims or personal information. Check that it is accurate and addressed to the intended recipient; correct errors and remove details the recipient should not see. The FTC also recommends regular security-awareness training for financial institutions covered by the Safeguards Rule.

6. Prepare for a vendor or data incident

Assign an internal incident owner and identify vendor contacts before a problem occurs. Your response plan should explain how to suspend access, preserve relevant logs, investigate affected records, and determine whether contractual or legal notice is required. Include third-party AI services in exercises and revisit the plan when vendors, features, or data flows change.

NIST recommends incident-response plans for third-party generative AI technologies and alignment with applicable breach-reporting and data-protection laws. No single notification deadline applies to every organization or incident; the answer depends on jurisdiction, the data involved, and the facts.

Which legal requirements apply?

There is no single AI-sales privacy rule that applies identically to every business. The FTC Safeguards Rule covers financial institutions within the rule’s definition and requires covered entities to maintain a written, risk-based information-security program. Whether a business is covered depends on its operations and the information involved; the FTC advises businesses to reassess whether their activities bring them within the definition.

Other federal, state, national, sector-specific, contractual, or customer requirements may apply depending on the business, data, and locations. The FTC states, “There is no AI exemption from the laws on the books.” That is a reminder that existing obligations remain relevant, not a determination that one particular law applies to every AI sales tool user.
