Before a proposed U.S. data center is approved, ask for the project’s site plans, permit record, utility and water projections, generator details, and impact studies—and check them with the agencies that have authority over the site. There is no single federal “data-center permit”: land-use decisions and several environmental and utility processes may apply, depending on the project’s location and design.

Start with the proposal and its public record

Request the current project description and the studies, applications, and agency decisions that support it. Separate estimates from measured results: a developer’s projected demand is not the same as a facility’s metered use, and annual averages can conceal peak requirements. Ask who prepared each study, what assumptions and site boundaries it uses, and whether the agency has reviewed or accepted it.

For a useful review, obtain records from both the developer and the relevant public authorities. EPA tools such as ECHO, EnviroAtlas, Cleanups in My Community, MyEnvironment, NEPAssist, and EPA’s permitting-authority map can help identify permits, site context, and possible responsible agencies. Treat them as starting points, not approvals or definitive site assessments; confirm requirements and records with the authority that actually administers each program.

Check these seven areas before a decision

1. Land use, site history, and construction footprint

Ask the planning office and applicant for the zoning status, proposed use, site plan, construction footprint, access and traffic plan, and project schedule. Check whether the land-use decision is discretionary and what hearings, findings, or conditions remain.

Find out whether the parcel is a brownfield, a Superfund site, or subject to another cleanup program. Request the environmental assessment, cleanup status, remaining obligations, and plans for protecting any caps, barriers, groundwater controls, or other engineering controls during construction and operation. EPA’s redevelopment mapper can screen site characteristics and surroundings, but screening is not a finding that land is clean or suitable for a particular use.

EPA’s “Reuse Considerations for Data Centers on Brownfield Sites” says suitable reuse depends on responsible siting, planning and engagement, alignment with cleanup standards, maintenance of engineering controls, and environmental protection. A brownfield may be reusable; the question is whether the proposed work and long-term operation meet site-specific cleanup requirements and preserve required controls.

2. Permits, agencies, and the approval record

Ask the local planning office for the zoning, site-plan, building, traffic, and noise proceedings. Ask the relevant state, Tribal, territorial, or federal environmental authorities which permits apply, who will issue them, and where applications, technical reviews, public comments, and final conditions can be inspected.

Potentially relevant EPA permit programs include air emissions, pollutant discharges, dredge or fill in waters and wetlands, water quality, hazardous waste, and underground injection. EPA directly issues some permits; other programs are administered by authorized states, Tribal Nations, territories, or municipalities, and local or state requirements may add to federal ones. Applicable permits can set operating limits, monitoring, and reporting duties. Do not assume that every listed program applies to every site.

This is a request list, not a determination that a permit or proceeding is required. The responsible authority can identify the operative rules and the actual approval record.

3. Electricity demand, grid upgrades, and who pays

Request the proposed facility’s peak electrical load and annual consumption, the schedule for phased growth, interconnection status, and any transmission or substation upgrades needed to serve it. Ask the developer and utility to explain the expected generation mix, outage planning, and who would pay for each upgrade or other cost.

Check utility filings and regulator decisions for the applicable tariff and cost allocation rather than relying on general assurances about rates, jobs, or infrastructure. The U.S. Department of Energy’s 2025 request for information (RFI) identifies energy prices and infrastructure as siting concerns. EPA’s July 2026 announcement discusses a federal Ratepayer Protection Pledge, but a pledge does not establish the tariff or cost allocation for a particular community.

4. Water supply, cooling, and drought performance

Ask for projected daily, peak, and annual water withdrawals and consumptive use; the source of the water; assumptions about drought; and plans for wastewater and cooling-tower blowdown. Request cooling-system details for normal and peak conditions, and ask how demand would change under alternative cooling configurations. Compare the projections with local supply and other users, not just with a broad industry benchmark.

The DOE Federal Energy Management Program (FEMP) explains that water use in cooling-tower systems relates to heat load and cooling efficiency. FEMP defines water usage effectiveness (WUE) as annual site water usage in liters divided by IT equipment annual energy use in kilowatt-hours. A WUE figure is useful only when its facility boundary, reporting period, and operating conditions are clear; otherwise, comparisons may not be equivalent. Distinguish projected use from metered use.

5. Air emissions and backup power

Request a complete inventory of stationary engines and turbines, their fuel types, proposed permit limits, modeled emissions, expected operating and testing hours, monitoring plans, and the air agency’s permit record. Ask how many units could run at once, including during outages, and whether the application’s operating assumptions match the facility’s backup plan.

EPA identifies stationary combustion turbines and engines as common primary or backup power sources and says they are subject to applicable emissions standards. State and local agencies issue most data-center air permits under approved programs. EPA’s current resource page includes modeling and permitting materials, but rules and agency interpretations can change; verify the operative permit and requirements with the responsible air agency.

EPA’s July 2026 release says its guidance interprets the Acid Rain Program not to apply to certain islanded facilities. That statement does not establish whether a particular proposal is an islanded facility or resolve its other air requirements. Ask the controlling authority to identify the guidance and standards that apply to the project.

6. Noise, construction, and cumulative effects

Request baseline noise measurements and modeled sound levels at nearby homes and other sensitive locations. Ask whether the model includes cooling equipment, generators, and generator testing; what limits are proposed; when testing may occur; how complaints will be handled; and whether post-construction monitoring and corrective action are required.

Review construction hours, truck routes and expected traffic, lighting, dust controls, land disturbance, wetlands, and stormwater plans. Consider cumulative effects alongside existing industrial activity and other approved or proposed projects. DOE’s 2025 RFI raises noise, water, energy prices, land footprint, environmental baselines, and adverse community impacts as siting questions; it does not establish the impacts of an individual project. Site-specific studies and enforceable permit or approval conditions are needed to assess those effects.

7. Public participation and Tribal interests

Ask for project plans and technical studies to be disclosed early in an accessible format, for public meetings before decisions become effectively final, and for a record showing how comments were answered. Where mitigation is needed, ask whether commitments will be written into enforceable permits, approvals, or agreements rather than left as informal assurances.

Identify relevant Tribal governments and ask which cultural resources, archaeological sites, burial grounds, traditional-use areas, treaty rights, or reserved rights may be implicated. DOE’s 2025 RFI expressly raises Tribal engagement, cultural resources, and treaty or reserved rights. Applicable consultation duties and interests depend on the location, affected rights, and authorities involved; consult the relevant Tribal governments and agencies rather than assuming one process fits every project.

Compare proposals on the same basis

If a community is evaluating more than one site or design, request equivalent reporting periods, facility boundaries, and assumptions. A proposal with a lower headline figure is not necessarily lower-impact if its estimate excludes different equipment, phases, or parts of the site.

Noise Measured or modeled sound at the same types of nearby receptors, plus enforceable limits and monitoring
Construction Traffic, truck routes, work hours, and schedule
Accountability What is disclosed, how comments are answered, and whether mitigation or community commitments are enforceable

Use engineering figures cautiously

FEMP gives a broad comparison of a power usage effectiveness (PUE) of 2.0 for average-efficiency data centers and says highly efficient centers can approach the theoretical minimum PUE of 1.0. These are general guidance figures, not a guarantee or a directly comparable estimate for a proposed facility. Request the project’s definition, boundary, expected operating conditions, and supporting engineering analysis.

FEMP also describes up to 20% less chiller energy for certain air-management practices in its Best Practices Guide. That is a conditional energy-saving figure, not a promised reduction for a particular site. Ask for project-specific evidence before applying it to a proposal.

Turn unanswered questions into specific records requests

  1. Identify the decision and its deadline. Ask the planning office which applications, hearings, votes, and comment periods remain, and request the public notice and docket or file number.
  2. Request records from the authority that holds them. Seek applications, studies, correspondence, technical reviews, comments, draft and final permit conditions, and decisions from the relevant local, state, Tribal, territorial, utility-regulatory, or federal office. Public-records procedures and deadlines vary by jurisdiction.
  3. Ask for missing assumptions in writing. If a projection lacks a boundary, period, peak value, operating scenario, or cost allocation, ask the applicant and reviewing agency to specify it before comparing figures.
  4. Track whether commitments are enforceable. For each proposed mitigation measure, note the responsible party, trigger, monitoring method, reporting frequency, corrective action, and document that makes it binding.
  5. Keep a question-and-response record. Submit comments through the official process, cite the application or study at issue, and ask the decision-maker to respond in the record before acting.

General federal resources can help identify issues and starting points; they do not decide whether a local proposal should be approved. The controlling record is the project’s site-specific application, applicable permits and land-use decisions, utility and regulator filings, and the conditions imposed by the authorities with jurisdiction.
