If an online price changes between visits—or even while you are deciding whether to buy—the seller may be using dynamic pricing: changing prices in response to conditions such as demand, stock, or timing. That does not automatically mean the store has identified you personally and chosen a price just for you. Market-responsive pricing and personal-data-based price personalization are different practices, and the distinction matters when you assess what you are seeing.
What is dynamic pricing?
There is no universally agreed definition. The UK Competition and Markets Authority (CMA) says, “The term ‘dynamic pricing’ does not have a commonly-agreed definition.” For its 2025 project, it uses the term for situations where firms “adjust prices rapidly and frequently in response to changing demand conditions.” CMA, Update: dynamic pricing (2025)
In e-commerce, the practical idea is that a seller changes a listed price as circumstances change rather than keeping it fixed for a long period. How often a price changes, which inputs affect it, and whether the change happens automatically vary by seller and sector. The CMA’s examples and findings include travel, rail, hotels, ride-hailing, and live events, so they should not be treated as controlled evidence about how every online retailer sets prices.
Why do online prices change?
A store may adjust prices to respond to market conditions or manage limited stock and selling opportunities. The inputs can include:

- Demand: A seller may raise or lower a price as demand for an item or service shifts.
- Remaining inventory or capacity: The price may change as stock runs low or as a seller manages a limited number of places, bookings, or units.
- Time: A seller may account for how long remains before a booking, event, or sale opportunity.
- Competitor prices: Some businesses include competitors’ prices in a broader revenue-management strategy.
These are possible inputs, not a universal formula. A business may automate some adjustments and review others manually. It may change prices by small or large amounts, hold an advertised price during checkout, or allow it to change before the purchase is complete. Dynamic pricing is often used where supply cannot quickly expand and what is being sold is perishable—for example, a particular seat on a particular flight. Once the moment to sell that seat has passed, it cannot be sold later. The CMA says this approach can help businesses use capacity, improve efficiency, maximize profits, and potentially invest in additional capacity. Those are possible business and market effects, not a guarantee of lower prices or a consumer benefit in every case.
How can dynamic pricing affect shoppers and competition?
Effects depend on the market, the seller’s ability to set prices, and how the system is implemented. Where supply is fixed in the short term, changing prices can help allocate limited capacity. Where supply is more flexible, a higher price during a demand peak may bring additional supply online; the CMA gives ride-hailing drivers as an example. That sector example describes a possible mechanism, not proof that the same effect occurs in ordinary online retail.

There are also consumer risks. A shopper may not realize prices are changing, may feel pushed to decide quickly, or may have difficulty comparing an offer if the seller gives little information about its pricing approach. The CMA also identifies the possibility that vulnerable consumers pay more than others. It is particularly concerned when pricing practices are used to obtain or maintain market power or to make it harder for competitors to enter a market. CMA (2025)
AI-enabled personalized pricing raises related but distinct policy questions. The OECD’s 2025 discussion describes possible concerns involving detailed consumer data, market power, exclusion, and consumer surplus, while emphasizing that effects are context-dependent and that some competitive implications need further analysis. This is a discussion of potential risks, not evidence that every algorithmic pricing system produces those outcomes. OECD (2025)
Dynamic pricing is not the same as personalized pricing
Dynamic pricing changes a price in response to changing market conditions, such as demand, inventory, or timing. Personalized pricing uses information about a particular consumer to set a price based on what the seller estimates that person may be willing to pay. Automated systems can combine market and personal inputs, but the terms are not interchangeable.

In January 2025, the US Federal Trade Commission (FTC) described staff analysis indicating that data intermediaries could use signals such as location, demographics, browsing patterns, shopping histories, mouse movements, and items left in an online cart to tailor prices or promotions. The FTC noted that the intermediaries examined worked with at least 250 clients, including grocery and apparel sellers. That is a client count in the study context, not an estimate of how many retailers use personalized pricing. The FTC also said its staff perspective used hypothetical examples and that the study was ongoing at the time. One hypothetical described a new-parent profile being shown a higher-priced baby thermometer; it was not a finding that a named retailer had done so. FTC (January 2025)
Available sources do not establish a representative share of e-commerce businesses using either dynamic or personalized pricing. A changing price alone also does not show that a seller used your personal data; identifying the inputs behind an individual retailer’s price may require information the retailer has not made public.
What rules apply to changing online prices?
There is no single worldwide rule. The requirements below are jurisdiction-specific guidance and should not be read as legal advice for other places. The legal question often depends not simply on whether a price changes, but on what information the seller gives consumers and how the price is presented.

The FTC’s May 2025 FAQ for its Rule on Unfair or Deceptive Fees says businesses may use dynamic pricing based on demand or inventory when pricing information is not misleading. The FAQ also discusses total-price and fee disclosures in contexts covered by that rule; it is not a blanket determination that every pricing technique is lawful. Separately, an August 2026 FTC release sought public comment on a draft enforcement policy statement concerning personalized pricing. It defined the practice as using personal data to set prices according to what a company believes an individual is willing to spend. The release set a September 18, 2026 comment deadline, which had passed by October 4, 2026; the release describes a proposal, not a final rule. FTC Chairman Andrew Ferguson said of the draft: “The FTC does not have the legal authority to ban personalized pricing in all circumstances, but businesses that fail to tell consumers how their personal data is being used to set a price may be in violation of the FTC Act and other laws we enforce.” That is his statement about the proposed policy, not a definitive adjudication of any particular company’s conduct. European Union
Your Europe says traders must tell consumers when a price has been personalized through automated decision-making and profiling of the consumer’s behavior. That disclosure guidance concerns personalization; it does not mean every market-responsive price change requires a personalized-pricing notice. For covered price-reduction claims, the guidance also says the reference price must be the lowest price applied during at least the preceding 30 days, subject to relevant rules and exceptions. United Kingdom
The CMA’s June 2025 update says UK consumer law does not generally prohibit a pricing strategy simply because it is dynamic; implementation and communication with consumers matter. Consumers need material information to make informed transactional decisions. Depending on the circumstances, useful information may include that prices can change, what makes them change, and a price range. An invitation to purchase must state the total price, and changing a price after a consumer has proceeded through checkout can raise legal concerns. The CMA also describes the Digital Markets, Competition and Consumers Act 2024 enforcement regime, which can include fines of up to 10% of global turnover for relevant consumer-law infringements. A single price change rarely tells you why it happened. To compare a retailer’s approach or a pricing system, look for the information that would help distinguish market response from personalization and make the offer easier to evaluate:
- Inputs: Does the retailer explain whether prices respond to demand, stock, timing, competitor prices, or individual-level data?
- Frequency and scale: How often does the price change, and how large are the changes?
- Checkout treatment: Is the shown price held while you complete the purchase, or can it change before payment?
- Transparency: Is the pricing policy, total cost, or relevant price range easy to find?
- Safeguards: Does the business describe caps, manual review, or consideration of vulnerable consumers?
- Applicable rules: Which country’s consumer protections apply to the transaction?
These are practical comparison questions, not a regulator-issued checklist. A seller may not publish enough detail to answer all of them.
