Open-source license compliance is a release process, not a scan or a one-time SBOM export. For each product or release, identify the components it contains, verify their license terms, assess obligations in the context of how the software is used and distributed, and preserve the evidence and notices needed to support release. Automation can help find components and organize evidence; uncertain license interpretations require informed human review and, when appropriate, legal counsel.

What compliance needs to establish

A workable process answers four questions for every component in a release: What is it? Which license terms actually apply? What do those terms require in this use and distribution context? What evidence and materials must accompany the release?

Keep those questions distinct. A scanner’s license match is a lead for review, not a legal determination. A publicly readable repository does not by itself make code open source, and a copyright notice alone does not grant permission to use or distribute the work. Confirm the license from the actual package materials and, where needed, an authoritative copy of the license text.

Build a repeatable compliance workflow

1. Inventory what ships

Start with the contents of the product or release being supplied—not just the top-level project or a developer’s list of direct dependencies. Record components across the development lifecycle, including relevant versions and the evidence used to identify them. The OpenChain practical guide describes maintaining a component record and SBOM, and names FOSSology, ORT, Syft, and cdxgen as automation examples.

Choose a bill of materials format that fits the process. OpenChain recommends SPDX or CycloneDX. An inventory is useful only if it remains tied to a particular product and release and can be updated when that release changes.

2. Confirm license identity

Check package metadata, included license and notice files, copyright statements, and the project’s authoritative license information. Where an SPDX identifier is present, use it as a valuable shorthand for locating and recording a license, then confirm that it matches the actual materials and terms. Identifiers can speed review but do not replace the license text.

Record uncertainty rather than silently resolving it. If files contain conflicting notices, the package has non-standard terms, or the license cannot be confirmed, route the issue for review before approval.

3. Review obligations in context

Document the relevant rights, obligations, and restrictions for each component, along with the reason the component was approved. The analysis depends on the terms that apply and the way the software is used or supplied. OpenChain’s guide recommends considering whether software is distributed as a binary, offered as SaaS, or used internally; do not assume one distribution scenario has the same obligations as another.

License obligations are specific to the license and facts. For example, OpenChain’s summary identifies notice requirements for MIT and BSD-2-Clause, and source-disclosure and same-license terms for GPL-2.0 on distribution. These are orientation points, not substitutes for checking the applicable license version, exact text, and circumstances. Escalate uncertain interpretations, conflicts, non-standard terms, or commercial restrictions to counsel.

4. Approve and preserve evidence

Make approval part of the release process. Keep the component record, license confirmation, obligation review, approval decision, and any escalation together so that the team can explain why a component was accepted. The OpenChain guide describes registering and retaining an SBOM, providing it upon distribution where appropriate, updating it after changes, and archiving it.

Build-time or CI/CD automation can help detect changes and keep records current, but it should support a documented review and approval procedure rather than silently turn a match into an approval.

5. Assemble release materials

Use the reviewed components and applicable license terms to prepare the materials required for the release. Depending on those terms, these may include license texts, copyright notices, attribution information, or source code or a written offer. Check the actual release package and its accompanying documentation for completeness before distribution.

6. Reassess changes between releases

When components are added, upgraded, replaced, or removed, reassess the affected records and release materials. The Linux Foundation guide describes comparing BOMs between versions to identify added, updated, and retired components. A BOM diff is a useful change signal: it does not determine whether a changed component is legally acceptable or whether the release artifacts are complete.

What common license examples mean for release work

BSD-2-Clause: retain and reproduce required notices

The Open Source Initiative’s BSD-2-Clause text requires retaining the copyright notice, conditions, and disclaimer in source distributions, and reproducing them in documentation or other materials supplied with binary distributions. Check that the relevant notices make it into the actual form of release rather than assuming a repository file will accompany a binary.

GPL version 2: check source conditions for object-code distribution

GPLv2 sets conditions for distributing object code, including ways to provide source code and requirements about what corresponding source means. The release review should use the actual GPL version and terms applicable to the component and determine which source-provision path, if any, fits the distribution. Do not substitute a generic “GPL” label for that analysis.

These examples illustrate why a notice-generation step and a license review are separate tasks: preserving required text is essential, but it does not alone establish that every obligation has been met.

Choose tools by the job they perform

The Linux Foundation describes OpenChain, SPDX, and FOSSology as different layers rather than interchangeable products. The OpenChain guide also names ORT, Syft, and cdxgen as automation examples. The cited material identifies use cases, not controlled performance comparisons.

Compare candidates against the needs of your own release process. Useful evaluation criteria include:

  • Component coverage and license identification, including how findings can be checked against source evidence.
  • Whether the tool exposes evidence that a reviewer can inspect and supports SPDX or CycloneDX output.
  • Integration with builds and CI/CD, plus SBOM update and version-diff workflows.
  • Support for preparing notices or other release artifacts and for routing policy exceptions and approvals.
  • Data handling and the level of human or legal support needed to interpret results.

Treat claims about accuracy or completeness as claims to validate for the specific products, languages, build process, and policy in scope. The cited sources do not provide a controlled head-to-head tool comparison.

Use OpenChain as a program framework

OpenChain ISO/IEC 5230:2020 provides a framework for locating responsibilities and repeatable process steps across an organization. The OpenChain Project says an organization can adopt it through self-certification or work with an official partner for independent assessment or third-party certification. The project dates the standard’s graduation to December 2020.

For a team building or improving a program, the practical value is process ownership: make clear who maintains the inventory, confirms licenses, reviews obligations, approves exceptions, prepares release materials, and archives evidence. A framework can help organize those responsibilities; it does not replace review of the terms that govern a particular component.

A release-readiness checklist

  • The inventory corresponds to the exact product and release being supplied.
  • Component and version information, license evidence, and relevant notices have been recorded.
  • Automated identifications have been confirmed against package materials and applicable license text.
  • Obligations have been reviewed in light of modifications, combinations, and the mode of use or distribution.
  • Conflicts, non-standard terms, commercial restrictions, and uncertain interpretations have an identified reviewer or escalation path.
  • Required license texts, notices, attribution information, and applicable source-code materials or written offers are prepared for the release.
  • The SBOM and supporting evidence are registered and retained, with a plan to update them when components or versions change.

The Linux Foundation’s quick reference calls the SPDX license identifier “a critical first step” toward easier and more accurate compliance. The useful operational reading is “first step”: a clear identifier helps organize the work, while verification, obligation review, approval, and release preparation complete it.
