It depends on what “creating” means. A person may set a goal, direct a tool, select and arrange results, or revise them, while the AI generates some of the expressive material. For copyright, the key question is narrower: what human-authored expression, if any, is sufficiently present under the law that applies? The answer differs by country.

Four different questions are hidden in “who created it?”

Everyday credit, copyright authorship, ownership, and responsibility for publishing a work are related, but they are not interchangeable. A person can initiate a generation without necessarily authoring all of its expression; an authorship rule does not, by itself, answer every question about ownership or publication.

  • Who directed the process? A person may describe a goal or give instructions.
  • Who determined the expressive elements? This asks who made the creative choices apparent in the work, and is central to the U.S. Copyright Office’s approach.
  • Who is treated as the author under local law? The answer may depend on jurisdiction and, in the UK, a specific statutory rule for certain computer-generated works.
  • Who must disclose or mark the content? Transparency requirements address particular content and actors; they do not automatically decide authorship or ownership.

There is no single statistic in the official materials reviewed that measures who is “actually creating” in the broader philosophical or social sense. The reported figures concern public submissions and a policy consultation, not a measurement of creative contribution.

Does writing a prompt make you the author?

Not automatically. In its January 29, 2025 report on copyrightability of generative AI outputs, the U.S. Copyright Office says protection depends on whether a human determined sufficient expressive elements. It identifies human-authored material that can be perceived in the output, a creative arrangement of material, and creative modifications as possible bases for protection. Merely supplying prompts is not enough on its own.

When a person contributes protectable expression

AI assistance does not, by itself, disqualify a work from copyright protection. A person’s own expression may remain protectable when an AI tool assists the creative process or contributes material to a larger human-generated work. The question is which parts reflect sufficient human authorship, not simply whether AI was used.

When the person mainly requests a result

A prompt can communicate an idea or desired outcome without necessarily giving the person sufficient control over the resulting expression under the U.S. approach. The Copyright Office’s test is not simply whether a human started the process: it focuses on human-determined expressive elements. The assessment depends on the contribution and the work, so a prompt alone should not be treated as a guarantee of copyright.

How the answer differs in the United States, United Kingdom, and EU

The following is a comparative orientation based on U.S. Copyright Office materials and the UK government’s 2026 Report on Copyright and Artificial Intelligence. It is not a universal rule; other jurisdictions may differ, and outcomes depend on the facts and work type.

United States The Copyright Office focuses on sufficient human-determined expressive elements. Prompts alone are not enough; human-authored material, creative arrangement, or creative modification may be protectable. The Office’s January 2025 position is that existing law is adequate and additional protection for AI-generated output is not warranted on the record it reviewed. Its approach does not create a specific rule assigning authorship of a wholly computer-generated work to someone.
United Kingdom For certain computer-generated literary, dramatic, musical, or artistic works with no human author, section 9(3) of the Copyright, Designs and Patents Act 1988 treats the person who made the arrangements necessary for creation as the author. The 2026 report says that, for a general-purpose AI responding to a user prompt, this will usually be the person who input the prompt. The report describes a 50-year term from creation for these computer-generated works. It also discusses possible reform; those policy options are not enacted changes.
European Union The 2026 UK government report describes EU copyright originality as requiring the author’s intellectual creation and free and creative choices. It says EU copyright does not provide specific protection for computer-generated works without a human author. The report separately describes certain AI Act transparency requirements for generated or manipulated content. Those requirements concern transparency, not a special copyright authorship rule.

Why the UK prompt rule does not settle the question everywhere

The UK provision is a jurisdiction-specific statutory rule for certain works with no human author. It should not be generalized into “the person who types a prompt is always the author.” The U.S. Copyright Office instead asks whether sufficient human-authored expression is present, and the UK government report describes EU originality in terms of human intellectual creation and free and creative choices. A similar act—entering a prompt—can therefore sit within different legal frameworks.

Does an AI label tell you who owns the work?

No. The UK report describes EU AI Act requirements that include machine-readable marking for certain synthetic outputs and disclosure by deployers in defined deepfake and public-interest contexts, subject to exceptions. Those are transparency duties: they do not, by themselves, identify who determined the expressive elements or who owns copyright. Which duty applies depends on the content, actor, and circumstances; for compliance, consult the applicable EU rules and implementation guidance.

What the current policy debate does—and does not—show

The U.S. Copyright Office said more than 10,000 responsive comments informed its conclusions. That is a count of submissions, not a poll showing public opinion. Its separate Part 3 concerns AI training and licensing, a different issue from Part 2’s question of copyrightability in outputs. The Office’s initiative page said a pre-publication version of Part 3 was released May 9, 2025, with a final version to follow; the training-data debate should not be treated as a ruling on who authored a particular output.

In the UK, 78% of online survey respondents who answered the relevant consultation question opposed maintaining current computer-generated-works protection, according to the 2026 government report. Fewer than half of consultation respondents answered the relevant questions, so this is not representative of the public. The report describes the government as assessing policy options; consultation responses and proposed reforms are not themselves a change in law.

A practical way to describe an AI-assisted work

When explaining who made something, be specific about the contribution rather than using “AI-created” or “human-created” as if either label answered every question. For example, distinguish the material generated by a tool from the parts a person wrote, selected, arranged, or creatively modified. Then treat legal authorship, ownership, disclosure, and publication responsibility as separate matters to assess under the rules that apply to the work and location.

This distinction also helps avoid claiming more than the available evidence establishes: a person’s role in directing a process is not identical to control over its expressive result, and a legal rule assigning authorship in one country does not establish who deserves social credit in every sense.
