Usually, accountability does not stop at the AI agent. It depends on what happened, where it happened, who built and supplied the system, who configured and deployed it, and which legal duties and remedies apply. “Rogue” describes a scenario, not a legal category: the software itself is not a substitute for identifying the people or organizations whose decisions or conduct may have caused harm.
What does “accountable” mean in an AI-agent incident?
There are two different questions: whether an organization complied with rules governing AI, and whether someone harmed by an incident can obtain compensation. Those questions may involve different laws, parties and proof. A regulatory breach does not automatically establish a right to damages, and an incident that causes harm does not by itself prove a regulatory violation.
The European Commission’s AI Act Service Desk says “AI agent” is not a separate legal category under the AI Act. The Act instead covers agents through its existing definitions of AI systems and general-purpose AI (GPAI) models. The system’s label therefore does not settle who is responsible.
Which people or organizations could be responsible?
The role that matters depends on the alleged failure and the applicable law. An organization may occupy more than one role: for example, it might select a provider’s model, connect it to business tools and deploy it in a customer-facing workflow.

What should be established before assigning responsibility?
Start with the incident facts, not with the description “rogue.” The following are practical investigation steps, not a quoted statutory checklist.
- Locate the relevant events. Record where the system was marketed, deployed and caused effects. Identify the country and, where relevant, the state or EU member state; applicable law can vary.
- Fix the timeline. Note when the product was placed on the market, when the system was deployed, when updates or configuration changes occurred and when the incident happened. For EU product-liability claims, the market-placement date is especially important because of the transition to the revised directive.
- Preserve how the agent operated. Retain prompts, outputs, tool calls, permission settings, logs, model and software versions, integrations, human approvals, monitoring records and relevant updates. Preserve the output that a person or system acted on.
- Map control to each decision. Establish who selected the system, granted access, connected external tools, set operational limits, supervised it and could intervene. Separate those decisions from the provider’s design and update decisions.
- Document the harm and causal chain. Identify what was damaged and how the agent’s conduct, an alleged defect or a human decision contributed. Under the European Commission’s summary of revised EU product-liability rules, a claimant must prove defectiveness, damage and that the defect caused the damage; access to relevant evidence is subject to legal conditions.
- Identify the legal route. Regulatory enforcement, product liability, negligence or another civil claim, contract, privacy, consumer protection, employment and sector-specific rules ask different questions. Which route is available depends on jurisdiction and facts.
What does EU law say, and which dates matter?
The EU AI Act and product-liability law address different parts of the problem. The AI Act regulates actors including providers and deployers; a claim for compensation requires a separate applicable legal route. The European Commission AI Act Service Desk’s FAQ describes agents as covered by the Act’s existing AI-system and GPAI-model definitions rather than as a separate category.

AI Act application dates for agents
According to the Service Desk FAQ, transparency rules apply from 2 August 2026 to agents intended to interact with natural persons or generate content. The FAQ gives later application dates for high-risk AI system requirements: 2 December 2027 or 2 August 2028, depending on the system. These are not blanket deadlines for every agent; the category, transitional provisions and current official guidance must be checked for a particular deployment.
Transition to the revised Product Liability Directive
Directive (EU) 2024/2853 covers software, including AI systems. The European Commission says it entered into force on 8 December 2024. EU countries have until 9 December 2026 to transpose it into national law, and the revised rules apply to products placed on the market from that date. The 1985 directive remains applicable to products placed on the market before then. Entry into force, the national transposition deadline and the date from which the revised rules apply are separate milestones.

Under the Commission’s overview, a manufacturer may be liable for a defect that existed when software or an AI system was released even if the defect becomes apparent later through an update, upgrade or machine-learning feature. A product is defective if it does not provide the safety a person is entitled to expect or that the law requires. The revised framework describes covered harm as death or personal injury, including physical and psychological harm, property damage, and destruction or corruption of data, subject to the directive’s rules and exceptions.

The official US materials covered here do not establish one comprehensive federal or state liability rule for AI agents. The answer remains an existing-law, jurisdiction-specific inquiry; applicable rules and outcomes may depend on the conduct, harm and facts of a case.

The National Institute of Standards and Technology describes its AI Risk Management Framework as voluntary guidance for organizations designing, developing, deploying or using AI. It can inform risk management, but it is not a statute that determines damages liability. A 2023 Congressional Research Service report describes existing legal frameworks and agency authorities that may apply and explains that AI liability allocation develops through courts, agencies and legislatures. That report is useful for this limited point, not as a current inventory of every state law, agency action or later case outcome.
