Sometimes—but commercial permission is not the same as copyright ownership or complete legal clearance. In the United States, whether you can use an AI-generated image commercially depends on the image service’s contract and plan, the human creative contribution, and any third-party rights involved. Here is how to check those issues before using an image in an ad, product, website, or other paid work.
Commercial permission and copyright protection are different
An image generator’s terms may allow you to use an output in commercial work. That permission is a matter of your contract with the service. It does not, by itself, mean the output qualifies for copyright protection or that you have cleared every other right connected to it.
Under section 102 of the U.S. Copyright Act, copyright covers original works of authorship fixed in a tangible medium, including pictorial, graphic, and sculptural works. The U.S. Copyright Office’s January 29, 2025 report on AI copyrightability explains that U.S. copyright requires human authorship. It distinguishes human expression made with AI assistance from expressive elements determined by the machine. The Copyright Office’s AI initiative page provides related agency materials.
So an image may be contractually permitted for a business use even if the generated expression itself is not copyright-protected. Conversely, protectable human expression in an AI-assisted work does not automatically resolve the generator’s contract restrictions or other people’s rights.

What human contribution can affect copyright?
A prompt alone does not settle authorship
Writing a prompt—even a detailed one—does not automatically make the resulting image human-authored for copyright purposes. The key question is whether a person contributed protectable expression or whether the model determined the image’s expressive elements. The Copyright Office’s report does not treat prompt complexity alone as a guarantee of copyrightability.
Human-authored expression may qualify
Original human-created elements may be protectable when they meet the legal standard. Examples can include a human-drawn illustration, original text, substantial creative edits, or an original selection and arrangement of material. Those contributions may be protected on their own or as part of a larger work that also contains AI-generated material. Whether a particular contribution qualifies depends on the facts; using AI does not guarantee that the output, or a human-modified version, can be registered or enforced as copyrighted.

Check these terms and rights before commercial use
- Find the terms for the exact product and feature. Confirm that the current agreement permits your intended use of generated images. Do not assume one company’s rules apply to another tool, or that rules for one product apply to every feature.
- Check plan and business-size conditions. Look for restrictions tied to a subscription tier, company revenue, or the account holder. Confirm that the plan in effect when you create and use the image covers your situation.
- Read what “ownership” means in context. Check whether the contract qualifies ownership by applicable law, preserves third-party rights, or grants the service a license to your prompts, uploaded materials, or generated assets.
- Review visibility and sharing defaults. Determine whether images are public, remixable, or visible in shared spaces. A private business intention does not change a service’s default settings.
- Check inputs and the final image for others’ rights. Review rules about uploaded source material and consider whether the result includes protected artwork, a recognizable person, a trademark, or other material that requires permission.
- Keep records. Retain the service and plan used, the applicable terms, prompts and source materials, and meaningful human edits. This is a risk-management practice, not a legal requirement established by the sources cited here.
How the reviewed Midjourney and Adobe terms illustrate the differences
These are examples of specific service rules, not universal standards for AI image generators. Terms can change, so check the live agreement that applies to your account and use.
Midjourney: ownership language with conditions
The Midjourney terms reviewed say users own assets they create “to the fullest extent possible under applicable law,” subject to the agreement and third-party rights. They require a company—or an employee of a company—with more than $1,000,000 in annual revenue to subscribe to Pro or Mega to own assets under those terms. That contractual wording is not a government determination that every generated image has copyright protection.

The same terms grant Midjourney a perpetual, worldwide, non-exclusive, sublicensable, royalty-free, irrevocable license over input content and generated assets. In public settings, content is public and remixable by default; assets made in shared spaces remain visible to people in those spaces. Midjourney’s separate commercial-use help page also says another user’s upscaled image remains that creator’s and requires permission.
Adobe: rights restrictions do not establish every plan’s commercial grant
Adobe’s generative AI guidelines prohibit creating, uploading, or sharing content that violates third-party copyright, trademark, privacy, publicity, or other rights. They also warn that generated outputs may be inaccurate or misleading and call for user judgment when validating them. The guideline reviewed does not establish the commercial terms for every Firefly product or plan, so check the specific product terms and account agreement.

Commercial use does not clear third-party rights
A service’s permission to use an output does not necessarily give you permission to use someone else’s protected material, name, likeness, or mark that appears in it. Midjourney’s terms leave third-party rights in place and make users responsible for their content and inputs; Adobe’s guidelines expressly prohibit certain rights-violating uses. Check the relevant permissions and applicable law before publishing or selling an image, particularly in advertising or other high-visibility uses.
This article addresses the U.S. framework. Copyright and related rights vary by country, and these sources do not resolve the status of a particular image, model-training legality, or pending litigation. For a consequential commercial project, evaluate the actual image, the applicable contract, and the relevant rights with qualified legal help.
