The arrests were allegations, not proof of guilt; the U.S. Department of Justice later reported that Bourret pleaded guilty and that both men were sentenced.
What was Photofucket?
Photofucket was software that the indictment alleged could circumvent privacy settings on Photobucket, an image- and video-hosting website. According to the Justice Department, it was used to access and copy private or password-protected images and videos without authorization. The government also alleged that the defendants obtained guest passwords for protected albums and supplied passwords to paying users.
The alleged scheme was intended to make money by selling passwords, access, and private material. These were claims in the indictment announced at the time of arrest, not facts established simply by the arrests. The Justice Department’s May 8, 2015 announcement said both defendants were presumed innocent unless and until proven guilty.
Who was arrested, and what did prosecutors allege?
The defendants were Brandon Bourret and Athanasios Andrianakis. The Justice Department announced their arrests on May 8, 2015, in connection with an indictment alleging conspiracy and fraud-related offenses. The announcement described the charged conspiracy period as July 12, 2012, through July 1, 2014.
